A RESOLUTION APPROVING A PRE -ANNEXATION AGREEMENT BETWEEN THE
CITY OF MOAB AND MOAB 21 LLC
WHEREAS, Moab 21 LLC owns property in the area northwest of Moab City Limits; and
WHEREAS, Moab 21 LLC desires to receive culinary water and sanitary sewer services for the
Holiday Inn Express property; and
WHEREAS, the City of Moab currently owns, operates and maintains a culinary water and
sanitary sewer system; and
WHEREAS, Moab 21 LLC and the City of Moab desire that the Moab 21 LLC property will
eventually be annexed into the City; and
WHEREAS, the Pre -annexation Agreement, Storm Water Drainage Easement, Purchase Option
Agreement and other executable exhibits have been presented to this meeting of the City
Council.
NOW THEREFORE, we, the Governing Body of the City of Moab do hereby resolve to approve
the Pre -annexation Agreement, Storm Water Drainage Easement, Purchase Option Agreement
and all other executable exhibits in substantially the form presented at the meeting of the Moab
City Council, and direct the appropriate parties to execute and deliver said documents at the time
specified in the Pre -annexation agreement.
This resolution shall take effect immediately upon passage.
Passed and adopted by action of the Governing Body of the City of Moab in open session
this 14th day of March, 2006.
