A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TEMPLE CITY FINDING AND DETERMINING THAT THE
PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE
THE ACQUISITION OF CERTAIN REAL PROPERTY FOR PUBLIC
STREET PURPOSES AND ALL USES APPURTENANT THERETO
(BROADWAY: ROSEMEAD TO ENCINITA, IMPROVEMENT PROJECT)
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the City Council of the City of Temple City
does hereby find, determine and declare that the public interest, con-
venience and necessity require the acquisition by said City of the fee
title interest in and to certain hereinafter described real property
for public street purposes and all uses appurtenant thereto.
That the location of said rights of way has been planned
and located in a manner which will be most compatible with the great-
est public good and the least private injury.
SECTION 2. That it is the intention of said City Council to
acquire said property in its name, by a proceeding in condemnation, in
accordance with the provisions of the Code of Civil Procedure of the
State of California.
SECTION 3. That said real property hereinabove referred to,
the acquisition of which is required by said public interest, conven-
ience and necessity, for the purposes set forth in SECTION 1 hereof, is
located in the City of Temple City, County of Los Angeles, State of
California, and is more particularly described on Exhibit "A" attached
hereto, incorporated herein and made a part hereof by reference.
SECTION 4. That the City Attorney of the City of Temple City
and designated Special Counsel are hereby authorized and directed to
prepare, institute and prosecute, in the name of said City, such pro-
ceedings in the proper Court having jurisdiction thereof as may be
necessary for the acquisition of said real property above described.
Said City Attorney is also authorized and directed to obtain a neces-
sary Order of Court granting to said City the right of immediate
occupancy and possession of said property.
SECTION 5. That the City Clerk shall certify to the adoption
of this Resolution and forward copies hereof to the City Attorney.
ADOPTED AND APPROVED this 5th day of November, 1968.
I HEREBY CERTIFY that the foregoing Resolution was duly
adopted by the City Council of the City of Temple City, at a regular
meeting held on the 5th day of November, 1968, by the following vote:
AYES: Councilmen - Harker, Merritt, Tyrell, Briggs
NOES: Councilmen -None
ABSENT: Councilmen - Beckley
