Initial: / B. The Agency certifies that it is a non-profit organization and has tax-exempt status under the Internal Revenue Co a or governm r1.t agency and will submit certification of status. Initial: /�/L- Gleaner Food Bank Responsibilities A. Indiana State Department of Health (hereinafter referred to as ISDH, acting as an agent of the United States Department of Agriculture (hereinafter referred to as USDA), will provide USDA food products monthly to GFB. The GFB will then provide food pack es to abo e p med Local Agency for distribution to eligible participants. Initial: // B. GFB does not guarantee the quality or condition of food products provided to the agency. The LA shall release USDA, ISDH, and GFB from any liability for losses, damages, illnesses, or, i jyies resulting from distribution of food packages. Initial: / C. GFB actin as an agent of ISDH, shall supply the LA with all the necessary reporting forms for distribution of CSFP food packages. Local Agency Responsibilities A. The LA shall not charge any fees or require membership as a condition for receipt of food package. This agreement prohibits the requirement of membership in any organization (church, political, fraternal, union, block club, etc.) or attend��c��of same, as a requisite for receipt of any food package. The LA shall abide by the Federal Civil Rights Act of 1964, the Federal Rehabilitation Act of 1973, The Americans with Disabilities Act, Title IX of the Education Amendments of 1972, The Age Discrimination Act of 1975, and all other federal and state laws, regulations, or orders. In accordance with federal law and USDA policy, this institution is prohibited from discrimination in all its programs and ctivities� on the basis of race, color, national origin, sex, age, or disability. The LA shall not allow the sale, exchange, or use of any USDA food for personal gain, or as a means to further the political interest of any individual or party. When physical delivery of food packages is taken, the LA shall assume liability for the safekeeping of the food product until the food packages are released to eligible recipients or authorized proxy. Losses must be immediately reported to GFB. The LA will be the carrier insuranceJaill supply GFB with a copy of a Certificate of Insurance. Initial: K. In the event of loss or damage to USDA food due to theft or damage resulting from improper storage, or as a consequence of negligence in the care or handling of USDA food by LA. The LA will reimburse ISDH the value of the lost USDA food or replace the USDA food with product equivalent t99 the lost of d ed product as approved by ISDH and/or the USDA. Initial: Gam/ /C� L. The LA agrees to cooperate with GFB and ISDH in the investigation of all complaints received in connection with distribution of food packages. The LA agrees to correct any irregularities that are disclosed. The LA shall report promptly, first by phone and then in writing, to GFB, complaints and all corrective measures taken. If any irregularities are deemed critical, GFB and/or ISHD may immediate y remove LA participation in the program with only verbal notification. Initial: /tTT khk 3/4/14 Page 2 of 4 M. The LA shall maintain a clean, secure and adequate facility for proper storage and distribution of all food packages received. Storage facilities must be maintained in keeping wit he hig y'(!�ate or local health department standards. Initial: N. The LA shall safeguard USDA food from theft, spoilage, and other damage, destruction, or loss by maintaining storage areas: 1) secure from unauthorized access; 2) free of rodent, bird, insect, and other animal infestation 3) clean and free from litter or debris and otherwise maintained in sanitary conditions; 4) at temperature and humidity levels necessary to assure maintenance of quality level to that of the food received. Recommended temperatures are to be 50-70 degrees Fahrenheit for dry USDA foods and 36-40 degrees Fahrenheit for refrigerated product (cheese); 5) y taking oth otective measures as necessary Initial: / O. The ALA agrees that representatives of from USDA, ISDH, GFB, or any agency designated by ISDH may visit to observe distribution of CSFP food packages to recipients, storage facilities, food packages in storage, as well as, pertinent records. The LA shall collect such operations records as necessary for USDA, ISDH and GFB to monitor services provided under this agreement. If the LA utilizes volunteers to assist in the distributing food packages, all volunteers will be properly trained on the completion of all records and forms. This record keeping must include: 1.
