The purpose of the Project is to create a swimming area on the bayside of the Village of Key Biscayne by installing four (4) swim area buoys. The buoys will be illustrated with the words "Swim Zone" and regulatory symbols denoting the swim area. The buoys will be held to the bottom by helical steel anchor shafts that will be drilled into the substrate at the selected locations. Divers will be used to select the best location for each buoy, prior to installation, to avoid impacts to aquatic resources to the maximum extent practicable. A steel downline will be used to connect the buoys to the anchor shaft. A Stormsoft Shock Absorber will be installed on the line, which will allow the line to be adjusted to ensure it does not rest on the bottom during low tide or otherwise affect submerged aquatic resources. The standard manatee conditions will be adhered to during all in water work. The swimming area buoys will be maintained by the Village of Key Biscayne and demarcate a public swimming area in compliance with Village Ordinance No. 2011-13. The swim area will not be operated as a commercial facility and revenue will not be collected for the use of the swim area. The swimming bouys will not act as moorng buoys. We respectfully request verification that the proposed activities are clearly in the Public's interest and will qualify for a De Minimus Exemption and Letter of Consent, pursuant to Chapters 253, 258, and 373 Florida Statutes. We are also requesting verification of the Nationwide Permit #1 from the US Army Corps of Engineers. The client is concurrently working with the Florida Fish and Wildlife Conservation Commission's Waterway Management Unit to obtain a Uniform Waterway Marker Permit for the proposed buoys. The proposed buoys are not lighted and therefore will not require separate authorization from the U.S. Coast Guard.
