A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TEMPLE CITY DISMISSING AN APPEAL,
CONFIRMING THE PLANNING COMMISSION, AND
DENYING A VARIANCE WITH REGARD TO A LOT
SPLIT
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE:
SECTION 1. The City Council finds and determines that
Thomas F.•Minahan and Kathryn D.•Minahan have applied for a
variance in conjunction with a lot split on property known
as 5430 North Halifax Road, for a permit to deviate from
Zoning Code requirements with respect thereto as follows:
substandard frontage, substandard width and substandard
setback.
SECTION 2. The City Council further finds that the
Planning Commission has previously denied such request as
set forth in Resolution No. 68- 279PC,.and that an appeal
has been taken therefrom and a public hearing has been held
with respect thereto before this City Council.
SECTION 3. For the reasons set forth by the Planning
Commission, [and for the further reasons:
a) that no hardship has been shown with respect to
said property, and it is feasible for the property
to be used in compliance with the existing zoning
regulations;
b) that such variance would tend to depreciate
property values of adjoining properties;
c) that the split as proposed would make resale
of such property difficult; and
d) that since the time of other lot splits in the
area, the City requirements have been upgraded;
that such upgrading is for the benefit of the
neighborhood;, that there appears to be no
reason to deviate in conjunction with this
request; and that the precedent of other lot
splits in the area do not relate to the merits
of this particular application in that there
have been no other lot splits on Halifax Road
in this area and the other lot splits_on the
side streets were accomplished under less
stringent zoning regulations as to which no
variance was necessary.] -
said variance is denied in all its particulars and Planning
Commission Resolution No. 68 -279PC is hereby confirmed.
SECTION 4. The City Clerk shall certify to the adop-
tion of this Resolution.
