Brewster Town Office Building 1. Present: Chairman Taylor convened the Planning Board meeting at 7:OOPM in the Brewster Town Office Building with members Pierce, McMullen, Bob Bugle, Linda Bugle and Remy present. 2. DISCUSSION WITH MR. JOHNSON RE —WATERSHED MANAGEMENT. Present Carroll Johnson and Jane Johnson. 3. Carroll Johnson — He praised the efforts of the Brewster Planning Board for the Long Pond Landing Subdivision Approval and the protection the board required of the subdivision to protect Long Pond. Requiring the applicant to be 300 ft for edge of water to the property lines with all natural buffer in between. Requiring the septic systems to be even further. Asking the applicant if they would be interested in donating $30,000.00 to the long pond study and the applicant did. 4. Jane Johnson— We work with the Cape Cod Commission. The Commission has tested over 200 ponds, only 8 have been found un-impacted, and two of these are in Brewster, Pine Pond and Slough Pond. Our group tests 26 of the 44 named ponds every two weeks. We are volunteers with the help of grants and money raised we can continue. We are hoping to continue at least for the next 2 years so that we will have 4 years worth of data to study. 5. Carroll Johnson — we are trying to get the Conservation Commission and Board of Health to enact regulations to protect our ponds; not allowing lawn area down to the water, requiring alternative septic systems and even the use of low or no phosphorus items. We are working to create a ban of such material on Cape Cod. 6. Mr. Johnson praised the efforts of the Planning Board in their work to protect our natural resources. 7. Eastward Homes — Request release of lots 3, 4, 5 and 6 from covenant and road inspection- Long Pond Landing Subdivision, Whidah Way on assessor's Map 48 Lot 8. Present Susan Ladue. 8. Ladue - request to release Lots 3, 4, 5 and 6 from the Agreement and Covenant. Lot# 2, will remain the last lot in the Agreement and Covenant until all work required under the Special Permit is completed. 9. The Board did an inspection of Whidah Way. The road does not have a berm on one side, but with pitch of the road, this should not create any drainage problems. The cul-de-sac was not finished and the sign was missing. Ms. Ladue stated that it had been damaged and was being replaced. 10. Motion by McMullen, Pierce second, "release lots 3, 4, 5 and 6, retain lot 2 until required work is done. All voted in favor. 11. Ladue asked that the release for Captains Village be schedule for the end of the meeting she was waiting for the Eastward Companies Attorney to arrive. The Board did not have a problem with this. 12. CONTINUANCE - LEGAL HEARING — DEFINITIVE SUBDIVISION PLAN #DEF2003-18- Doeg, Robert - Located off Buggy Whip Road on Assessors' Map 21, Lot 82-1. - Proposed 6 lot subdivision. Present: John O'Rielly, Mr. Doeg, and Atty. McCormick. 13. The Planning Board reviewed the changes and additions as discussed previously, the signed Agreement and Covenant, The bond for $30,000.00 for repair of possible damage to the existing roads leading to the above subdivision during road construction. The new road will be named"Harrison Hill Road". 14. Motion by Pierce, McMullen second "approve the definitive subdivision plan last revised on November 4, 2003, the signed Agreement and Covenant, also accepted the $30,000.00 bond for repair of possible damage to the existing roads leading to the above subdivision during road construction." The new road will be named "Harrison Hill Road". 5 voted in favor with Remy abstaining. 15. The Chairman announced that anyone wishing to appeal this decision may do so through the courts as soon as the decision is filed with the Town Clerk. 16. Discussion Harold and Phyllis May—regarding an easement, and recognized road for town services. 17. The Mays came before the Planning Board regarding their property on Captain Perry Road. They provided the Board with information regarding a dirt way that runs in front of their property off from the approved portion of Captain Perry Road. Their argument was that this was a road, and town services (i.e. plowing) should be provided. 18. The deed references that they referred to, do not create this as a road recognized by the Planning Board. The Planning Board can recognize roads shown on a plan approved and endorsed in accordance with the rules and regulations governing subdivision of land in Brewster, Massachusetts. The plan of 1982 for the portion of Captain Perry Road that abuts the May property has the required approval and is currently being plowed, according to the DPW. 19. The Board suggested that they ask the Board of Selectmen, to have town services provided for the right of way, from Captain Perry Road that fronts their home. The Planning Board cannot make that decision. 20. Discuss V-B District present: Chief Roy Jones. 21. The Board discussed redistricting the Town of Brewster. This discussion stems from the Open Space Committee trying to purchase the Nevin Property, which consists of 2 acres in the Village Business District, and the lack of support for this purchase from the business community. They object to taking 2 acres out of the VB District for non-commercial use. 22. Jones—replacing the V-B acreage that would be lost in the open Space purchase would gain a lot of support. The town should not lose any of its land with in the V-B or C-H districts. Brewster should be adding to it. He could not support the purchase unless this was done. 23. Jones -The center of town should be redirected to 137 and Underpass Road drawing some of the traffic from 6A and capitalizing on the expanding commercial business at the Harwich end of 137. 24. McMullen and Remy agreed that the V-B and Commercial should be re-looked at for possible expansion by redistricting other areas to allow such uses. 25. Jones—redistricting could relieve some of the Tax burdens of the residents. 26. The Board will continue to have these discussions in the future to consider other areas to promote V-B and C-H Zoning. 27. Remy recused herself and left the meeting. 28. Eastward Homes — Request release of remaining lots 5, 6, 7, 8, 9 and 11 from covenant- Captains Village Subdivision, off Millstone Road on assessor's Map 33 Lot 18-1. Present: Susan Ladue 29. Ladue —Eastward Companies Attorney did not show. We request the release the remaining Lots 5, 6, 7, 8, 9 and 11 from the Agreement and Covenant. Eastward Companies has provided the Board with Attorney's letters stating the land dispute over the above lots had been settled. Eastward Companies is prepared to post a$5,400.00 road maintenance bond 30. The Board did a road inspection and found that the light had not been installed at the entrance to the subdivision. 31. Ladue—would look into it and have the light installed. 32. Motion by Bugle, Pierce second "Approve the above request to release the remaining Lots 5, 6, 7, 8, 9 and 11 from the Agreement and Covenant, accept the $5,400.00 road maintenance bond, they shall install the light.
