HomeMy Public PortalAboutRES-CC-2005-18Resolution # 18-2005 A RESOLUTION APPROVING AN INTERLOCAL AGREEMENT AS TO THE FUNDING OF A TEEN CENTER DIRECTOR BY AND BETWEEN THE CITY OF MOAB ("CITY") AND THE GRAND COUNTY SPECIAL SERVICES RECREATION DISTRICT ("DISTRICT") WHEREAS, the Interlocal Agreement as to the Funding of a Teen Center Director, by and between the City of Moab and the Grand County Special Services Recreation District, has been presented to this meeting of the Moab City Council, and is attached to this resolution. NOW, THEREFORE, we, the Governing Body of the City of Moab do hereby approve the attached agreement in substantially the form presented to this meeting of the Moab City Council, and authorize the appropriate officials to sign and execute said agreement. This resolution shall take effect immediately upon passage. Passed and adopted by action of the Governing Body of the City of Moab in open session this 14th day of June, 2005. Sakrison Mayor Rachel Ellison City Recorder_ Page 1 of 1 Resolution # 18-2005 INTERLOCAL AGREEMENT AS TO THE FUNDING OF A TEEN CENTER DIRECTOR BY AND BETWEEN THE CITY OF MOAB ("CITY") AND THE GRAND COUNTY SPECIAL SERVICES RECREATION DISTRICT ("DISTRICT") RECITALS WHEREAS, the Interlocal Cooperation Act (Sections 11-13-1 et. seq. Utah Code Annotated) allows local governmental agencies to enter into agreements that benefit the constituencies of the agencies entering into said agreements; and WHEREAS, the City will operate the Moab Teen Center located at 203 East Center Street in Moab after July 1, 2005; and WHEREAS, the District has agreed to fund a portion of the salary and benefits for the Teen Center Director in an amount not to exceed $20,000. AGREEMENT 1. Financial Responsibilities. The parties hereby agree that the District will fund 000 toward the cost of the salary and benefits of the Moab Teen Center Program Director. Said payment shall be due to the City on or before August 31, 2005. The parties agree that should the City not utilize all of said funds by June 30, 2007, any remaining funds shall be returned to the District by July 30, 2007. 2. Provision of Services. The City agrees to operate the Moab Teen Center and provide supervision for the Teen Center Program Director for a six month period beginning after July 1, 2005. 3. Administration of Agreement. The parties agree that the City Manager and the District Board Chair will administer this agreement. 4. Control of Property. Pursuant to Section 11-13-7, Utah Code Annotated, each party to this agreement shall exercise control over its respective property that is provided in fulfilling its obligations under this agreement. The parties agree that the District shall have no responsibility or liability associated with the operation of the Moab Teen Center or the activities of the Moab Teen Center Program Director. 5. Effectiveness and Duration of Agreement. This agreement shall become effective immediately upon its approval by resolutions of the parties' governing bodies and by execution of the agreement by the appropriate officials. This agreement shall remain in effect until the satisfaction of the obligations provided for herein, or written notification by the City to the District that the contemplated services will not be provided.
