A RESOLUTION ADOPTING AN INTERLOCAL AGREEMENT AS TO THE
CREATION, FUNDING AND ADMINISTRATION OF A JOINT AFFORDABLE HOUSING
PLAN BY AND BETWEEN GRAND COUNTY, THE CITY OF MOAB AND THE HOUSING
AUTHORITY OF SOUTHEAST UTAH.
WHEREAS, Moab City, Utah ("City"), Grand County, Utah ("Grand County"), and the
Housing Authority of Southeast Utah have had discussions regarding the creation, funding and
administration of a joint affordable housing plan, and the benefits associated with the creation of a
plan; and
WHEREAS, Moab City, Grand County and the Housing Authority of Southeast Utah have
determined that the Plan can best be created through an interlocal agreement; and
WHEREAS, the Interlocal Agreement as to the creation of a joint affordable housing plan has
been submitted to the Moab City Council and the Grand County Council,
NOW, THEREFORE, BE IT RESOLVED BY THE MOAB CITY COUNCIL that:
1. The Council hereby authorizes and approves the Agreement in substantially the form
presented to this meeting of the Moab City Council.
2. The appropriate officials are hereby authorized and directed to execute and deliver the
Agreement in substantially the form presented to this meeting of the Council.
3. This resolution shall be effective immediately upon its passage.

INTERLOCAL AGREEMENT AS TO THE CREATION, FUNDING AND
ADMINISTRATION OF A JOINT AFFORDABLE HOUSING PLAN BY AND
BETWEEN GRAND COUNTY, THE CITY OF MOAB AND THE HOUSING
AUTHORITY OF SOUTHEAST UTAH
WHEREAS, the City of Moab, Utah ("City"), Grand County "(County") and the Housing
Authority of Southeast Utah ("HASU") have determined that the creation of a joint
affordable housing plan will be the most efficient and beneficial method to provide
affordable housing opportunities in Grand County; and
WHEREAS, pursuant to the Interlocal Cooperation Act (Section 11-13-1 et. seq. Utah
Code Annotated) and for the mutual benefit of the citizens and inhabitants of the City and
the County, the City, the County and HASU hereby agree as follows:
1. Purpose. The purpose of this agreement is to facilitate the production and adoption
by local governing agencies of a Moderate Income Housing Plan ("Plan") and Moderate
Income Housing Plan components of the Grand County and Moab City General Plans.
The aim is to produce a Plan that will be approved by the Grand County Council and the
Moab City Council. The Plan will also be approved by the governing board of HASU.
The Plan will help guide the work of the County, the City, and HASU in proposing,
initiating, supporting, and/or participating in efforts to increase the amount and improve
the quality of housing affordable to households earning less than 80 percent of the area
median income in Moab and Grand County.
The Plan will fulfill all State of Utah requirements to adopt a moderate income
housing plan component of each general plan in order to provide for moderate income
housing needs in each local jurisdiction.
The Plan will address the current state of affordable housing in the county. The
Plan will define the problem and will address regulatory and discretionary solutions. The
Plan will establish concrete, measurable goals in the effort to address the current
affordable housing shortage, and will establish measurable goals to ensure that Moab and
Grand County remain cognizant ofthe need to continue to address the affordable housing
issue in the future.
2. Provision of Services. HASU will procure the services of a qualified consultant to
develop the Plan. HASU will work with said consultant to develop a scope of work for
the development of the Plan. This scope of work shall be approved by the administrative
committee provided for in Section 7 of this agreement. The scope of work shall detail the
process for development of the Plan, proposed use of local resources, delineation of
public and agency involvement, and a schedule outlining important dates and project
deliverables.
3. Financial Responsibilities. Financial responsibility for the Plan will be divided
equally among the County, the City and HASU. Grants and contributions obtained to
help defray the cost of the Plan shall be applied to the total cost of the project, reducing
the financial liability equally among the participants. The total cost for the Plan shall not
exceed $18,000.
4. Control of Property, Materials and Equipment. Upon completion the Plan shall be the
joint intellectual property of the County, the City and HASU. Pursuant to Section 11-13-
7, Utah Code Annotated, all the parties to this agreement shall exercise control over all
materials and equipment provided in fulfilling its obligations under this agreement.
5. Effectiveness and Duration of Agreement. This agreement shall become effective
immediately upon its approval by resolutions of the County Council and the City
Council, and the approval of the governing board of HASU. This agreement shall remain
in effect until the adoption of the plan by the parties hereto.
6. Budget Administration. HASU will administer the budget for the Plan. Expenditures
will be reviewed and approved by the administrative committee referred to in Section 7
below.
7. Administration of Agreement. This agreement shall be administered by an
administrative committee composed of the County Administrator, the City Manager, and
the Executive Director of HASU, or their designated representatives._ The administrative
committee shall approve the scope of work of the consultant procured by HASU and shall
monitor the activities associated with this agreement.
