Present: Mayor, Thomas Anderson; Counoilmembers,'Sarah Lutz, Wilfred Scherer, William Reiser, Thomas Crosby; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator, JoEllen Hurr; Public Works Director, Ron Duran; Police Chief, Charles Hoover;. Engineer, Dave Hansing; Attorney, Richard Sohieffer 1. ADDITIONAL AGENDA ITEMS Members agreed to discuss the following additional items: Hazardous Waste study area Cable TV Medina Morningside Water supply Computer service feasibility study 2. MINUTES OF MAY 19, 1981 Thomas Crosby asked that Item 6, page 191 be amended to include an additional condition re- garding a parcel of less than 5 acres,that would be created by a division, would require Blackfoot Tr. to be blacktopped. Also, Gary Lindgren Item, Page 192, should read "deed," not "contract for deed." Motion by Reiser, seconded by Crosby to approve minutes of May 19, 1981, as amended. Motion declared carried 3: PUBLIC WORKS DEPARTMENT Northwestern Bell Telephone Co. Motion by Lutz, seconded by Crosby to adopt Resolution 81-19, allowing Northwestern Bell Telephone Co. to bury cable in the Meadowwoods Farm roads. Motion declared carried Wright -Hennepin Electric Motion by Crosby, seconded by Reiser to adopt Resolution 81-20, allowing Wright -Hennepin Electric to bury electric lines in the Meadowwoods Farm area. Motion declared carried Minnesota Gas Co. Motion by Crosby, seconded by Scherer to adopt Resolution 81-21, allowing Minnegasco to bury gas line in the Medina Morningside area under the condition that they coordinate plans with city engineer. Motion declared carried Wichita -Trail Dave Hansing reported'that a contractor will be hired for $1500 to correct the water run-off problem; That Mr. Layeux will sign a release for the contractor to go onto his property and that permission will be sought from Mr. Green,new owner at 4565 Wichita, to work on his property also. Hamel Sidewalks Dave Hansing reported that it would cost approximately $30,000 to install sidewalks along Sioux Dr. to the railroad tracks. Ron Duran stated that there is a snowhandleing problem and sidewalks would need to be far enough away from the street. Dave Hansing stated that they would -be -meeting with Mrs. Edholm and would try to contact Mr. Neumann. i Medina Morningside Dave Hansing stated that PCA is still reviewing the sewer installation plans. Thomas Anderson reported that Long Lake would like Medina in on the plans for connecting the Medina Morningside water supply to the Long Lake system, at no cost, and they would like to set up a meeting to discuss the matter. American Water Works • Council commended Ron Duran and the Public Works Department on their accident -free record for 1981 according to a letter received from the American Water Works Association. $. James Lutz Fence Discussion of various fence problems that various Medina neighborhoodshave had. • - Thomas Anderson stated that if Mr. Lutz' fence is allowed to remain to close to the road the city may be open to many other requests. Motion by Crosby, seconded by Scherer to adopt Resolution 81-22, calling attention to the fact that Jim Lutz has constructed a fence to close to Brockton Lane right-of-way and the city shall not be held responsible if snow plowing or any type of road machinery should damage the fence. Motion declared carried. Voting No -Anderson, who stated that by approving of the location the city may be subject to other requests. Abstaining -Sarah Lutz Dave Hansing stated that they will be asking a property owner in the Medina Industrial Park to move his fence. 4. POLICE DEPARTMENT Part-time Officer Roskop Chief Hoover stated that Mark Roskop must•have a physical, agility test, psychological evaluation and fire -arms test, within a year. Mayro Anderson called attention to information he had received regarding incidents regarding Mr. Roskop moving his cattle. William Reiser stated that he would be having a meeting with him. Discussion of limiting hours to 14 per week. Chief Hoover stated that if he had to be held to 14 per week no one would be able to take a vacation. 5. PLANNING AND ZONING DEPARTMENT Midland Nursery, Conditional Use Permit JoEllen Hurr reviewed application and recommendations of Planning Commission to allow re- tail sales expansion at 2425 Hwy. 55. She stated that original approval allowed only contract landscaping. She added that driveway and all parking should be blacktopped and theoperation should be reviewed within two years. Dave Hansing stated that basically the property has been improved according to the origr inal plans, that the railroad crossing should be checked for height and the blacktop needs to be repaired; Also, the existing drainfield will be able to handle the addit- ional load. Harvey Foss stated that they have 8+ acres, sufficient for parking and greenhouses and would be moving the temporary greenhouses to the rear of the property. Motion by Crosby, seconded by Lutz to grant a Conditional. Use Permit to Midland Nursery to allow for retail expansion at 2425 Hwy 55., subject to review within 2 years for parking facilities; that greenhou3ses shall be moved and fenced by September 1st. and parking lot and driveway blacktopped by September 1st, with the developer to enter into a development contract with the city.