HomeMy Public PortalAbout2016-05-161 REGULAR COUNCIL MEETING, MAY 16, 2016 CALL TO ORDER The Regular Council Meeting of May 16, 2016, was convened at 6:00 P.M. by Mayor Carrie Tergin. ROLL CALL The following Council Members were present for the roll call: Present: Branch, Costales, Graham, Henry, Hussey, Mihalevich, Prather, Schreiber, Ward, and Wiseman Absent: None A quorum was declared present. Mayor Tergin explained the Code requirement for speakers for “Presentations from the Gallery” to sign up on the sign-up sheet provided before the beginning of the meeting in order to be allowed to make such presentations. She indicated the Council may vote to suspend its own rules to allow speakers who have not signed up. No one had signed up to speak at tonight’s meeting. ADOPTION OF THE AGENDA A motion was made by Councilman Graham for adoption of the agenda as published, seconded by Councilman Prather, and approved unanimously. MISCELLANEOUS AGENDA ITEMS Mayor Tergin recognized a Boy Scout in the audience and asked him to come forward to state his Troop and badge on which he was working. The Scout indicated he was from Troop 104 at Thomas Jefferson Middle School and was currently working towards his Citizenship in the Community Merit Badge. Mayor Tergin welcomed him and wished him well on his achievement. Mayor Tergin made comments regarding the recent death of former City Councilman Richard (“Dick”) Groner and offered her condolences to his family on behalf of the City. 2 REGULAR COUNCIL MEETING, MAY 16, 2016 Mayor Tergin presented a Proclamation in observation of “Kids to Parks Day” to Mr. J. J. Gates of the Parks, Recreation, & Forestry Department. Mr. Gates thanked Mayor Tergin for the proclamation and emphasized the positive benefits gained by children who use the City’s parks, and encouraged the public to bring their kids to the parks often. Mayor Tergin read a proclamation honoring “Relay for Life” and stated the proclamation would be sent to the organization. She urged citizens to participate in this event to both raise awareness and funds to search for a cure for cancer. City Administrator Steve Crowell presented the Outstanding Employee Award for May to Mr. Larry Heckman who works as a Mechanic in the Parks, Recreation, & Forestry Department. Mr. Crowell detailed some projects on which Mr. Heckman’s expertise had provided not only much needed equipment for Parks, but also saved the City money by building the items himself. Mayor Tergin congratulated Mr. Heckman for for over 37 years of outstanding service to the City, and presented him with a City Coin and a gift certificate in appreciation for his dedication. PUBLIC HEARINGS (a) Rezoning 34.5 Acres of Land Addressed as 1050 South Country Club Drive from C-1 Neighborhood Commercial to RS-2 Single Family and Endorsing an Associated Comprehensive Plan Amendment. Planning & Protective Services Department Director Janice McMillan provided a detailed background of the proposed rezoning and offered to answer any questions. At the conclusion of staff testimony, Mayor Tergin asked if anyone present wished to make comments in favor of, or opposition to, the proposed rezoning. In Favor: Mr. Mike Bates, Central Missouri Professional Services, explained briefly how the proposed rezoning would facilitate the developer’s plan to develop the area. He answered questions asked by the Council. As no one else came forward to speak on the issue, Mayor Tergin declared the public hearing concluded, and stated the Council would now take up the associated pending bill. 2016-4 sponsored by Councilman Graham, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING 34.5 ACRES OF LAND ADDRESSED AS 1050 3 REGULAR COUNCIL MEETING, MAY 16, 2016 SOUTH COUNTRY CLUB DRIVE FROM C-1 NEIGHBORHOOD COMMERCIAL TO RS-2 SINGLE FAMILY RESIDENTIAL AND ENDORSING AN ASSOCIATED COMPREHENSIVE PLAN AMENDMENT. Bill 2016-4 was read third time by title, placed on final passage , and passed by the following roll-call vote as Ordinance 15526: Aye: Branch, Costales, Graham, Henry, Hussey, Mihalevich, Prather, Schreiber, Ward, and Wiseman Nay: None (b) Special Exception Use Permit to Operate a Neighborhood Center/Community Activity Building for Property Located at 1105 Lafayette Street (Boys’ & Girls’ Club) Planning & Protective Services Department Director Janice McMillan provided a detailed background of the proposed use for the property, and offered to answer any questions. At the conclusion of staff testimony, Mayor Tergin asked if anyone present wished to make comments in favor of, or opposition to, the proposed rezoning. In Favor: Mr. Mike Bates, Central Missouri Professional Services, explained briefly the history of the former and future facility, and explained issues of parking, etc., connected with the project. Mr. Tim Sigmund, Vice-President of the Boys and Girls Club Board of Directors, offered to answer any questions the Council might have. As no one else came forward to speak on the issue, Mayor Tergin declared the public hearing concluded, and stated the Council would now take up the associated pending bill. 2016-5 sponsored by Councilman Graham, entitled AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A SPECIAL EXCEPTION USE PERMIT FOR CONSTRUCTION OF A NEIGHBORHOOD CENTER/COMMUNITY ACTIVITY BUILDING ADDRESSED AS 1105 LAFAYETTE STREET, DESCRIBED AS PART OF OUTLOTS 26 AND 82 AND PART OF VACATED FRANKLIN STREET RIGHT OF WAY, JEFFERSON CITY, COLE COUNTY, MISSOURI. 4 REGULAR COUNCIL MEETING, MAY 16, 2016 Bill 2016-5 was read third time by title, placed on final passage , and passed by the following roll-call vote as Ordinance 15527: Aye: Branch, Costales, Graham, Henry, Hussey, Mihalevich, Prather, Schreiber, Ward, and Wiseman Nay: None APPOINTMENTS BY THE MAYOR The following appointments to City Boards and Commissions were recommended for approval: *3rd term requires 2/3 majority vote A motion was made by Councilman Costales for approval of the appointments as recommended, seconded by Councilman Graham, and approved unanimously. APPROVAL OF CLOSED SESSION MINUTES 10 REGULAR COUNCIL MEETING, MAY 16, 2016 A motion was made by Councilman Henry to approve the May 2, 2016, Closed Session Minutes. The motion was seconded by Councilman Mihalevich, and approved by the following roll-call vote: Aye: Branch, Graham, Henry, Hussey, Mihalevich, Prather, Schreiber, Ward, and Wiseman Nay: None Abstain: Costales GO INTO CLOSED SESSION Mayor Tergin stated that, pursuant to Sec. 610.021 of the Revised Statutes of Missouri, the Chair will entertain a motion to go into Closed Session to discuss the following: a. Discussion of Operational Guidelines, Policies, and Response plans “for use in responding to or preventing any critical incident which is or appears to be terrorist in nature.” Disclosure would impair the City’s ability to project the security or safety of people and property; public interest in non -disclosure outweighs the public interest in having this portion of the meeting be open. [Sec. 610.021.18] A motion was made by Councilman Mihalevich to go into Closed Session at this time for the above-stated purpose, seconded by Councilman Costales, and approved unanimously by the following roll-call vote at 6:55 P.M.
