The Council of the City of Medina met in regular session on Tuesday, June 1, 1982 at
7:30 P.M.
Present: Mayor, Thomas Anderson; Councilmembers, William Reiser, Thomas Crosby, Wilfred
Scherer; Clerk -Treasurer, Donna Roehl; Public Works Director, Jim Dillman;
Planning and Zoning Administrator, JoEllen Harr; Acting Police Chief Michael
Rouillard; Attorney, Richard Schieffer
Absent: Councilmember, Sarah Lutz
1. ADDITIONAL AGENDA ITEMISS
Council agreed to discuss the following additional agenda items:
Mark Roskop, Clothing bill
John Raskob, Garage variance
Hennepin County, jail bill
Sylvia Rudolph, pay increase request
Establishment of an HRA
2. PUBLIC WORKS DEPARTMENT
Minnesota Gas Company
Motion by Crosby, seconded by Reiser to adopt Resolution 82-10, allowing Minnegasco to
install gas lines along Co. Rd. 19 and along the Independence Beach streets, provided
that no trenches are dug in the streets, all digging be augered underneath streets.
Motion declared carried
Lawn mower trailer
Jim•Dillman presented information on the purchase of a trailer on which to transport the
lawn mower: A new trailer would cost approximately $2500; materials to build a new one
would cost approximately 11500 and a used trailer from M and P Utilities would cost $1000
plus $100 to repair.
Motion by Scherer, seconded by Crosby to purchase the used trailer from M and P Utilities
for $1000 and repair, as suggested.
Motion declared carried
Francis Pumarlo Contract
Discussion of the prepared contract designating Francis Pumarlo as a private contractor
to perform various tasks in the Public Works Department.
Motion by Scherer, seconded by Reiser to enter into contract with Francis Pumarlo for
$8.00 per hour.
Motion declared carried
3. POLICE DEPARTMENT
Richard Setter Contract
Motion by Crosby, seconded by Reiser to enter into contract with Richard Setter for work
as outlined in connection with hiring a Chief of Police.
Motion declared carried
Animal Control
Micheal Rouillard stated that discussions with a private party to handle animal control
had been tabled for the time being and that the Police Department would be bringing dogs
to the cities kennel to be held for 24 hours.
Hennepin County Police Dispatching
Michael Rouillard commented on'the fact that 8 Channel radios are needed to communicate
with other departments, under the new system that is being put into effect and that Medina
would be receiving the new radios after Hennepin County receives additional units.
Radar Units
Michael Rouillard stated that the existing radar units need to be repaired at a cost of
approximately $1500. He presented the following quotes on new units: KR 1 ® $1995 each;
MPH @ $883.25 each, with a $50.00 per unit trade-in.
Motion by Reiser, seconded by Crosby to purchase one radar unit for $833.25, including
tradd-in.

Mark Roskop
Mark Roskop requested that the city pay for clothing he had purchased prior to his knowing
his posistion as a part-time police officer, would be terminated. He also asked that the
remainder of his bill for 1981 purchases be paid.
He discussed the fact that he wished that Council had given him additional time to com-
plete his licensing requirements because he thought he had been doing a good job as a
police officer.
Thomas Anderson stated that the city was under obligation to discharge him because of State
licensing requirements that had not been met and perhaps a new police chief would reappraise
the situation.
Motion by Crosby, seconded by Scherer to pay Mark Roskop $103.40 remaining from his 1981
clothing bill and $54.95 for items purchased in 1982 with Mr. Roskop return police equip-
ment, other than clothing, to the city.

Hennepin County.Jail Bill
Michael Rouillard stated that he is researching the bill to determine if charges are Med-
ina's.
Donna Roehl was asked to write a letter to the Hennepin County judges requesting that they
assess fines equal to jail bills.
Speed Limit Changes
Michael Rouillard reported the Minnesota Public Safety Director makes a final determination
regarding lowering speed limits after the city has engineering and traffic speed reports
completed.
Thomas Crosby stated that the matter should be tabled until after the Medina Morningside
streets are completed; at which time a survey of traffic could be completed.
Police Equipment
Michael Rouillard recommended that the city not return the new gun that has been received
from Streicher as a new officer could use it.
Tower Dr. and Hickory Dr. Stop Signs
Michael Rouillard recommended that Stop signs be placed on Hickory Dr. near the apartment
building in Hamel and on Tower Dr., both sides of Pinto Dr.
Motion by Reiser, seconded by Scherer to authorize installation of Stop signs, as recommended.

1 83-84 Police Contract
Thomas Anderson asked if the city needed a negotiator to work on the police contract.
Members asked that one meeting be held without a negotiator to determined what the issues
might be that need to be negotiated.
William Reiser, Thomas Anderson and Thomas Crosby agreed to meet with a Union represent-
ative, at a first meeting.
Police Recruiting System
Motion by Crosby, seconded by Reiser to appoint William Reiser as delegate and Wilfred
Scherer as alternate to the Suburban Police Recruiting System, Board of Directors.
Motion declared carried
4. PLANNING AND ZONING DEPARTMENT
Notary Public
Motion by Crosby, seconded by Scherer to authorize JoEllen Hurr to make application as a
Notary Public, at a cost of $10.00 plus $30.00 for a seven year notarial bond.
Motion declared carried
Woodlake Sanitary Landfill
JoEllen Hurr reported that she had attended a meeting with Hennepin County personnel to
discuss long term liability for the Woodlake Landfill.
She stated that the Task Force members would be discussing liability, end use of the land-
fill property, landscaping and any other pertinent items, at their June 9th meeting.

