Check our website for updates at: www.moabcity.org Agenda MOAB CITY COUNCIL REGULAR MEETING June 9, 2015 The Moab City Council held its Regular Meeting on the above date in the Council Chambers at the Moab City Center, located at 217 East Center Street, Moab, Utah. Mayor David L. Sakrison called the Pre -Council Workshop to order at 6:30 PM. In attendance were Councilmembers Heila Ershadi, Gregg Stucki, Kyle Bailey and Kirstin Peterson. Also in attendance were City Manager Rebecca Davidson, City Recorder/Assistant City Manager Rachel Stenta, City Treasurer Jennie Ross, Police Chief Mike Navarre, Public Works Director Jeff Foster and Acting City Engineer Eric Johanson. Mayor Sakrison called the Regular City Council Meeting to order at 7:00 PM and led the pledge of allegiance. Fourteen (14) members of the audience and media were present. Councilmember Ershadi moved to approve the Regular Meeting Minutes of March 12, May 26, May 29 and June 2, 2015. Councilmember Stucki seconded the motion. The motion carried 3-0 aye with Councilmember Peterson being briefly absent. There were no Citizens to Be Heard. Mayor Sakrison presented Miguel Gonzalez with the Mayor's Student Citizenship of the Month Award for May 2015 for Helen M. Knight School. Mayor Sakrison opened a public hearing at 7:12 PM for Solicitation of Public Input on Proposed Ordinance #2015-06 - An Ordinance Amending the City of Moab Classified Hourly Pay Rate Schedule and Exempt and Elected Officials Salaries. No Public Comment was given. Mayor Sakrison closed the public hearing at 7:13 PM. The motion carried 4-0 aye. Councilmember Ershadi moved to Approve Proposed Resolution #22- 2015 - A Resolution Accepting the Public Improvements Constructed in Association with the Planned Unit Development, Known as "Deer Trail Subdivision" and Authorizing the Release of the Performance Guarantees Associated with Said Improvements. Councilmember Bailey seconded the motion. The motion carried 4-0 aye. Councilmember Bailey moved Send Proposed Resolution #23-2015 —A Resolution Amending the City of Moab Fiscal Year 2014-2015 Budget to Public Hearing. Councilmember Stucki seconded the motion. The motion carried 4-0 aye. Councilmember Peterson moved to approve Proposed Resolution #24- 2015 — A Resolution Approving Lease Amendment No. 2 To Contract No. 060285, a Lease Agreement with the State of Utah, Division of Facilities Construction and Management for Tenant Space at the Moab City Center for the Department of Human Services as amended. Councilmember Bailed seconded the motion. The motion carried 4-0 aye. Councilmember Stucki moved to Award the Ballpark Concessionaire Contract and Vendor Permit to Shawn Welch. Councilmember Ershadi seconded the motion. The motion carried 4-0 aye. Councilmember Bailey moved to approve a Retail Food Vendor License for Shawn Welch to Conduct a Concessionaire Stand at the Center Street Ball Park. Councilmember Stucki seconded the motion. The motion carried 4-0 aye. Councilmember Ershadi moved to Confirm the Mayoral Appointment of Allison Brown to the Moab City Planning Commission for a Fill-in Term Ending December 31, 2017. The motion carried 4-0 aye. Under Mayor And Council Reports, Councilmember Peterson reported that she had attended the opening of the Goblin Valley State Park Mountain Bike Trail. Councilmember Ershadi reported that she had attended the Interlocal Housing Task Force Committee Meeting and that the Grand Conservation District had approved a letter of support concerning Grey Water. Councilmember Ershadi also reported that she had attended the Envision Utah meeting as well as a public meeting regarding UTV use in Moab. Councilmember Bailey reported that he had attended those same meetings. Councilmember Stucki reported that the Grand County Solid Waste District had hired a new full time Manager. Mayor Sakrison stated that he had been very busy and he thanked City Manager Davidson for meeting with members of the community regarding the proposed water tank. There was no Correspondence to be Read. Under Administrative Report, City Manager Davidson distributed a written report and stated that she hoped to be doing a radio show after each Council meeting and would like the City to reach out in new ways to the community, including social media and a newspaper column. City Manager Davidson then stated that the Police Department was experiencing some staffing changes and that depart heads had been working on performance evaluation forms as well as job description revisions to prepare for the upcoming salary survey. City Manager Davidson stated that the Flood Channel Ordinance would be coming back to Council along with a proposal for a Riparian Master Plan. A Report on City/County Cooperation was not given. Councilmember Bailey moved to pay the bills against the City of Moab in the amount of $441,103.59. Councilmember Peterson seconded the motion. The motion carried 4-0 aye by a roll -call -vote. Mayor Pro-tem Ershadi called the Pre -Council Workshop to order at 6:32 PM. In attendance were Councilmembers Gregg Stucki, Kyle Bailey, Doug McElhaney and Kirstin Peterson. Mayor Pro-tem Ershadi called the Regular City Council Meeting to order at 7:00 PM and led the pledge of allegiance. Ten (10) members of the audience and media were present. Councilmember Peterson moved to approve the Regular Meeting Minutes of May 12, 2015. