Brewster Town Office Building 1. Present: Chairman Taylor convened the Planning Board meeting at 7:OOPM in the Brewster Town Office Building with members Henchy, Pierce, Linda Bugle, Bob Bugle, and Remy present. 2. JOINT LEGAL HEARING —PLANNING BOARD, HISTORIC DISTRICT COMMITTEE AND BREWSTER TREE WARDEN - SCENIC ROAD ACT AND PUBLIC SHADE TREE FOR TRIMMING AND/OR REMOVING SELECTED TREES BY NSTAR; TRIMMING IN THE FOLLOWING MARKED AREAS: LOWER ROAD (6A — SWAMP); BREAKWATER ROAD ; STONY BROOK ROAD (6A — PAINES CREEK); GREATFIELDS ROAD (STONY BROOK — ROW CROSSING); TUBMAN ROAD (6A — GRIFFITHS POND ROAD); ROBBINS HILL ROAD AND BRIER LANE. THE TRIMMING TO BE DONE IS TO PROVIDE CLEARANCE FOR ELECTRIC DISTRIBUTION LINES THUS IMPROVING RELIABILITY OF SERVICE AND IMPROVING PUBLIC SAFETY. Present: Paul Sellars,NSTAR; Roy Robinson,HDC and Pat , HDC. 3. After reviewing the proposed work, the Boards asked that when on Lower Road near Breakwater and Tubman Road that they be called for site inspection and review of proposed cutting. Paul Seller's agreed to this. On a Motion by Roy Robinson, Jane Remy second, "approve noting that the Board will be called when on Lower Road and Tubman Road prior to trimming so that the Board may review work to be done at that time, The Boards will review the sites for scope of work and will continue meeting, so that all agree on the scope, continued until June 2, 2004. All voted in favor except Bob Bugle abstained. 4. CONTINUED LEGAL HEARING — DEFINITIVE SUBDIVISION PLAN #MRS2004-12- Red Top Development Inc. — off Satucket Road on Assessors' Map 36 Lot 37 —proposed 7 lot division. Due to not all members being present the applicant requested to be continued to June 2"d, at 7:45PM. The Board agreed. 5. APPROVAL NOT REQUIRED — ANR 2004-16 — Pleasant Bay Nursing Center/Zuckerman— located at Route 39 and Freeman's Way with frontage on both roads, shown on Assessors Map 45, Lots 66, 67, 68 & 69 — combining all four lots and then subdividing into two lots. Present: Atty. Landreth and David Lyttle. Page 1 of 2, minutes of 5-19-04 6. Lyttle—The ANR presented conforms with rules and regs of the the Brewster Planning Board. 7. Landreth — the configuration of these lots are so the septic system can be on the same lot. Also for financial reasons each lot needs to be separate. 8. The Board noted that the parking is running over onto another lot creating a zoning violation. Motion by McMullen, Bob Bugle second, Approve ANR plan, noting that there is a zoning violation.
