McCarty Street Large Conference Room ATTENDEES. Committee members present:Jim Branch, Mark Schreiber,Glen Costales, Rick Mihalevich, Erin Wiseman Staff present:Drew Hilpert,Jayme Abbott, Matt Morasch, Eric Seaman Others present:Mayor Carrie Tergin, Madeleine Leroux (News Tribune), Councilman Carlos Graham Meeting came to order at 8:00 a.m. Councilman Costales made a motion to approve the minutes which was seconded by Councilman Schreiber.The motion passed 4-0. Honoring Citizen Board Members.Councilman Graham discussed his desire to see that Citizen Board and Commission members who have served their full allotted term receive recognition at a City Council meeting. The Committee also discussed that the Committee/Board/Commission from which the individual served would be invited to their meeting and thanked for their work as well. In addition the Committee discussed their desire to similarly honor long time employees who are retiring from the City. City Counselor Drew Hilpert advised he would draft a resolution for this plan and bring it back to the Administration Committee next month Reorganizing the Environmental Quality Commission. Presented by Jayme Abbott. Mrs. Abbott explained a proposed ordinance to reorganize the EQC as their current purpose has been completed and they have been seeking new direction. This bill would redefine them toward a community wellness purpose. After discussion and questions, Councilman Mihalevich made a motion to move the bill onto the Council with one amendment: to change “ to be determined” to “ Environmental Quality Commission” which was seconded by Councilman Schreiber. The motion passed 5-0. Councilwoman Wisemen left the meeting after the vote. Cemetery Board Membership. Presented by Jayme Abbott. Mrs. Abbott explained a proposal to change the membership of the Cemetery Board to 7 members, rather than 5. After discussion and questions, Councilman Schreiber made a motion to move the bill onto the Council which was seconded by Councilman Costales. The motion passed 4-0. Reorganization within Wastewater Presented by Matt Morasch. Mr. Morasch explained that Wastewater has two current vacancies and they explored ways to improve the operation of the Wastewater Plant.Staff proposed replacing the vacant administrative assistant with a Lab Pretreatment Supervisor. This change would allow Wastewater to focus on water quality issues which is a strong push by DNR. Staff also requests renaming another position to Environmental Specialist to better reflect that position’ s current job duties. Because of vacancy savings within the Wastewater personnel budget, there would be no need for any budget transfers. After discussion and questions, Councilman Schreiber made a motion to move the bill onto the Council which was seconded by Councilman Costales. The motion passed 4-0. Appointments Review. Presented by Drew Hilpert.The committee reviewed the recommendations by Mayor Tergin. Drew Hilpert brought up that several councilpersons from the previous council had asked about streamlining the process of resolution approval for grant applications. Staff will discuss it internally and Committee members will discuss it with Steve Crowell and the issue will be discussed at the next Admin meeting. There being no further business,after discussion and questions, Councilman Costales made a motion to adjourn which was seconded by Councilman Schreiber. The motion passed 4-0. Jefferson City Ordinance Sec. 18-227. Sale of tobacco to minors. A. It shall be unlawful for any person to sell tobacco products. vapor products,or tobacco productrelated paraphernalia to a minor. B. Warning signs concerning sales of tobacco products to minors shall be plainly visible at every display from which tobacco products are sold. Such signs shall: 1. Contain in red lettering at least one-half inch high on a white background "IT IS A VIOLATION OF THE LAW FOR TOBACCO PRODUCTS,OR TOBACCO PRODUCTVAPOR PRODUCTS, OR RELATED PARAPHERNALIA TO BE SOLD TO, OR POSSESSED BY,ANY PERSON UNDER THE AGE OF 1821", and 2. Include a depiction of a pack of cigarettes at least two inches high defaced by a red diagonal diameter of a surrounding red circle. C. The signs referred to in subparagraphs (B)(1) and (B)(2) shall be provided without cost by the City of Jefferson. D. For the purposes of this section, the following terms shall have the meanings designated: 1. "Tobacco products"shall mean any substance containing tobacco leaf, including, but not limited to, cigars, cigarettes, pipe tobacco and smokeless tobacco as well as alternative nicotine products. "Smokeless tobacco" means any tobacco products that are suitable for dipping or chewing, such as snuff, chewing tobacco or dipping tobacco. 2. "Vapor product"shall mean any non-combustible product with or without nicotine that employs a heating element, power source, electronic circuit, or other electronic, chemical or mechanical means, regardless of shape or size,which can be used to produce vapor. Vapor product includes any electronic cigarette, electronic cigar,electronic cigarillo, electronic pipe, or similar product or device and any vapor cartridge or other container that is intended to be used with such product or device. Vapor product does not include any alternative nicotine product or tobacco product or any product regulated as a drug or device by the United States Food and Drug Administration under Chapter V of the Food, Drug, and Cosmetic Act. (Ord. 15445, §1, 10- 5-2015). a3.For purpose of this definition, “aAlternative nicotine products” shall mean, any noncombustible product containing nicotine that is intended for human consumption, whether chewed, absorbed, dissolved,or ingested, inhaled, or otherwise introduced into the human body by any other means. Alternative nicotine product does not include any vapor product, tobacco product, or any product regulated as a drug or device by the United States Food and Drug Administration under Chapter V of the Food, Drug, and Cosmetic Act. (Ord. 15445, §1, 10-5- 2015) 24.Tobacco product"Related paraphernalia"shall include, but not be limited to,:cigarette wrapping papers for cigarettes,marijuana or other combustibles;and pipes made for smoking tobacco products;bongs;hookahs; or other devices intended for the use of introducing into the human body tobacco products,vapor products, marijuana,marijuana derivatives containing tetrahydrocannabinol (THC),or controlled substances or imitation controlled substances in violation of sections 195.005 to 195.425 RSMo.[Cross reference to Sec 18-280 -18-282 of city code] 35. Minor shall mean any person under the age of 1821 years. 46. Vending machine shall mean any mechanical, electric or electronic, self -service device which, upon insertion of money, tokens or any other form of payment, dispenses tobacco products. E. The provisions of this section shall not apply to the sale of tobacco products through a vending machine until January 1, 1993, if the vending machine contains thereon the warning signs referred to in paragraph B) and the owner of the vending machine or person leasing the machine does not knowingly permit the sale of tobacco products to minors. After January 1, 1993, all vending machines that are in areas open to minors must be supervised or controlled by the owner or lessor of the machine. The method of control may be visual, use of tokens, or a lockout. F. Any person found guilty of violating the provisions of this section shall be subject to a penalty for each violation as follows: 1. A fine of $100 for the first violation within a two -year period. 2. A fine of $250 for the second violation within a two -year period. 3. A fine of $500 for the third and any subsequent violation within a two -year period. Further, the tobacco retailer license held by the operator of the business may be suspended or revoked upon the discretion of the court.[In the event we also pursue a companion ordinance to require tobacco retailers to obtain a license.] G.If any provision, clause, sentence, or paragraph of this section or the application thereof to any person or circumstances shall be held invalid, that invalidity shall not affect the other provisions of this section which can be given effect without the invalid provision or application, and to this end the provisions of this Article are declared to be severable. H. The effective date of this section shall be (___________) Ord. No. 11533, § 1, 1-23-91) Sec. 18-228. Purchase or possession of tobacco by minors. A. It shall be unlawful for a minor to purchase or attempt to purchase tobacco products, vapor products, or related paraphernaila; or to have tobaccosuch products (as defined in section 18- 227) in his or her or her possession. Any person found guilty of violating the provisions of this section shall be subject to a penalty for each violation as follows: The minor will be required to perform not less than 5 hours of community service and not more than 100 hours of community service.