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Under Citizens to Be Heard, Bill Love stated that he was concerned about the water study currently being conducted by the City of Moab and that he feels that an important step is completing the study prior to building a water tank. Mr. Love asked that the Council postpone the water tank until the study is completed. Mr. Love stated that he believes it would be very expensive to put in the infrastructure before verifying that enough water is available. Doug Fix stated that he had some comments on the rezone and that he feels that the second proposal shares the same process issues as the first proposal. Mr. Fix stated that zoning isn't about a specific property owner but is about an overall plan. Mr. fix stated that the C-4 zones allows over 30 different types of buildings. Floyd Dean spoke and stated that he had met with the Mayor and City Manager to discuss the proposed water tank and thanked City Manager Davidson for dealing with the weed issue swiftly as promised. Mr. Dean stated that he has many questions regarding the tank project and that he would like to meet with the City Manager and would like a presentation to Grand County before the City Council votes on the issue. Mayor Pro-tem Ershadi proclaimed July 1— 7, 2015 as Independents Week in the City of Moab. Mayor Pro-tem Ershadi opened a public hearing at 7:15 PM for the Solicitation of Public Input on Solicitation of Public Input on Proposed Resolution #23-2015 — A Resolution Amending the City of Moab Fiscal Year 2015-2015 Budget. No Public Comment was given. Mayor Pro-tem Ershadi closed the public hearing at 7:37 PM. Councilmember Peterson moved to approve a Class II Beer License for Christopher Beitner d.b.a. Councilmember McElhaney seconded the motion. The motion carried 5- 0 aye. Councilmember Stucki moved to Award the 2015 Crack Seal Project to Superior Asphalt in the amount of $27,510. Councilmember McElhaney seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve the 2015 Crack Seal Project Contract. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve Proposed Resolution #26- 2015 — A Resolution Approving A Lease Amendment No. 2 To Contract No. 06-0525, A Lease Agreement With The State Of Utah, Division Of Facilities Construction And Management For Tenant Space For At The Moab City Center For The Department of Corrections, Division of Adult Probation and Parole. Councilmember McElhaney seconded the motion. The motion carried 5-0 aye. Councilmember Stucki moved to approve Proposed Ordinance #2015-07 — An Ordinance Approving a Zoning Map Amendment for Property Located at 889 North Main Street from R-2 to C-4 as Referred to Council by the Planning and Zoning Commission. Councilmember McElhaney seconded the motion. Councilmember Ershadi moved to table Proposed Ordinance #2015-07 — An Ordinance Approving a Zoning Map Amendment for Property Located at 889 North Main Street from R-2 to C-4 as Referred to Council by the Planning and Zoning Commission. Councilmember Bailey seconded the motion to table. The motion passed 3-2 aye with Councilmembers Ershadi, Bailey and Peterson voting aye and Councilmembers McElhaney and Stucki voting nay. Under Mayor And Council Reports, Councilmember Peterson reported that the Canyonlands Health Care District had approved an agreement to work with Moab Regional Hospital to help with the Care Center, and that there would be a Grand County Homeless Coordinating Meeting the next day at 1:00 PM at Zions Bank. Councilmember Stucki reported that the Grand County Solid Waste District had hired a new full time Manager who was in place, was awesome and was doing a really good job. Councilmember Ershadi reported that she and City Manager Davidson had attended a meeting in Price regarding water security in Utah the focus of which was having enough water for people. Under Reading of Correspondence, Councilmembers Peterson and Stucki both stated that they had received many letters regarding the proposed zone change, the water tank project and UTVs in our community. City Manager Davidson then