Mayor Harker called the meeting to order and gave the invocation, 3. He then led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Merritt, Tyrell, Harker ABSENT: Councilmen - Nunemaker ALSO PRESENT: City Attorney Martin, City Manager'Woollett and Asst. City Manager Koski 5. APPROVAL OF MINUTES: a. Adjourned Meeting of May 3, 1965. Councilman Merritt moved to approve the minutes of the adjourned meeting of May 3, 1965, Coun- cilman Dickason seconded, and the motion was carried unanimously., b. Minutes of Regular Meeting of May 4, 1965. Councilman Dicka- son moved to approve the minutes of the regular meeting of May 4, 1965, Councilman Merritt seconded, motion unanimously carried. c. Minutes of Regular Meeting of May 18, 1965. Approval of these minutes was held over until the next regular meeting of the Cour:c1 on June 15, 1965. UNFINISHED BUSINESS: PUBLIC HEARING: 7:30 P. M. ASSESSMENT HEARING FOR CURB & GUTTER a. Agnes east side -Olive to Howland. b. Temple City Blvd. east side -La Rosa to Sparklett. Mayor Harker declared the public hearing opened. a. Asst. City Manager Koski stated the work has been completed on the east side of Agnes, Olive to Howland, and the proposed assessment is on 11 +2 lineal feet of curb and gutter at $2.50 per foot, and is in the amount of $355. Mayor Harker asked if anyone desired to be heard in connection with this proposed assessment. No one came forward to speak. Councilman Merritt moved to close the public hearing, Councilman Dickason seconded, and the motion was carried unanimously. Councilman Dickason moved to approve the assessment and direct that the property be so assessed, Councilman Merritt seconded, the motion was carried by the following roll call vote: AYES: Councilmen - Dickason, Merritt, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman - Nunamaker b. Councilman Dickason moved to open the public hearing, Councilman Merritt seconded, and the motion was carried unanimously. Asst. City Manager Koski stated the curb and gutter has been installed on the east side of Temple City Blvd., La Rosa to Sparklett, at a cost of $2.75 per ft. on 118 lineal feet. The proposed assess - ment is on 59 ft. in the amount of $162.25. Mayor Harker asked if anyone desired to be heard in connection with this proposed assessment. ORDINANCE NO, 65 -161: 2nd read. Forming Parking District No. 4 City Attorney Martin read title to Ordinance No. 65 -161 AN ORDI- NANCE OF THE CITY OF TEMPLE CITY, CALIFORNIA, FINDING AND DETER- MINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE, AND ORDER- ING, THE ACQUISITION AND IMPROVEMENT FOR VEHICLE PARKING DISTRICT NO. 4, OF SAID CITY AND ESTABLISHING THE BOUNDARIES OF SAID DIS- TRICT. Councilman Merritt moved to waive further reading of Ordinance No. 65 -161, Councilman Dickason seconded, and the mo- tion was unanimously carried. Councilman Merritt moved to adopt Ordinance No. 65 -161, Councilman Dickason seconded, and the motion was carried by the following roll call vote: AYES: Councilmen - Dickason, Merritt, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman- Nunamaker 9. PRESENTATION OF CERTIFICATE OF RECOGNITION: Jr. Chamber of Commerce, Robert. Garvin, President. Robert Garvin, Pres. of the Jr. Chamber of Commerce, stated the Junior Chamber has been organized for four years now and would not have been a complete success without the City Council and City staff. For this reason their organization has prepared a Resolution, which he read in full, and presented to Mayor Harker thanking the City for their support. Mayor Harker accepted on behalf of the City and expressed appreciation of the Council. He commended their organization and their accomplishments in the past several years since their incorporation. PUBLIC HEARING: 7:30 P. M. RE =PRE- ZONIMG PROPERTIES ;WESTERLY OF ROSEMEA[ BETWEEN EMPEROR AND CALLITA TO R -1 POTENTIAL C -2. Councilman Dickason moved to open the public hearing, Councilman Merritt seconded, and the motion was carried unanimously. The City Manager advised this pre - zoning concerned properties on the westerly side of Rosemead between Emperor and Callita, and the. Planning Commission recommend the zoning R -1 Potential C -2. The present County zoning is R -A 5000. The applicant requests zoning suitable for a shoppinc center and restaurant which would require C -2 zoning in this City. ?resently there are 9 single dwellings on 6 parcels zoned RA 5000, Rosemead north and south zoned R -3 with four corners at Longden C -2. The request has been before the Planning Commission and they recommend R -1, Poten- tial C -2. Mayor Harker asked if anyone wished to speak on this request. Mr. Bernard Bender, 1114 Rancho Rd., Arcadia, stated he represent- ed the eleven owners submitting this request. He read in full a letter he had prepared stating the frontage on Rosemead is not 755 Council Minutes, June 1, 1965, page 3 the best for apartments due to traffic noise. The values exceed the use for residential property. The annexation to Temple City would be advantageous to the