A RESOLUTION OF THE CITY OF MCCALL, VALLEY COUNTY, IDAHO,
AUTHORIZING THE CITY MANAGER TO NEGOTIATE A CONTRACT AND
NECESSARY DOCUMENTS WITH CONTRACTORS NORTHWEST, INC. TO CORRECT
DEFECTIVE WORK IN THE J-DITCH PROJECT PHASE II AS SPECIFIED BY
J-U-B ENGINEERS, INC. AND AUTHORIZING THE MAYOR, ALLAN MULLER,
TO EXECUTE SUCH AGREEMENT AND OTHER NECESSARY DOCUMENTS TO THAT
EFFECT ON BEHALF OF THE CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of McCall has the power to enter into
contracts as provided in 50-301, Idaho Code; and
WHEREAS, on August 22, 2001, the City gave seven (7) days
notice to Employers Insurance of Wausau, A Mutual Company, of
the City's intent to correct defective work pursuant to
paragraph 13.09 pf the General Conditions of the Construction
Contract, J-Ditch Phase II; and
WHEREAS, the City desires to hire Contractors Northwest,
Inc. to correct the defective work as directed by J-U-B
Engineers, Inc.
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
MCCALL, Valley County, Idaho, as follows:
Section 1: That Contractors Northwest, Inc. is selected
to correct the defective work on behalf of the Owner, City of
McCall, pursuant to paragraph 13.09 of the General Conditions of
the Construction Agreement - J-Ditch Phase II; and
Section 2: That the City Manager is authorized to
negotiate a contract and all other necessary documents with
Contractors Northwest, Inc., to correct the defective work, and
the Mayor for the City of McCall is hereby authorized to sign an
agreement and other necessary documents with Contractors
Northwest, Inc. A Copy of the proposed agreement and some of the
proposed necessary documents are attached hereto and
incorporated by reference herein as Exhibit "A."
Section 3: This resolution shall take effect and be in
force from and after its passage and approval.