stated that there would be a meeting on June 30 regarding the five national parks. City Manager Davidson then stated that the water study had completed the first phase and that the next phase would include drilling and would begin the following January. Under Report on City/County Cooperation, Mayor Pro-tem Ershadi REPORT ON CITY/COUNTY stated that she had met with Grand County and the mobile office of COOPERATION Representative Mike Lee and his staff to discuss Affordable Housing in Moab. Councilmember Bailey moved to pay the bills against the City of Moab in the amount of $189,083.67. Councilmember Peterson seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Mayor David Sakrison called the Pre -Council Workshop to order at 6:00 PM. In attendance were Councilmembers Heila Ershadi, Gregg Stucki, Kyle Bailey, Doug McElhaney and Kirstin Peterson. Also in attendance were City Manager Rebecca Davidson, City Recorder/Assistant City Manager Rachel Stenta, City Treasurer Jennie Ross, Public Works Director Jeff Foster, Planning Director Jeff Reinhart, Zoning Administrator Sommar Johnson and Acting City Engineer Eric Johanson. The purpose of the workshop was a discussion regarding code enforcement. Discussion followed. Mayor Sakrison called the Regular City Council Meeting to order at 7:00 PM and led the pledge of allegiance. Thirty-one (31) members of the audience and media were present. There were no minutes to approve. Under Citizens to Be Heard, Joe Kingsley stated that Grand County was also having the same discussion regarding code enforcement. Bill Love stated that he valued participation in public meetings and felt that issues need needed to be resolved at local meetings instead of just submitting written comments and questions. Mr. Love stated that two of this issues he had submitted had not been addressed. A presentation was made by Gregg Stucki of the introduction of Debbie Barton, the Grand County Solid Waste District Manager. The Presentation Regarding the Proposed Boulder was postponed. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember McElhaney moved to approve a Task Order with Bowen, Collins and Associates for a Sewer Rate and Fee Study. Councilmember Ershadi seconded the motion. The motion carried 5-0 aye. Mayor Sakrison opened a public hearing at 7:10 PM for Solicitation of Public Input on Proposed Ordinance #2015-05 — An Ordinance Amending the City of Moab Municipal Code, Chapter 17.33, FC-1 Flood Channel Zone, Specifically Referencing Fencing, Structures for Public Transportation, Vegetation and Penalties. Planning Director Reinhart gave a staff overview of the Proposed Ordinance. John Crofts, the State Flood Plain Manager gave an overview of FEMA regulations as relating to the Proposed Ordinance. Kara Dohrenwend stated that she lives at 40 W. and 100 No. and that she is happy to see some of the changes in the ordinance although she has been disappointed that there was not more public participation in the process. Ms. Dohrenwend stated that Moab is in compliance with the National Flood Insurance Program and asked if the regulations need to be changed today? Ms. Dohrenwend continued that residents have made a lot of changes to create a functional floodway and that she had been in conversations with City Manager Davidson regarding her concerns and that she was very encouraged by the changes that had been made. Ms. Dohrenwend stated that she has worked with a lot of property owners in the creek corridors and she is troubled by the proposed fines and punishments in the ordinance. Ms. Dohrenwend inquired what the application process will be, where a permit will be needed, who the Flood Plain Administrator is and how many permits will be issued. Stan Holland stated that he is a land owner along the creek and he has worked to get invasive species out, to repair fences and done many upgrades. Mr. Holland stated that he has been working to open the creek back up to its natural state. Mr. Holland stated that livestock have to have fencing and he feels the City doesn't do enough to help the landowners. Mr. Holland stated that the City should give a process to July 14, 2015 Page 2 of 5 TASK ORDER WITH BOWEN COLLINS AND ASSOCIATES FOR SEWER RATE STUDY, APPROVED PUBLIC HEARING OPENED PUBLIC COMMENT Agenda Page 15 of 51 the public before they vote on the regulations. Mr. Holland continued that he would like to work together to resolve conflicts and that the code to fine or imprison for working on a fence is offensive and un- American. Mr. Holland urged the Council to vote no on the ordinance. Page Holland stated that the ordinance being changed allows animals on the property and that the overlay is restricting the uses, except the only uses allowed