RESOLUTION NO. 16-07
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, VALLEY
COUNTY, STATE OF IDAHO, ALLOWING THE PUBLIC WORKS DIRECTOR FOR THE
CITY OF McCALL, IDAHO TO IMPOSE LOAD LIMITS AND RATES OF SPEED ON ANY
HIGHWAY SECTION OR STREET WITHIN THE CITY'S JURISDICTION BY MAKING
REGULATIONS REDUCING PERMISSIBLE SIZES, WEIGHTS OR SPEEDS OF
VEHICLES OPERATED THEREON FOR ANY PERIODS NECESSARY FOR THE
PROTECTION OF SUCH HIGHWAY SECTION, STREET, OR FOR PUBLIC SAFETY;
PROVIDING FOR SIGNS DESIGNATING SUCH REGULATIONS; AND PROVIDING AN
EFFECTIVE DATE OF THIS RESOLUTION.
WHEREAS, Section 49-1005, Idaho Code, provides, in part, that whenever authorities in
charge of the operation of any section of highway determine that vehicle sizes and weights at
rates of speed permissible by law will cause damage to the highway section or interfere with the
safe and efficient use of the highway section, the authorities have the authority to make
regulations reducing the permissible sizes, weights or speeds of vehicles operated on that
highway section for any periods as may be necessary for the protection of that highway section
or for public safety and that signs designating such regulations shall be erected and maintained at
each end of the highway section and at intersections with main traveled highways; and
WHEREAS, the McCall City Council, based on a report by the McCall Public Works
Director has determined that certain highway sections and other streets located within the City of
McCall are at risk of damage due to heavy winter snowfall and an expected extended spring; and
WHEREAS, the McCall City Council recommends that the McCall Public Works
Director be authorized to impose load limits and rates of speed on any highway section or street
within the City's jurisdiction which the Public Works Director deems necessary to protect such
highway section, street, or the public safety.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
CITY OF McCALL, IDAHO, AS FOLLOWS:
1. Following a determination by the McCall Public Works Director that the
operation of vehicles of sizes and weights at rates of speed permissible by law will cause damage
to a highway section or street by reason of climatic or other conditions and will interfere with the
safe and efficient use of the highway section or street by the traveling public, the McCall Public
Works Director is authorized to make and impose regulations reducing the permissible sizes,
weights and/or speeds of vehicles operated on such highway section or street for any periods as
may be necessary for the protection of the highway section, street, or for public safety.

2. The McCall Public Works Director shall ensure that signs designating such
regulations shall be erected and maintained at each end of the highway section or street and at
intersections with main traveled highways.
3. This Resolution shall be in full force and effect immediately upon its adoption
and approval.