•. Motion declared carried Tom Kellin, Variance JoEllen Hurr reviewed Mr. Kellin's request to use an existing garage as a brooder house for a 4-H project. She reviewed Planning Commission discussion regarding the structure being moved in illegally and a pond being dug without a land alteration permit. She stated that structure is not located the proper distance from the property lines. to meet requirements for animal barns. Motion by. Crosby, seconded by Lutz to deny the set -back variance application of Thomas Kellin to allow a brooder house to remain at 4555 Pioneer Tr. and instructing Mr. Kellin to relocate his structure 150 ft. from all property lines and secure a building permit for the structure. Motion declared carried Parker Products Jim Murdock appeared to request that the small trees that have been planted be allowed to remain and not be replaced by larger trees. He presented a list of additional work that has overrun their budget. He stated that they hayed received a Certificate of Occupancy for the building. Thomas Crosby stated that the city should not have to pay for a developer's inexperience., in dealing with fullfilling terms of a development contract. He suggested that they either comply with the previously approved plan or submit a new plan. Motion by Crosby, seconded by Scherer to table Mr. Mardock's request until a revised land- scape plan has been submitted to the city. Denis Jordan, bivision Mr. Jordan reviewed past history of the development of his property on Chippewa. Rd. thought it had been subdivided properly and asked the council to waived the park dedication fee. JoEllen Hurr stated that plans had been approved for an innovative septic system for the house built on the front 5 acre parcel and a conventional system had been installed. She explained that the owner of the house has said that there are problems with the septic system. • • Thomas Crosby stated that the council would need to make a decision as to whetheror not the property had been divided under 1978 or 1981 standards. Motion by Crosby, seconded by Reiser to waive the Denis Jordan park dedication fee as it is unclear as to what the city had done previously and to deny the division would render the 5 acre parcel to the east unuseable. Motion carried Voting No -Sarah Lutz, Wilfred Scherer John Da JoEllen Hurr reported that Mr. Day's time extension elapsed on May 1st and he is requesting a'further extension. She explained that the building now being shown cover more than 60% of the lot; also the plans that were approved on October 1, 1980 were approved under the old ordinance and if the city is to consider anything new it should comply with the present ordinance. Building Contractor, Vern Isham, stated that the Architect that planned the building planned it to large for the lot and they would reduce the building size so as to comply with the 60-40 hardcover requirement. Motion by Anderson, seconded by Scherer to egtend the starting date of the John Day project with the condition that the size of the building be reduced to meet hardcover requirements and that a drainage plan be submitted indicating how water to the northwest will be handled. Motion declared carried Wdodlake Sanitary Landfill Hydrologist, Bruce Lieseh, presented report covering resistivity test his firm had completed on the Woodlake property, recommending that additional test holes be drilled on the siteas there is enough of an indication that there are unsuitable soils on the property to warrant further exploration. JoEllen Hurr reported that the report would be presented to various agencies and Browning - Ferris at a meeting the following day. Motion by Crosby, seconded by Scherer that City Council agrees with recommendations for the drilling of additional test holes as explained in his report dated May, 1981. Motion declared carried Mr. Lieseh also explained that during the course of their testing they discovered problems with the existing monitoring wells and made suggestions for correction. Motion by Lutz, seconded by Scherer to order corrections be made on existing test wells as listed in the Lieseh report dated June 2, 1981, that will meet with the Minnesota Department of Health Well Code. Motion declared carried Hazardous Waste Study Area Mayor Anderson asked if Council wished to do anything at this time regarding Medina being in a study area for hazardous waste. JoEllen Hurr reported that meetings will be held and information presented to all concerned. Dave Hansing stated that they will be looking for a site with heavy clay soil somewhere in the Metropolitan area. Administrative Handbook Chuck Riesenberg reviewed process and forms that will be used for submittal of various types of development and subdivision plans and asked that Council review and make recommendations so that forms could be printed. )(1)9 6. MONEY MARKET CERTIFICATE ADVANCE Motion by Reiser, seconded by Crosby to authorize the Mayor and Clerk to sign for an advance of $60,000 on an existing Money Market Certidicate which is due and payable on June 22nd. Motion declared carried 7. ANIMAL HUMANE SOCIETY Motion by Scherer, seconded by Reiser to grant a non -intoxicating malt liquor license to Allen Stender for the Animal Humane Society for June 24-28th to be used in.conneetion with a Horse Show at Alpine Stables. Motion declared carried 8. CABLE TV Thomas Anderson presented information on the status of Cable TV for Medina: Adrian Herbst. has been retained as attorney for the group at $60.00 per hour; expenses will be shared equally and no joint powers agreement will be signed. Motion by Crosby, seconded by Reiser to authorize expenditure of up to 300 for costs in the development of Cable TV in view of the fact that only a small portion of the city (Medina Morningside) will be served and to approve of the hiring of Adrian Herbst as legal counsel. Motion declared carried Voting No -Lutz 9. DATA PROCESSING GRANT Motion by Crosby, seconded by Scherer to adopt Resolution 81-23 approving of participation in a grant application for a feasibility study in connection iwth a potential computer program for the city and to authorize Donna Roehl to act as Medina's representative on the small city consortium applying for the grant. Motion declared carried 10. BILLS Motion by Reiser, seconded by Crosby to pay the bills: Order Checks # 9524-9574 in the amount of $50,299.34 and Payroll Checks # 6236-6261 in the amount of $10,218.97. Motion declared carried 11. CLINT EIDE Motion by Crosby, seconded by Reiser to adopt Resolution 81-24, recognizing that Tract C, RLS 1368 owned by Clint Eide is and will be considered a buildable lot.
