The Common Council of the City of Richmond, Indiana met in regular session Monday, September 21,
2009 in the Council Chambers in said City.
PLEDGE OF ALLEGIANCE

President Wissel presided and the following business was conducted:
ROLL CALL
Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing
Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn.
Also present were: City Engineer Greg Stiens; City Controller Tammy Glenn; Fire Chief Mike Crawley;
Director of Human Resources Bill Harris; Director of Human Rights Ron Church; Doug Goss, Information

APPROVAL OF MINUTES
Ms. Pappin moved to approve the minutes of the meeting of September 8, 2009, supported by Mr. Miller.
Upon a vote viva voce, the motion passed.

Mr. Elstro moved to suspend the rules and read Ordinance Nos. 40, 41, 42, 43, 57, 58, 59 -2009 on first
reading by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed.
ORDINANCE NO. 40 -2009 — AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 2010
BUDGET
The Clerk read Ordinance No. 40 -2009 on first reading by title only.
Mr. Miller moved to amend Tab 3, page 6 of the proposed Department of Human Rights 2010 budget by
reducing each line item to zero which would reduce the annual budget by $74,150.00, supported by Mr.
Goodwin. Speaking against the proposed amendment were Dr. Kriese, Ms. Sancova, Messrs. Hunter,
Kramer, Williams and Church. In favor of the proposal was Dave Dorston of Richmond. The motion to
amend Ordinance No. 40 -2009 was approved by a 5 -4 vote viva voce. Dissenting were Messrs. Elstro
and Quinn and Ms. Cruse - Nicholson and Ms. Pappin.
Mr. Parker moved to advance Ordinance No. 40 -2009 as amended to second reading and to suspend the
rules and read by title only, supported by Ms. Pappin. Upon a vote viva voce, the motion passed.
The Clerk read Ordinance No. 40 -2009 as amended on second reading by title only.
President Wissel declared Ordinance No. 40 -2009 as amended on second reading and public hearing.
There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance
No. 40 -2009 as amended, supported by Mr. Parker. Upon a vote viva voce, the motion passed.
Ordinance No. 40 -2009 as amended will be heard on third reading Monday, September 28, 2009.
ORDINANCE NO. 41 — 2009 — AN APPROPRIATION ORDINANCE FIXING THE ANNUAL
COMPENSATION OF ALL ELECTED CITY OFFICERS FOR 2010

Mr. Parker moved to advance Ordinance No. 41 -2009 to second reading and to suspend the rules and
read by title only, supported by Mr. Welch.

and read by title only, supported by Mr. Welch. Upon a vote viva voce, the motion passed.

comments for or against the Ordinance, Mr. Parker moved for engrossment of Ordinance No. 42 -2009,
supported by Mr. Miller. Upon a vote viva voce, the motion passed.
Mr. Parker moved to advance Ordinance No. 42 -2009 to third and final reading and to suspend the rules
and read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed.

ORDINANCE NO. 43 -2009 — AN APPROPRIATION ORDINANCE AUTHORIZING PAYMENT FOR
SERVICES FROM THE RICHMOND SANITARY DISTRICT, RICHMOND POWER & LIGHT, MOTOR
VEHICLE HIGHWAY, AND PARK AND RECREATION DEPARTMENT FUNDS TO THE GENERAL
FUND IN 2010

Ms. Pappin moved to advance Ordinance No. 43 -2009 to second reading and to suspend the rules and
read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed.
President Wissel declared Ordinance No. 43 -2009 on second reading and public hearing. There being no
comments for or against the Ordinance, Mr. Parker moved for engrossment of Ordinance No. 43 -2009,
supported by Ms. Pappin. Upon a vote viva voce, the motion passed.

ORDINANCE NO. 57 -2009 - AN APPROPRIATION ORDINANCE AMENDING THE 2009 BUDGET
The Clerk read Ordinance No. 57 -2009 on first reading by title only.
Presented by Mr. Stiens, this Ordinance would authorize the transfer of $16,000 into Other Equipment
within the 2009 Engineering Department Budget.
Mr. Welch moved to advance Ordinance No. 57 -2009 to second reading and to suspend the rules and
read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed.
President Wissel declared Ordinance No. 57 -2009 on second reading and public hearing. There being no
comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 57 -2009,
supported by Mr. Miller. Upon a vote viva voce, the motion passed.

ORDINANCE NO. 58 -2009 — AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF
RICHMOND TO RECEIVE DONATIONS
The Clerk read Ordinance No. 58 -2009 on first reading by title only.
Presented by Mr. Foster, this Ordinance would authorize the City of Richmond to accept donations to
support the programs of the Historic Preservation Commission.
Mr. Welch moved to advance Ordinance No. 58 -2009 to second reading and to suspend the rules and
read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed.
President Wissel declared Ordinance No. 58 -2009 on second reading and public hearing. There being no
comments for or against the Ordinance, Mr. Parker moved for engrossment of Ordinance No. 58 -2009,
supported by Mr. Welch. Upon a vote viva voce, the motion passed.

ORDINANCE NO. 59 -2009 - A GENERAL ORDINANCE CREATING CHAPTER 78 OF RICHMOND
CITY CODE REGARDING THE USE AND REGISTRATION OF MOPEDS, ALTERED MOTORIZED
BICYCLES, AND POCKET BIKES
The Clerk read Ordinance No. 58 -2009 on first reading by title only.
Presented by Chief Wolski, this Ordinance would regulate the use of Motorized bicycles, scooters,
mopeds and pocket bikes within the City of Richmond.
Mr. Miller moved to advance Ordinance No. 59 -2009 to second reading and to suspend the rules and
read by title only, supported by Mr. Welch. Upon a vote viva voce, the motion passed.
President Wissel declared Ordinance No. 59 -2009 on second reading and public hearing. Speaking in
favor were Messrs. Harkleroad, Dooley, VanMiddlesworth and Cook. Speaking against were Messrs.
Ridgway and Webb.
Ordinance No. 59 -2009 was held to continue second reading on October 5, 2009.
