HomeMy Public PortalAboutResolution 2018-22, Authorizing The Mayor To Accept An Agreement By Which Seth Woods, Accepts Full Responsibility For Beginning Excavation Work Prior To Approval Of Plat And Plans For Woods Estates Of Riverdale Subdivision RESOLUTION NO. 2018-22 A RESOLUTION AUTHORIZING THE MAYOR TO ACCEPT AN AGREEMENT BY WHICH SETH WOODS, WOODS CONSTRUCTION AND DEVELOPMENT INC., ACCEPTS FULL RESPONSIBILITY FOR BEGINNING EXCAVATION WORK PRIOR TO APPROVAL OF PLAT AND PLANS FOR WOODS ESTATES OF RIVERDALE SUBDIVISION WHEREAS, Seth Woods, Seth Woods Construction and Development, Inc. ("Woods"), did by his attorney Michael L Gorsline, Davenport, Iowa, on June 15, 2018 request in writing the consideration of approval by the City Council of the City of Riverdale ("City") to begin excavation and fill work in the proposed subdivision known as Woods Estates of Riverdale prior to the City approving the plat and plans for the aforesaid subdivision; and, WHEREAS, Woods desires to excavate and fill around the areas that include the roadway leading northwesterly from U.S. highway 67 (State Street)to the upper area where the future residential lots will be platted and the stormwater detention areas located in the same general area so as to meet a project deadline of Fall, 2018; and, WHEREAS, at Chapter 102.18 of the Riverdale City Code, entitled"Proof of Compliance for Grading Activity", allows that the City may permit such anticipatory work in a proposed subdivision prior to approval of the plat and plans, contingent upon compliance with all provisions of General Permit#2 and the Storm Water Pollution Prevention Plan(SWPPP) pursuant to the approval of the City Engineer; and, WHEREAS, Woods does state in his request that he is willing to take all risk associated with commencing the excavation and fill work prior to the completion of the aforesaid subdivision plat and plans and the approval of same by the City; and, WHEREAS, with the understanding, in writing, that Woods shall accept all responsibility and meet the requirements of City Code Chapter 102.18,the City Council finds that providing Woods with a start on excavation and fill in the defined areas of the aforesaid subdivision prior to final approval of plat and plans will provide for the earlier possibility of sale of lots and an increase in the City's tax base and related additional revenues, is in the interest of the City. NOW THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF RIVERDALE IN THE STATE OF IOWA: Section 1. That the document prepared by Woods' engineer, J & M Civil Design, Inc, Bettendorf, Iowa, entitled"PLANNED EROSION AND SEDIMENT CONTROL MEASURES", which establishes the approximate area of excavation and fill operations for the aforesaid subdivision, is attached to and hereafter is a part of this resolution. General Permit#2 b. Storm Water Pollution Prevention Plan(SWPPP) c. And other documentation as may be necessary; The City Engineer shall so advise the Mayor, and the Mayor shall accept by his signature Woods' written and signed acceptance of all risks and waiver holding the City harmless, prior to Woods beginning further excavations. Our client has purchased significant amounts of real estate that will be platted into Woods Estates of Riverdale, however,the final platting procedure will take approximately one month to finish. He would like to start development in order to meet his fall deadline for Phase 1 of the subdivision. Our client is requesting that he be allowed to commence dirt work prior to the completion of the plat. There is around 2 months' worth of dirt work to complete,and our client would like to begin now in order to have the road in place before the winter season. Our client is willing to take all risk associated with commencing the dirt work prior to the completion of the plat. Additionally, he has obtained the DNR Storm Water General Permit No. 2 and an Erosion Control Plan from J+M Civil Design, LLC. A copy of both the permit and the plan are enclosed for your reference. ("Developer") and the City of Riverdale ("City"). Woods, the developer and City shall also be referred to as the "parties" in this Agreement. This Release pertains to the development of Woods Estates of Riverdale (the "Subdivision"). WHEREAS, Developer is requesting the City to allow the Developer to begin grading, earthmoving, excavation and fill work in the Subdivision prior to the City approving the plat and plans for the Subdivision("Action"); and WHEREAS,the City Council is considering Resolution No.2018-22("Resolution"),which may allow for said Action by Developer. NOW THEREFORE,in consideration of$1.00 and other good and valuable consideration, Woods and the Developer do hereby agree to defend, indemnify, hold harmless, release, acquit and forever discharge the City and its agents, employees, affiliated entities, successors, heirs, insurers, assigns, and any and all other persons, firms and corporations, from any and all liability, expenses, damages (including, but not limited to, attorneys' fees and expenses), claims, actions, demands,losses,liabilities and causes of action whatsoever, arising out of or relating to Developer's Action in the Subdivision. This Agreement covers all injuries and damages,whether known or not, and which may be hereafter appear or develop arising from or in any way connected with the action. Woods and Developer are executing this Hold Harmless and Indemnification Agreement solely in reliance upon their own knowledge,beliefs,and judgment and not upon any representations made by any party released or others acting on their behalf.
