RESOLUTION FOR APPROVAL OF AN ANNEXATION MORATORIUM AGREEMENT BETWEEN THE
CITY OF TIFFIN, IOWA AND THE CITY OF NORTH LIBERTY REGARDING THE FUTURE ANNEXATION
OF PROPERTIES SUBJECT TO PROVISIONS OF IOWA CODE CHAPTER 368.
WHEREAS: the City Council of Tiffin, Iowa (hereinafter "Tiffin") recognizes the need to establish a long-term
policy regarding the annexation of lands between the two cities of Tiffin and the City of North
Liberty, Iowa (hereinafter "North Liberty") as contemplated by Iowa Code Chapter 368 (2010) in
order to provide more orderly growth and more efficient delivery of public services in the subject
area.
WHEREAS: a Future Land Use Comprehensive Plan has been adopted by Tiffin and reviewed by North
Liberty and'joint agreement has been reached by both parties for future annexation boundary
lines. (Attachment A)
THEREFORE, BE IT RESOLVED: upon review of Annexation Moratorium Agreement presented by North
Liberty regarding the Annexation of Properties and Attachment A establishing future agreement
lines, Tiffin adopts the attached Annexation Moratorium and Agreement Lines as shown on
Attachment A with North Liberty subject to the provisions of Iowa Code Section"368.4.
THEREFORE, BE IT RESOLVED: the City Council of Tiffin authorize the Mayor and City Clerk to sign
all necessary documents and follow all applicable requirements and proceedings, as required and
necessary to adopt the Annexation Moratorium Agreement with North Liberty.
On this 14th day of April 2010, at a regular meeting of Tiffin City Council, Tiffin, Iowa, Council person Travis Weipert
introduced RESOLUTION 2010-14, RESOLUTION FOR APPROVAL OF AN ANNEXATION MORATORIUM
AGREEMENT BETWEEN THE CITY OF TIFFIN, IOWA AND THE CITY OF NORTH LIBERTY REGARDING
THE FUTURE ANNEXATION OF PROPERTIES SUBJECT TO PROVISIONS OF IOWA CODE CHAPTER
368. and made a motion for approval with an amendment to the map to move two approximately forty acre
sections from the agreed boundary line of Tiffin to be included in the area for North Liberty. The motion was
seconded by Council person Jim Bartels.
AYES: Chris Ball, Jim Bartels, Mark Petersen, and Travis Weipert
NAYS: Mike Gericke
ABSENT: None
WHEREUPON, with four votes for approval, Mayor Phillips declared that Resolution 2010-14 with an amendment to the
map to move two approximately forty acre sections from the agreed boundary line of Tiffin to be included in the area for
North Liberty, be adopted and signified his approval of the same by affixing his signature thereto. (Atachment A attached.)
