HomeMy Public PortalAboutRES-CC-2006-06Resolution #06-2006 A RESOLUTION GRANTING AN EXCEPTION TO THE BLOCK LENGTH STANDARD AS SET FORTH IN THE MOAB MUNICIPAL CODE FOR THE PROPOSED ALLEN SUBDIVSION. WHEREAS, the City of Moab is supportive of residential subdivisions where said projects can be efficiently and safely developed; and WHEREAS, the Moab Municipal Code at 16.24.020.A limits block length to one thousand feet maximum; and WHEREAS, the Moab Municipal Code at 16.08.030 provides the authority for the Council to grant an exception to the block length standard in cases where unusual topographic or other exceptional conditions exist provided that the exception does not cause substantial detriment to the public good; and WHEREAS, the subject property is surrounded on three sides by public lands restricting the possibility of future development and the extension of Birch Avenue would require relocation of a large gas transmission pipeline; factors that constitute exceptional conditions specific to this property; and WHEREAS, the Planning Commission reviewed the request for a block length exception and determined that the exception would not cause substantial detriment to the public good provided the following conditions are imposed: (1) traffic calming measures are installed on the proposed Doc Allen Drive, and (2) a pedestrian public access route is provided through the proposed subdivision connecting Birch Avenue with the public lands to the west; and WHEREAS, the Planning Commission, in its regular meeting on January 26, 2006, passed a recommendation that the City Council grant said exception subject to the conditions stated above. NOW THEREFORE, we, the Governing Body of the City of Moab do hereby resolve to grant an exception to the block length standard as set forth in Moab Municipal Code 16.24.020 for the proposed Allen Subdivision located in Section 12, T 26 S, R 22 E, SLM subject to the Subdivider installing traffic calming measures on the proposed Doc Allen Drive, and the Subdivider providing pedestrian public access route through the proposed subdivision connecting Birch Avenue with the public lands to the west. Passed and adopted by action of the Governing Body of the City of Moab in open session this 14`" day of March, 2006. SI Davi L.
