TOWN OF BREWSTER MINUTES OF PLANNING BOARD
Tuesday, January 21, 2003 7:00 P.M.
Brewster Town Office Building
1. Present: Chairman Taylor convened the Planning Board meeting at 7:OOPM in the Brewster Town
Office Building with members Henchy, Pierce, McMullen, Bugle and Remy present.
2. INFORMAL DISCUSSION REGARDING THE GRANTED SPECIAL PERMIT FOR — LUKE
BREWSTER REALTY TRUST - Located at 15 Lower Road on Assessors' Map 20, Lot 39 — for a
coffee and baked goods shop in existing building, in a vacant unit. Present: Myer Singer.
3. Singer- Luke Brewster Realty Trust has leased the coffee and baked goods shop to Dunkin Donuts. The
applicant then applied to the Board of Selectmen for a Common Vehicular License and a concern about
traffic arose the applicant then withdrew the application and proceeded to have a traffic study done. The
board has been presented with a copy of the study for tonight's meeting, and is asked if the Planning
Board has any concerns.
4. Taylor — The Traffic study has been referred to the Cape Cod Commission for review on a
recommendation of the Board of Selectmen.
5. Singer was not aware of the referral and requested that this discussion continue when the review of the
Cape Cod Commission was complete. The Board agreed to wait for the report before discussion.
6. PLANNING BOARD WILL ATTEND MEETING OF THE BOARD OF SELECTMEN IN
ROOM A.
7. The Planning Board adjourned their meeting at 7:30PM to attended the meeting of the Board of
Selectmen. The Planning Board re-convened for their hearing at 8:OOPM.
8. CONTINUANCE OF LEGAL HEARING — SPECIAL PERMIT #SP2002-20 CORRIDOR
OVERLAY PROTECTION DISTRICT BYLAW — BRANDT, PETER — Located off Underpass
Road, on Assessors' Map 27, Lot 20-5—construct a 40 x 100 metal building for a Showroom, office
and storage. Present: Tim Brady.
9. The Board attended the Board of Selectmen's meeting regarding an application in front of them for the
same applicant and property (Peter Brandt, Underpass Road). At 8:OOPM the Board reviewed the new
material and plans. The Board requested that lattice be added to the exposed southerly side of the

foundation. A narrative was requested as to the type of operation. On a Motion by Bugle, McMullen
second, "the Board continued the hearing until February 4, 2003 at 8:OOPM." All voted in favor.
10. SPECIAL PERMIT #SP2002-17 —CORRIDOR OVERLAY PROTECTION DISTRICT BYLAW
—BRANDT, PETER—Located off Freeman's Way on Commerce Park Road, on Assessors' Map
46, Lot 41, known as sub Lot #3. — Change of use of existing building from manufacturing to
automobile garage and storage.
11. This matter came before the Planning Board on October 22, 2002, at which time the applicant presented
the application for special permit to the Board. The matter was continued by agreement, pending a
decision by the Brewster Board of Selectmen on the license application for the same project under the
provisions of M.G.L. c. 148, sec. 13. On January 6, 2003, the Selectmen voted to deny the M.G.L. c.
148, sec. 13 license to the applicant. In light of that denial, the applicant communicated to the Planning
Board that it no longer desired to pursue the application for the special permit. On Jnauary 21. 2003,
the date to which the matter had been previously continued, no one appeared to represent the applicant at
the designated time for the hearing. In light of the denial by the Board of Selectmen, which denial
rendered the special permit application moot, and in light of the fact that the applicant no longer wished
to pursue the special permit application, the Planning Board voted S (Tavlor. Bugle. Remv. McMullen
and Pierce) to 1 abstention (Henchy) to deny the same.
12. Meeting adjourned at 9:OOPM.
