HomeMy Public PortalAboutRES-CC-2006-13Resolution #13-2006 A RESOLUTION APPROVING A HILLSIDE DEVELOPMENT PERMIT FOR THE SUNRISE HILLS SUBDIVISION WHEREAS, Moab Municipal Code Chapter 17.55 provides for the standards for the development and excavation of hillside and slope areas located in the City so as to minimize soil and slope instability, erosion, and the negative effects associated with construction in geologic hazard zones; and WHEREAS, Chapter 17.55 also provides for the minimization of the visual effects of scarring caused by hillside excavation; and WHEREAS, the Sunrise Hills Subdivision is defined as a major development under Chapter 17.55; and WHEREAS, individual lots within major developments are included in the Hillside Development Permit for the major development such that individual permits for individual lots will not be required; and WHEREAS, a major development is required to obtain a Hillside Development Permit; and WHEREAS, Parcel A of the Sunrise Hills Subdivision is not to be included in the Permit; WHEREAS, the process for obtaining a Hillside Development Permit requires a number of submittals; and WHEREAS, the applicant has provided said submittals; and WHEREAS, the applicant performed a slope analysis and determined the allowable density of the area that is subject to the Moab City hillside ordinance; and, WHEREAS, a site plan has been developed for the subdivision; and, WHEREAS, geologic hazards were identified in the area using mapping from the Utah Geological Survey, Special Study 107, Geologic Hazards of Moab, that was completed in 2003; and, WHEREAS, a subdivision plat and construction drawings have been developed for the subdivision which includes mitigation efforts of potential hazards along areas of the hillside; and, Resolution #13-2006 Page 1 of 3 WHEREAS, potential soil problems were identified and noted on the final subdivision plat; and, WHEREAS, an analysis along the hillside was performed by a rockfall specialist and it was determined that the rockfall hazard could be mitigated with the construction of a catchment berm; and, WHEREAS, an appropriate catchment berm has been designed and is included in the subdivision construction drawings; and, WHEREAS, the height of buildings on lands subject to the Moab hillside ordinance are limited to twenty feet in height and shall have a deed restriction as noted on the subdivision plat; and, WHEREAS, buildings constructed upon lands subject to the hillside ordinance shall be constructed with materials appropriate to mitigate significant visual impacts and should be constructed with materials that closely resemble and blend in with native vegetation and hillside features; and, NOW THEREFORE, the City finds that the health, safety and the general public welfare of the residents of the City will be promoted through the adherence to the Moab Municipal Code Section 17.55 and the City Council hereby grants approval to the Sunrise Hills subdivision as major hillside development on the following conditions of approval: 1. Inclusion of a note on the final subdivision plat that lots 20, 21 and 26- 31 may have potential soil problems that should be analyzed and mitigated prior to the issuance of a building permit for said lots; 2. Approval of construction drawings by the City Engineer and Public Works Director of the drainage and rockfall mitigation improvements; 3. Recordation of conservation easement providing for the conservation of undisturbed hillside property for a portion of lot 31 of the Sunrise Hills Subdivision as stipulated in the said easement; 4. Inclusion of a note on the final subdivision plant that the height of buildings on lands subject to the Moab hillside ordinance are limited to twenty feet in height and shall be constructed with materials appropriate to mitigate significant visual impacts; 5. Exclusion of Parcel A from the major development and this Hillside Development Permit; and 6. The abidance by the subdivider of all other provisions of the Chapter 17.55.