City for increased revenue. A major restaurant chain has been contacted and are very much interested. They also have interested parties in the shopping area. However it is impossible to get firm committments with the zoning R -1 Potential C -2 and it is necessary that they have a definite C -2 zoning without any conditions placed upon it to go forward with this annexation and development, Mayor Harker asked if anyone else wished to speak in favor of the request and no one came forward to speak. The Mayor then asked if anyone wished to speak in opposition to the request and no one came forward to speak. City Manager ';!oollett explained the R -1 C -2 Potential stating it meant C -2 could be utilized if proper conditions were met. The Planning Commission were very anxious to see the property devel- oped as a single unit and not as small developments. Mr. Bender has indicated it would be developed as a single site. The City Attorney stated the potential zoning is intended to binc the property to designate its future zoning with the zoning at the present time. It is made to insure the property would be de- veloped as the property owner has stated it would be. It would be his recommendation that potential zoning be abolished and if suitable C -2 it should be zoned C -2. Zoning in the future is questionable from policy and legal standpoints. Mr. Bender advised the Council when the original request for C -2 was submitted to the Planning Commission they were also informed that they had the annexation petition signed by all the property owners involved subject to their getting this zoning. They are definitely interested if the zoning is definitely C -2, and if not they are not interested. City Manager Woollett stated when the petition is submitted to the City with 100% signed up there is an abbreviated procedure of annexation. He suggested if C -2 is granted and the Council receives this petition that when the hearing is held on Annexa- tion #3 that we request the Local .'Agency Formation Commission to delete this part from that annexation and we submit this petition and ask them to treat this separately under the uninhabited act and treat the rest of it under the inhabited act. Following discussion Councilman Tyrell moved to close the public hearing, Councilman Dickason seconded, roll call vote to carry the motion as follows: AYES: Councilmen - Dickason, Merritt, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman - Nunamaker Councilman Tyrell moved to instruct the City Attorney to prepare an ordinance zoning this area C -2 and bring it back to the Counci and to also refer it to the Planning Commission to show them the intention of the Council, Councilman Dickason seconded, the motio was carried by the following roll call vote: AYES: Councilmen - Dickason, Merritt, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman - Nunamaker PUBLIC HEARING: 7 :30 P. M. Charles C. Hubner, Variance Case #65 -148 Appeal from conditions imposed by the Planning Commission Councilman Merritt moved to open the public hearing, Councilman Dickason seconded, the motion was unanimously carried by roll call vote. City Manager Woollett advised this variance request was filed March 1b, 1965, requesting permission to create two parcels, one lacking street frontage, and one lacking square footage required. The applicant is appealing a condition imposed by the Planning Commission in granting the variance that the existing driveway to the rear house be widened and paved to the lot line which re- quired removal of trees and shrubs planted and would be detrimen- tal to the appearance of the property. Mayor Harker asked if anyone wished to speak in favor of this appeal. Mr. Hubner, 9024 Emperor, read a prepared statement and presented pictures showing the present plantings and explaining; what this condition to the variance would do. Mr. John E. Caher, 9018 Emperor, stated there was very little 756 Council Minutes, June 1, 1965, page 4 frontage between his property and the property line and he would appreciate this 4 ft. left as it is which lives both properties more privacy and for the aesthetic value. Also this helps them look more res'dential than with all in cement driveway. Mayor Harker asked if anyone else wished to speak in favor and no one came forward Mayor Harker then asked if anyone wished to speak in opposition and no one came forward to speak. The City Manager explained the point at issue is the Commission felt the driveway should extend to the property line which would remove the planting area, and stated their purpose was to try anc boost the area of the front parcel and make it larger. Following discussion Councilman Tyrell moved to close the public hearing, Councilman Merritt seconded, carried by the following called vote: AYES: Councilmen - Dickason, Merritt, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman - Nunamaker Councilman Tyrell stated he thought this condition unnecessary and an infringement upon the property rights of the parties in- volved and the gain is not in proportion to the cost incurred to meet the imposed requirement. He moved the development of the subject property should be in accordance with the plot plan Ex- hibit A including the other requirements and to grant the appeal on the condition imposed which called for the driveway to be extended to the property line, Councilman Merritt seconded, the motion was carried by the following roll call vote: AYES: Councilmen - Dickason, Merritt, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman - Nunamaker There followed some discussion regarding what was considered the front on a lot split for the purposes of determining front and side yard set- backs. 