TOWN OF BREWSTER MINUTES OF PLANNING BOARD
Tuesday, April 20, 2004 7:00 P.M.
Brewster Town Office Building
1. Present: Chairman Taylor convened the Planning Board meeting at 7:OOPM in the Brewster
Town Office Building with members Henchy, Pierce, Linda Bugle, Bob Bugle, and Remy
present.
2. APPROVAL NOT REQUIRED — ANR2004-14, RAIL TRAIL REALTY
TRUST/POITRAS — Underpass Road, shown on Assessor's Map 26, Lots 103 & 104 —
combining 21ots into one, property located in the CH Zone. Present John O'Rielly.
3. Motion by Henchy, Bob Bugle second, "Approve and endorse ANR Plan". All voted in favor.
4. LEGAL HEARING ROAD NAME CHANGE HEARING

5. Motion by Henchy, Pierce second"approve name change of Olde Owle Pond Road.
6. The petitioner for Toolas Trail, Peter Toolas. Mr. Toolas stated that being owner of property
abutting Buggy Whip Road and with rights of use on Buggy Whip Road dirt part that abuts
the Brewster Conservation Trust Land. Request a name change based on recommendation of
the Fire Chief, Roy Jones. We request that the name of Buggy Whip Road, North end, where
it intersects with whiffletree Ave, be changed to Toolas Trail. Toolas Trail will start at
Whiffletree Ave. and go up Buggy Whip for 763.91 feet. Renaming the road at this end will
eliminate confusion of the Fire Dept.

7. Henchy — that part of Buggy Whip Road is not constructed, it needs to be constructed to
Planning Board standards. There has been some neighbor concerns that this may be to allow
only private access for yourself. Complaints that you have blocked the road in the past and
accused people of trespassing while on the layout.
8. Toolas denied that he had blocked the road, he asked to withdraw the request and will submit
at a later date waivers for road construction in order to build home on lot that's on Buggy
Whip.
9. Motion by Henchy, Pierce second "Deny request for Road name change for Buggy whip". All
voted in favor.
10. PRELIMINARY PLAN APPROVAL — PRELIM2004-13- MAYO- located off Freemans
Way on Assessor's Map 53, Lot 6-1 & partial of Lot 6-2 —creation of a two lot subdivision.
Present: Chester Lay.
11. Lay—No waivers have been requested, the proposal meets all subdivision rules and Regs.
12. Motion by Pierce, Henchy second, " Approve Preliminary Subdivision Plan PRELIM2004-13".
All voted in favor
14. INFORMAL DISCUSSION — MERCHANT — Location A. P. Newcomb Road on Assessors
Map 36 Lot 1. Present Paul Sweetser and Jay Merchant. Remy recused for being a abutter to
abutter.
15. Merchant—would the Board consider the plan that shows 11 lot subdivision for property on A.P.
Newcomb Road with waiver's.
16. The Board reviewed the plan and stated that the applicant needed to address section 290-11 (1) of
the Subdivision Rules and Regs that pertains to Multiple Intersections, prior to any requests of
the Board.
