A RESOLUTION SETTING THE PUBLIC NOTICING REQUIREMENTS FOR
THE MOAB CITY PLANNING COMMISSION
WHEREAS, there has been public misunderstanding as to exactly what
notification requirements the Moab City Planning Office is required by
State Law to follow when noticing Public Hearing; and,
WHEREAS, the Planning Commission has been given the responsibility
for holding most Public Hearings required by the Moab City Land Use
Code; and,
WHEREAS, it is the responsibility of the Planning Commission to ensure
that Public Hearings are inform a reasonable and sufficient number of
possibly affected residents and agencies.
NOW THEREFORE, the City Council resolves that the public notice of
Public Hearings required by Ordinance 2006-01 will be as follows follows:
(a) List all Public Hearings on the City of Moab Web -site and post
said notices at two entrances into the City Center, 217 East
Center, at least 3 days prior to any Public Hearing; and,
(b) Notice Change of Zones, Preliminary Plats for Subdivisions and
Planned Unit Developments, Amendment of an existing
Subdivision where all the owners have not signed the Amended
Plat , "Similar Use Approval " for any use of a zone not listed,
and Site Plans for Multi- Residential, Commercial and Industrial
Uses will by (a) publication in the local newspaper and notice by
mail to all adjacent* residents at least 10 days prior to the
proposed Public Hearing, and, (b) by prominently posting
sign(s) on the property proposed for development that are no
smaller than 3' X 4', weather resistant and securely attached to
the ground via a pole at least 3 days prior to the Public hearing;
and,
(c) Notice by mail at least 10 days prior to Public Hearing to
Affected Public Entities listed below for Change of Zone,
Amendment to Subdivision or Land use Code, General Plan
Amendment, Development of a new General Plan, or where
said agencies may have some interest in projects noticed by
Section B.
(d) It shall be the responsibility of the developer to address and
stamp all envelopes sent by the City to adjacent land owners as
defined herein.

* Adjacent is herein understood to mean all properties
that directly abut the parcel or property, or
immediately adjacent to a public right-of-way over
which notice would extend opposite said parcel lot
lines 100 ft in each direction from the parcel where
noticed action was to take place.
