AN ORDINANCE AUTHORIZING A MAJOR AMENDMENT TO ARBOR TRACE
PLANNED UNIT DEVELOPMENT AND AMENDING ORDINANCE NUMBER 69-2005.
WHEREAS, the City of Richmond, through Ordinance Number 69-2005, previously amended the
Zoning Map which designated certain property commonly known as Arbor Trace, 3701
Hodgin Road, Richmond, Indiana, and legally described as follows:
Lot 2 Cherish Property LLC PUD Phase 1 Primary Care Facility
NW 11-13-1 containing 1.1316 Acres
as a PUD R-1 One -Family Residential District (a Planned Unit Development), with
certain restrictions as outlined on Ordinance 69-2005, which is attached hereto as Exhibit
A;
WHEREAS, it is desirable to amend the Planned Unit Development described above and subject to the
restrictions set forth in Exhibit "A" in order to allow Arbor Trace H&L Property, LLC,
the owner of Arbor Trace, to add to the existing primary care facility a rehabilitation
therapy wing and a maintenance garage as outlined in the attached Exhibit B;
WHEREAS, the rehabilitation wing, car port and garage will substantially match the existing building
in regard to guilding material, pitch of roof and detailing;
WHEREAS, additional landscaping sufficient to buffer the garage and southern boundary of the lot
will be installed before a Certificate of Occupancy will be issued;
WHEREAS, parking access off the potential extension of South 371h Street will be reduced down to a
single lane entrance; and
WHEREAS, the additional parking will be screened with landscaping.
NOW THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the
Planned Unit Development located at 3701 Hodgin Road, Richmond, Indiana, commonly known as Arbor
Trace, which Planned Unit Development was approved and subjected to certain restrictions under
Ordinance 69-2005, as set forth in Exhibit "A", is amended to allow the owner, Arbor Trace H&L
Property, LLC to construct adjacent to its existing primary care facility a rehabilitation therapy wing and
a maintenance garage, as set forth in Exhibit `B".
Passed and Adopted this 2nd day of November, 2009, by the Common Council of the City of Richmond,
Indiana.