don't mention animals. Ms. Holland stated that the she doesn't see any reason to eliminate animals. Arne Holdquist stated that the Proposed Ordinance is inadequate to protect our floodway and that he has researched other cities ordinances. Mr. Holdquist then distributed copies of the sample ordinances. Mr. Holdquist stated that a Riparian area was necessary to augment the floodway. Mr. Holdquist stated that the City was currently insured and that there was no rush to get this ordinance passed. John Crofts stated that his experience in working with farmers in this state is that they are the strongest proponents of flood plain management. Mr. Crofts stated that the floodway is the most dangerous part of the flood path and that a barbed wire fence is in compliance with the flood plain. Mr. Crofts stated that the purpose of the ordinance is to protect life and property. Kenneth Minor asked if we are in compliance with the National Flood Insurance Program or not? The relocation of the event to Swanny Park from Old City Park actually gives the city more oversight of the event, since it would now be within City limits. Staff has reviewed the application and has met with event organizers and do not foresee any problems with this event. The Pride Festival serves as a beacon in South Eastern Utah where people are invited to come together regardless of age, gender, religious or political affiliation. It serves as a way to bring the community to a greater understanding of difference and diversity. Now in its fourth year it has continued to grow with the help and support of many Salt Lake organizations who see our festival as an important outreach post for issues concerning the LGBTQ community. As well as Salt Lake, our festival has grown to attract many people from all over South Eastern Utah and Colorado, benefitting local businesses and the overall economy. The festival is a celebration of diversity, a way to entertain, engage and delight not only the LGBTQ community but the friends, families and allies, who also share the same idea that one day all people will be treated as equal. Moab Prides vision was to set up a year round presence offering information, help and support to those identifying as LGBTQ within the Moab community. We have finally achieved our goal by partnering with the Moab Valley Multicultural Center who have generously donated a space to serve as a drop in. Both our organizations seek to serve the needs of often overlooked minorities within our community, and we see the partnership as a way to educate, bridge gaps and to assess what the LGBTQ community needs and how best to facilitate those needs. Of course with any organization we need money to sustain our program and the Moab Pride Festival is our biggest fundraiser, as well as standing as a symbol of visibility and awareness to all people struggling with LGBTQ issues. Hold traffic during mass start on 400 North. Assist State Police at 191 and 500 West while riders cross 191. Assist County police at 4 way stop on Spanish Valley Drive and also on E. Spanish Trail Road to the rotary and on to S. Murphy Lane to the finish 10:30am to 2:30 pm. State Highway Patrol: Close intersection at 191 and 500 West until all riders thru 8am to 8:30am. Have State patrol car/cars lead down 191 and 128 to Castle Valley turn to slow on coming traffic and deal with any other traffic issues. The nature of a Gran Fondo Event is that the riders are going for the fastest time possible to finish the route. Therefore we would like to have 3 vehicles moving along with the larger groups of riders to again control traffic as the groups breakup and to insure that the riders do not cross the yellow line on 128. We will do the utmost to educate the participants to follow all the rules of the road and that all roads are open to traffic. State police to assist in any and all emergency situations. Grand and San Juan County Sheriff: Assist wherever necessary on the Lasal Loop Road, S Spanish Valley Drive, at the 4 way stop, and the rotary onto Murphy Lane to Old City Park at the finish. We would like the Count Sheriff to close the road from the rotary to Old city Park with police control wherever necessary. This is a timed event. We will have a professional timing company at the finish with 2 people and 2 cameras. There will be a small aid station at Old City Park. After the riders cross the finish line on Murphy Lane they will proceed to Old City Park. Notes: 1. Event participants will be made aware of all safety issues, including riding single file where necessary, obeying traffic laws and signs, being courteous to local traffic, and generally conducting themselves in a manner that will allow this event to take place in the future.