Robert Franklin reported that John Spaeth had installed 4' x 4' cement pads in front of
each existing building and had not removed the old existing cement pad along the lake shore.
He also stated that the fence is still in violation of height requirements.
JoEllen Hurr stated that she would investigate Mr. Franklin's reported violations.
Richard Schaeffer stated that such items were included in covenants and asked if the Council
wished to have a resolution filed.
Mr. Franklin stated that a buyer or his attorney would not read all of the pages of covenants.
John Raskob
Discussion of the prepared resolution regarding granting a set -back variance to John Raskob
to build an addition to his existing garage.
Motion by Crosby, seconded by Scherer to modify the Raskob variance resolution by deleting
Item 5 as requirement is covered under Item 6; that Item 8 be conditioned upon renter moving
out and Item 1 definition of"permanently", shall mean"Swo weeks."

WCCO
JoEllen Hurr reported that a letter from the FAA had been received reporting that the FAA
Hearing Examiner has ruled that the placement of a tower would be a hazard to air navigation.
Meadowwoods Farm, Street Lights
JoEllen Hurr reported that the Groves Company would be paying installation charges for the
three street lights they have requested be placed in Meadoww000ds Farm.
Motion by Crosby, seconded by Scherer to enter into contract with Wright -Hennepin Electric
for street lighting in Meadowwoods Farm, according to plans submitted.

5. MEDINA MORNINGSIDE SEWER
Discussion of the modification in grant amount to be received from the EPA for Medina Morn-
ingside sewer construction based on the amount of the bid that had been awarded.
Motion by Crosby, seconded by Reiser to table action on the agreement modification pending
calculation, by McCombs -Knutson, of the effect on the construction funds if reduced Federal
funds are to be received.

6. SUMMER YOUTH PROGRAM
Motion by Crosby, seconded by Scherer to pay Sheri Zimmerman $1.50 per hour and Becky White
$.50 per hour from city funds, over the minimum wage they will be receiving through the CETA
Summer Youth Program.
7. ROLLING GREEN COUNTRY CLUB
Daryl Uphoff, Attorney for Rolling Green, appeared to discuss the financial situation of the
club and their application for an On -Sale Liquor license for 1982-83. He stated that under
Ch. 11 Bankruptcy proceedings the club cannot pay debts incurred prior to the Ch. 11 filing
and that the club is requesting consideration of their application pending the outcome of
a vote of the membership board on June 3rd.
Thomas Crosby asked if the 1982 taxes which were due on May 31st could be paid.
Mr. Uphoff stated that he believed that the taxes could be paid.
Richard Schieffer stated that there is no provision in the ordinance for issuance of a license
when taxes have not been paid.
Thomas Anderson stated that he did not have a problem with investigating club officers for
license purposes but he did have a problem if taxes were not paid.
Mr. Uphoff explained that they were going back to bankruptcy court on June 24th for plan
approval of Board of Directors decision.
Thomas Anderson suggested setting up an escrow fund, approve a 60 day license and not renew
it if difficulties are not resolved within the 60 days.
Thomas Crosby stated that he agreed with such an arrangement if a precedent were not being
set for any other establishments in the city that might have similar problems.
Council discussed amending the ordinance.
Matter was tabled until June 15th.

8. ORONO SCHOOL DISTRICT TASK FORCE
Motion by Scherer, seconded by Crosby to appoint Robert Franklin and Penny Elsenpeter to
serve on the °rono School District Task Force Committee to make recommendations regarding
future of the Maple Plain School.
Motion declared carried
9. WAYZATA COMMUNITY EDUCATION
Motion by Crosby, seconded by Reiser to appoint Edris Guest to a two year term on the Way-
zata Community Education Committee.
Motion declared carried
10. HOUSING REDEVELO'ia AUTHORITY
Richard Schieffer reported that an HRA had been established some years ago but that it would
be necessary to follow through on the process again in order for the city to acquire and im-
prove drainage on several designated Independence Beach tax forfeit lots.
Motion by Crosby, seconded by Scherer to hold a Public Hearing on July 6, 1982 at 8:00 P.M.
to establish an HRA, with the City Council to act as its Board of Directors. '1 A

11. SYLVIA RUDOLPH
Discussion of Sylvia Rudolph's letter requesting a raise in salary.
Motion by Reiser, seconded by Scherer to increase wages of Sylvia Rudolph to $7.00 per
hour.

12. MINUTES OF MAY 18, 1982
JoEllen Hurr asked that Woodlake Sanitary Landfill item, page 54, be corrected by changing
"Hennepin County does not want to assume long term liability"to "Hennepin County is concerned
about long term liability."
Ms. Hurr asked that Item 7, page 55, WCCO, paragraph, "Richard Schieffer explained that
language in 1972 permit was not clear and that he had requested clarification and that
Mr. Hamel had stricken everything from the ihsissa new petition that does not pertain....;
read as such.
Richard Schieffer asked that Item 7, page 56, WCC0, paragraph, "Richard Schaeffer stated
that amendments are those things favorable to the city versus those that are not favorable,
the difference is additional property.", be changed to "Richard Schieffer stated that dif-
ference between the 1972 permit and the current proposal are thearents favorable to the
city versus these things not favorable (additional acreage since 1972.)"
Motion by Crosby, seconded by Scherer to accept minuses of May 18, 1982, as amended.

13. BILLS
Motion by Reiser, seconded by Scherer to pay the bills; Order Checks # 1256-1311 in the
amount of $144,480.43 and Payroll Checks #6690-6710 in the amount of $7611.85.
