ACCEPTING PUBLIC IMPROVEMENTS, RELEASING THE
PERFORMANCE GUARANTEE AND APPROVING A MAINTENANCE
GUARANTEE FOR PUBLIC IMPROVEMENTS AT MANORS OF
LEESBURG SECTION 2
WHEREAS, Rivermead Homes, Inc., the developer of Manors of Leesburg Section 2 have
completed the public improvements, in accordance with approved plans and town standards, and these
have been inspected and approved with the exception of a drainage ditch needed to be installed on the
adjacent property; and
WHEREAS, the town is working with the adjacent property owner and the developer to acquire
the needed easement so the work can be completed; and
WHEREAS, the developer is required to provide a new performance guarantee in the amount
of $30,000.00 to guarantee completion of the drainage ditch.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The corporate surety bond from Seaboard Surety Company in the amount of
$582,640.74 is released, a new security in a form approved by the town attorney for a maintenance
guarantee in the amount of $29,132.04 is approved, and shall be in effect for a period of one year from
this date.
SECTION II. The manager shall execute a new contract for public improvements as approved
by the Director of Engineering and Public Works for the required drainage improvements.
SECTION III. A performance guarantee in the amount of $30,000.00, in a form approved by
the town attorney, is approved to guarantee the completion of the required drainage ditch.
SECTION IV. This release is contingent upon delivery of a properly executed instrument
conveying unto the town all such improvements and easements free of any liens or charges.
