HomeMy Public PortalAboutResolution 68-833RESOLUTION N0. 68 -833 A RESOLUTION OF THE CITY COUNCIL OF TEE CITY OF TEMPLE CITY GRANTING AN APPLICATION FOR A CONDITIONAL USE PERMIT IN CASE 68 -253 AND MODIFYING RESOLUTION 68 -298 P.C. IN CONNECTION THEREWITH. THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE: SECTION 1. The City Council finds and determines: (a) That the owners of certain real property located in the City of Temple City, County of Los.Angeles, State of California, located at 5508 Rosemead Boulevard in said City, more particularly described as Lot 20 of Sunny View Tract,•Book 13, page 156 of Maps in the Office of the County Recorder, County of Los Angeles, State of California have heretofore filed an application for a Condi- . tional Use Permit to allow the construction of a sign, and reconstruct certain of the facilities of an existing automobile service station; and (b) That the Planning Commission has conducted a duly noticed public hearing on such application; that said Planning Commission has granted said Condi- tional Use Permit subject to certain conditions. (c) That the applicant has duly appealed such decision to the City Council and a public hearing has been held on such appeal. SECTION 2. Based upon the evidence adduced at such hearing and the files -and staff reports herein, and each member of the City Council being familiar with -the site, the City Council finds and determines that Resolution No. 68 -298 P.C. granting such Conditional Use Permit is hereby modified as follows: (a) That the-applicant shall guarantee by the deposit of a bond or time certificate, curbs, gutters, sidewalks and pave -out on the easterly 75 ft. on the property fronting Broadway where no improve- ments exist at this time at the time of Broadway improvement; and (b) That .a minimum of 150 sq. ft. of planting area shall be located and maintained at the northeast corner-of Rosemead Boulevard and Broadway; and (c) That the planting area shall be separated from asphaltic paving by a 6" high curbing; and (d) That planting shall not exceed a height of 30" and shall not encroach into the public right -of way; and 1 1 1 Resolution No, 68 -833 (e) That no vehicles parked on premises shall be offered for sale, lease or rent; and That no used or discarded automotive parts or equip- ment shall be located outside the service station building except within an enclosed trash storage area; and That the rental of equipment and the sale and rental of merchandise, not related to the use, shall be prohibited; and (h) That the revolving part of the proposed free - standing sign shall not exceed 4 RPM; and That no roof signs, banners, bunting strips, signal flags or flashing signs shall be permitted; and That all outdoor lighting shall be operated, shielded and maintained so as to prevent any glare or reflection, nuisance, inconvenience and /or hazardous interference of any kind to abutting or adjacent properties or public right -of -way; and (k) That all deliveries made to a service station shall be between the hours of 7:00 A.M. and 9:00 P.M.; and (1) That all business activities except servicing of vehicles with gasoline and oil shall be confined to the hours between 7:00 A.M. and 9:00 P,M.; and That no vehicular parking or storage shall be allowed on the subject property, except for that directly related to the service station usage; and (n) That all other applicable city regulations shall be complied with; and (o) That this variance shall expire and be of no effect unless exercised within a period of one year from and after the date of adoption of this resolution; and (f) (g) (i) (j ) (m) (p) That applicant shall file, or cause to be filed, with the City Clerk a document which the City may record, which shall acknowledge that the owner of the Subject Property is aware of and accepts the conditions set forth in paragraphs (a) through (o) above, and that the Subject Property, regardless of any change in ownership, is bound by and subject to the provisions of this Resolution and the conditions contained herein. SECTION 3.