10. SALE OF SURPLUS PROPERTY: Draperies Asst. City Manager Koski stated a notice was prepared, posted in a public place and advertised for sale of these surplus draperies. He has received one bid for $20. for 2 panels, 10 ft. long, one 20 ft. wide and one 18 ft. wide and he recommended the Council accept the bid. Councilman Merritt moved to accept the bid as submitted, Councilman Dickason seconded, and the motion was carried unanimously. Councilman Dickason asked concerning the sale of the parking meters. The City Manager advised approximately 50 had been sold netting the amount originally offered for all of them, and he anticipates more will be sold. NEW BUSINESS: 11. ORDINANCE NO. 65 -160: 1st read. Amending Municipal Code Section #2702 relating to City office hours. City Attorney Martin read title to Ordinance No. 65 -160 AN ORDI- NANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTION 2702 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO CITY OFFICES. Councilman Tyrell moved to waive further reading of Ordinance Mo. 65 -160, Councilman Dickason seconded, and the motic was unanimously carried. No further action was taken as this was the first reading of the Ordinance. 12. RESOLUTION NO. 65 -480: Commending Frank Bletcher, retiring In- spector of the Sheriff's Dept. City Manager Woollett presented Resolution No. 65 -480 A RESOLUTIO1 OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, IN- DICATING THEIR APPRECIATION FOR THE FINE SERVICES RENDERED BY INSPECTOR FRANK L. BLETCHER, LOS ANGELES COUNTY SHERIFF'S DEPART- MENT. Councilman Tyrell moved to adopt Resolution No. 65 -480, Councilman Merritt seconded, and the motion was carried by a unanimous vote. 13. REQUEST FROM TEMPLE CITY HIGH SCHOOL FOR CITY PARTICIPATION IN ECONOMIC YOUTH OPPORTUNITY ACT OF 1964, to wit: hiring of 8 re- creation aides for months of July and August at no cost to the City. City Manager Woollett advised he had received a letter from Bert 757 Council Minutes, June 1, 1965, page 5 Holoubek who handles the Economic Youth opportunity program at the High School making the recommendation that 8 recreation aides be hired for July and August at no cost to the City. The City Manager advised we had never budgeted for this type of service and we do not need this type of individual. Following discussion it was determined that the City would have no legal authority to decide who would work or what qualifications would be, when they would work or how long. Also our people would be given additional responsibilities in taking care of them and showing them what should be done. Following discussion Councilman Merrit moved to hold this over for a study session, Councilman Harker seconded, and the motion carried by the following called vote: AYES: Councilmen - Dickason, Merritt, Harker NOES: Councilman - Tyrell ABSENT: Councilman - Nunamaker 14. SAN GABRIEL VALLEY HUMANE SOCIETY: City Manager Woollett recommended the Council extend the agreemen with the San Gabriel Valley Humane Society for one year, or to June 30, 1965, and that the staff do some study and determine if you want to renew it again at that time. Following discussion Councilman Merritt moved to approve the extension of the agree- ment for one year, Councilman Tyrell seconded, and the motion was unanimously carried. The City Manager will negotiate a con- tract for an additional year. The Council felt we should have a financial accounting as well as representation on the Board. 15. TRACT NO. 29492: Blackley St., J. B. Weber Dev. Co. Acceptance of Street Improvements. City Manager 400llett presented a letter from the City Engineer recommending the Council accept the street improvements and release Bond No. C7050817 in the amount of $8500. issued by Fire - mans insurance Fund. Councilman Tyrell so moved, Councilman Dickason seconded, and the motion carried unanimously. 16. TRACT NO. 29569: Dnal Developers, between Baldwin & Glickman, and Olive & Green, acceptance of Sanitary Sewers and release of Faithful Performance Bond. City Manager';\oollett presented a letter from the City Engineer recommending approval of the work and acceptance of the sanitary sewers for public use, and cancellation of the Faithful Perform., ance Bond for construction under private contract #7070, Bond No. 202616 in the amount of $11,000., National Automobile & Casu- alty Ins. Co. to Dnal Developers, Inc. Councilman Tyrell so moved, Councilman Merritt seconded, and the motion was carried unanimously. 