Brewster Town Office Building 1. Present: Chairman Taylor convened the Planning Board meeting at 7:OOPM in the Brewster Town Office Building with members Henchy, Pierce, McMullen and Remy present. 2. CONTINUENCE LEGAL HEARING—SPECIAL PERMIT#SP2002-19—CORRIDOR OVERLAY PROTECTION DISTRICT BYLAW—RABIN, ROBERT & PATRICIA—Located at 2421 Main Street, on Assessors' Map 15, Lot 74 & 75 —Relocate take-out pastry& Specialty food operation to its own free standing location. Present: Atty. Lois Farmer, Benoit Corillard and Tim Brady. 3. Brady presented the Board with a"Vision Statement" from the owners. 4. Brady—The proposed pastry shop will relocate from the existing location at the Chillingsworth Restaurant. The focus will be products made on the premises, especially pastries,but also soups, salads and pates. In addition, there will be, home made croissants, muffins, scones, specialty cookies, and chocolate truffles. In the new location the selection of items will be increased,but will be take out only. 5. Brady- The existing building has a small parking lot that does not meet today's standards. Landscaping plan needs to be done. All deliveries will be made from Chillingsworth, parking lot. 6. Farmer—Catering Services will be offered. Take out only. Maximum of two employees. 7. McMullen—all parking should be at Chillingsworth and the current entrance off 6A should be closed. 8. Farmer—this is a separate lot with a separate entrance, I don't think this Board has the legal authority to order a discontinuance of the existing curb cut on State Highway. 9. The Board requested that all parking be at the adjacent property or have a traffic study done to comply with Brewster Zoning Bylaw Chapter 179—67 COPD, all plans must show dimensions. On a motion by Henchy, McMullen second, the meeting was continued until 5/7/2003. All voted in favor. 10. LEGAL HEARING— SPECIAL PERMIT #SP2003-04—CORRIDOR OVERLAY PROTECTION DISTRICT BYLAW—Zuckerman/Pleasant Bay Assisted Living Facility—Located at South Orleans Road and Freeman's Way, on Assessors' Map 45, Lots 68 & 69—60 units of assisted living in a two story 60,626 sq. ft. building. 11. On a motion by Pierce, McMullen second "continue until April 23 at 7:30 at applicant's request". All voted in favor. 12. INFORMAL DISCUSSION WITH JEFFREY KARLSON RE: Tree removal. 13. Karlson—The trees suggested for removal have been pruned by the Utility Companies to a point where the tree trunk only is remaining. I would like to remove these trees. 14. The Board informed Mr. Karlson that a Public Hearing would need to be held under the Public Shade Tree Act. 15. The Board Discussed Our Lady of the Cape's approved COPD Plan with Mr. Chester Lay. Mr. Lay stated that the Church is in violation of the Special Permit issued by the Planning Board. The Board will send a letter to Building Commissioner Thyng regarding the enforcement of the Special Permit, a copy of the letter to be sent to the Board of Selectmen. 16. Meeting Adjourned 9:OOPM.
