HomeMy Public PortalAboutResolution 01-12 Disturbing the PeaceRESOLUTION NO. 01-12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, IDAHO, REGARDING THE SUSPENSION OF THE DISTURBING THE PEACE ORDINANCE FOR SPECIFIED TIMES AND LOCATIONS. WHEREAS, the McCall Folklore Society is sponsoring the McCall Folk Music Festival, to be held on July 19, 20, and 21, 2001; and WHEREAS, the McCall Folk Festival would violate the disturbing the peace ordinance; and WHEREAS, the Council finds a temporary and limited suspension of the disturbing the peace ordinance would be in the public interest and would further McCall's economic well-being or development. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF McCALL THAT: Section 1. The property commonly known as the University of Idaho Field Campus will be the location for the McCall Folk Festival. Section 2. The provisions of McCall City Code 5-5-030(G)(1)(b), prohibiting disturbing the peace by loud playing of a radio, tape or disc player, or other functionally similar electronic device, is hereby suspended within the location described above. Section 3. This resolution shall be in effect only on July 19, 20, and 21, 2001, between the hours of 6:30 pm and 10 pm. Section 4. The McCall Folklore Society must obtain a Group Events Permit prior to hosting the event from McCall City Hall. Section 5. The McCall Folklore Society must follow all terms of the attached agreement. In the event that the requirements are not met, the Police Chief may order such event to be closed. Passed and approved this 7th day of June 2001. Allan al4hulr Cathleen A.
