RESOLUTION NO. 68 -872
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TEMPLE CITY, CALIFORNIA,
DECLARING ITS INTENTION TO FORM A LIGHT-
ING MAINTENANCE DISTRICT, WHICH DISTRICT
IS TO PAY THE COSTS AND EXPENSES FOR THE
MAINTENANCE AND OPERATION OF A STREET
LIGHTING SYSTEM, INCLUDING LIGHTING
FIXTURES AND APPLIANCES FURNISHED,
INSTALLED AND MAINTAINED, AND ELECTRIC
CURRENT TO BE FURNISHED FOR LIGHTING
SAID FIXTURES.
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA,
DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That the public interest and convenience
require and that it is the intention of the City Council of
the City of Temple City to form a lighting district for the
purpose of consolidating all existing lighting maintenance
districts in the City of Temple City into a single district,
and to order where and as required, improvements as defined
in the Street Lighting Act of 1919, hereinafter referred to,
and the service and maintenance thereof on portions of
streets, avenues, places, circles, parkways, courts, ways,
and drives within said City, all as shown on that certain
diagram and plan designated and identified as "City of
Temple City, California - Temple City Lighting District
'Report' November, 1968 - under the provisions of Division
14, Part 1 of Streets and Highways Code (Street Lighting
Act of 1919) ", prepared by the Engineering Department
of the City of Temple City and on display and available
for examination in the City Clerk's Office, City Hall of
the City of Temple City at 5938 North Kauffman in said City;
said items to be furnished, installed, and maintained, and
electric current to be furnished for lighting such fixtures
and appliances for a period of 20 years from the date of
July 1, 1969. Said Report is hereby referred to and
incorporated herein by reference and made a part hereof as
though set forth in full.
That on November 19, 1968, the City Council of
the City of Temple City ordered the City Engineer to make
and file with the City Clerk in writing a report pursuant
to the provisions of Chapter 3, Division 14, Part 1 of the
Streets and Highways Code (Sections 18,000 and following)
this being the Street Lighting Act of 1919, for the furnish-
ing of electric current and the furnishing, installation
and maintenance of certain lighting fixtures. Said report,
dated November 19, 1968, was duly made by the City Engineer
and filed with the Clerk on November 19, 1968. Said report
is on file -in the office of the City Clerk and is hereby
incorporated herein by reference as though set forth in full.
All of the work and improvement above specified
shall be done in accordance with the specifications and plans
therefor referred to in the said report of the City Engineer.

SECTION 2. That the said contemplated work and improve-
ment, and the maintenance and operation of said lighting
system, in the opinion of the City Council of the City of
Temple City is of more than local or ordinary benefit, and
said City Council hereby makes the expense of said work,
improvement, maintenance, and operation chargeable upon a
district, which district said Council hereby declares to be
the district benefited by said work, improvement, maintenance
and operation and to be assessed to pay the cost and expense
thereof, which district comprises the entire City of the City
of Temple City as the same existed upon the date of
November 19, 1968, and as shown in said Report, on file in
the office of the City Clerk, and on display and available
for examination in the City Hall of the City of Temple City,
on which the extent of the assessment district is indicated,
and the exterior boundaries thereof are described by a
colored boundary line, and to which map diagram and plan
reference is hereby made for a complete and detailed descrip-
tion of said district and zones thereof, excepting from said
district any portion of any public street or alley which may
be included therein. The said diagram, plan, and map so on
file shall govern for all details as to the extent of said
assessment district.
SECTION 3. Any lots or parcels of land known as or
constituting public property, as the same is defined in
Section 18014, Part 1, Division 14, Streets and Highways
Code as amended (Street Lighting Act of 1919), hereinafter
referred to, which are included in the said assessment
district, shall be omitted and exempt from the assessment
to be made to cover the costs and expenses of said con-
templated improvement maintenance, and operation.
SECTION 4. The City Treasurer is hereby ordered to
establish a special fund to be known as the "Street Lighting
Installation, Electric Current and Maintenance Fund "; and
said City Treasurer shall place in said special fund all
monies transferred by the City Council or collected by the
Tax Collector pursuant to the provisions of this Resolution,
as soon as said monies have been transferred to him. Pay-
ments shall be made out of said special fund only for the
purposes provided for in this Resolution. To expedite the
making of this improvement, the City Council may transfer
into said special fund, out of any money in the Traffic
Safety Fund or such other funds as the City Council may
from time to time specify, such sums as it may deem neces-
sary, and the sums so transferred shall be deemed a loan
to such special fund, and shall be repaid out of the
proceeds of the assessment provided for in this Resolution.
SECTION 5. All acts contemplated by this Resolution
of intention shall be done under the provisions of the
"Street Lighting Act of 1919" (now Part 1 of Division 14 of
the Streets and Highways Code of the State of California),
as amended, Section 18,000 and following, and under the
alternative procedure for (tax levied) installment assess-
ments provided for in Chapter 8.5 of said "Street Lighting
Act of 1919 ".

SECTION 6. The City Clerk shall certify to the adoption
of this Resolution.
