MAKING A REDUCTION OF THE PERFORMANCE GUARANTEE FOR
PUBLIC IMPROVEMENTS AND AUTHORIZING A TIME EXTENSION
FOR COMPLETION OF PUBLIC IMPROVEMENTSAND APPROVING A
PERFORMANCE GUARANTEE FOR OLD MILL KENNELS
WHEREAS, the town Director of Engineering and Public Works has reviewed the public
improvements installed to date at Old Mill Kennels and confirmed that the value of work performed
exceeds $27,200.00; and
WHEREAS, Old Mill Kennel, Inc., the developer of Old Mill Kennels, has not completed all the
required public improvements in accordance with the approved construction drawings and town standards
within the two-year period agreed to in the contract for public improvements; and
WHEREAS, the developer has requested a sixty (60) day time extension to complete the public
improvements; and
WHEREAS, a letter of credit fi.om F & M Bank - Winchester in the amount of $34,000.00 has
been provided by the developer and approved by the Council to guarantee installation of public
improvements at Old Mill Kennels; and
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The letter of credit fi.om F & M Bank - Winchester in the amount of $34,000.00
is reduced to $6,800.00 and is approved to guarantee the installation of public improvements at Old Mill
Kennels.
SECTION II. The Town Manager shall notify the developer that liability for the letter of credit
funds has been reduced as outlined in Section I of this resolution, and that this reduction does not
constitute acceptance of public improvements by the town or relieve the developer of responsibilities
outlined in the contract for public improvements for Old Mill Kennels.