17. PROCLAMATION OF WEEK OF JUNE 7 -13 AS TOASTMASTERS INTERNATIONAL WEEK. City Manager Woollett presented a request for the above proclamation. Councilman Dickason moved to so proclaim, Council- man Tyrell seconded, motion carried unanimously. 18. RESOLUTION NO. 65 -482: Warrants & Demands. Councilman Tyrell moved to adopt Resolution No. 65 -482, warrants & demands in the sum of $19,216.35, Nos. 6598 -66u0, Councilman Merritt seconded, and the motion was unanimously carried. 19. RESOLUTION NO. 65 -481: Re- County Lighting Maintenance District #1395. City Manager`;Ioollett presented Resolution No. 65 -481 RESOLUTION GRANTING CONSENT AND JURISDICTION TO THE COUNTY LIGHTING MAINTEN- ANCE DISTRICT NO. 1395 PETITION HO. 35 -25. Councilman Tyrell moved to adopt Resolution No. 65 -481, Councilman Merritt second- ed, and the motion was carried unanimously. 20. COMMUNICATIONS: City Manager'.'!oollett presented a letter from the Los Angeles County Boundary Commission re proposed annexation # 30 to the City of Rosemead. Councilman Tyrell moved to receive and file, Councilman Dickason seconded, and the motion was carried unanimous ly. 21. TIME FOR THOSE I N THE AUDIENCE :1H0 WISH TO SPEAK: Mrs. Bertha Rains, 6438 Golden ..;rest, presented a request from the 758 Council Minutes, June 1, 1965, page 6 Co- ordinating Council requesting the Council consider in the 1965 -66 budget allocating some Funds for the publication of an information booklet covering laws and youth. She explained the recommendation and request from that organization. Following discussion by the Council the motion was made by Councilman Dickason that this be referred to the staff for futher study and for reports to be considered in the annual budget, Councilman Merritt seconded, and the motion was unanimously carried. Mrs. Rains spoke also concerning the Economic Youth Opportunity program. 22. City Attorney Martin presented Resolution No. 65 -490 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ESTABLISHING THE PLACEMENT OF A "NOT A THROUGH STREET" SIGN ON THE SOUTH SIDE OF WEDGEIOOD AVENUE AT THE WEST LINE OF ROSEMEAD BOULEVARD. Counc4l- man Tyrell moved to adopt Resolution No. 65 -490, Councilman Mer- ritt seconded, and the motion carried unanimously. City Attorney Martin read title to Resolution No. 65 -486 RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, CALLING FOR SEALED BIDS ON BONDS TO BE ISSUED TO REPRESENT UNPAID ASSESSMENTS UPON LANDS IN VEHICLE PARKING DISTRICT NO. 1 GrF SAID CITY. Councilman Tyrell moved to adopt Resolution No. 65 -486 and set the date of opening of bids for July 6, 1965, at 7:30 P.M. Councilman Merritt seconded, and the motion was carried unanimous- ly. City Manager ioollett advised the County Boundary Commission had passed favorable our proposed Annexation #3, and a public hearing will be set before the LocalAgency Formation Commission probably the 2nd or 4th Wednesday of Juiy. The City Manager advised the Traffic Engineer that the signals on Las Tunas will not be inter - connected until June 15 and not June 1 as he previously had stated. The City Manager presented a request from the Kiwanis Club for a rummage sale on the 4th & 5th oF June in the old American Savings building. Councilman Merritt moved to approve, Councilman Tyrell seconded, and the motion was carried unanimously. 759 Council Minutes, June 1, 1965, page 7 The City Manager requested authorization of payment on the Delgad contract of $9,120,51 which has been reviewed and approved by the architect and director of public works. Councilman Merritt moved to approve, Councilman Dickason seconded, roll call vote to carry the motion as follows: AYES: Councilmen - Dickason, Merritt, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman - Nunamaker The City Manager presented a letter from Mrs. '-Ioody, 10629 Daines Dr., requesting the removal of an oak tree just planted recently according tb the master tree planting program. Councilman Merritt moved to deny the request, Councilman Tyrell seconded, and the motion to deny the request was unanimously carried. Mayor Harker presented Resolution No. 65 -483, a proclamation that. "June is Dairy Month ", and Resolution No. 65 -434 A RESOLUTION OF, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, JOINING IN THE OFFICIAL OBSERVANCE OF JUNE AS DAIRY MONTH, Councilman Tyrell moved to adopt Resolutions No. 65 -483, and 65 -484, Council man Merritt seconded, and the motion carried unanimously. Mayor Harker presented Resolution No. 65 -485 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY PROCLAIMING JUNE 16, 1965 AS JACKIE ROBINSON DAY. Councilman Merritt moved to adopt Resolu tion No. 65 -485, Councilman Dickason seconded, and the motion was carried unanimously. 23. ADJOURNMENT: Councilman Tyrell moved to adjourn to an adjourned meeting on June 2, 1965, at 7:30 P. M. in the Council Chambers, of the City Hall, 5938 Kauffman Ave., Temple City.
