Brewster Town Office Building 1. Present: Chairman Taylor convened the Planning Board meeting at 7:OOPM in the Brewster Town Office Building with members Henchy, Pierce, McMullen, Linda Bugle, Bob Bugle, and Remy present. 2. Reorganization—Motion by Pierce, Remy second, Elizabeth Taylor, Chairman. All voted in favor. On a motion by Pierce, McMullen second, Bill Henchy, Vice Chairman, all voted in favor. On a motion by Taylor, McMullen second, Marjorie Pierce Clerk, all voted in favor. 3. CONTINUED LEGAL HEARING—DEFINITIVE SUBDIVISION PLAN #MRS2004-12- Red Top Development Inc.—off Satucket Road on Assessors' Map 36 Lot 37—proposed 7 lot division. 4. Present: John O'Reilly, Bennett & O'Reilly; Paul Shea, Environmental Consultant; Attorney Alec Watt; Robert Armstrong, Owner/applicant; Jim Sturgis, Contractor and Doug Payson, Realtor. About 5 abutters were also present. 5. The applicant and the Board discussed the Agreement and Covenant, expressing concerns that the Forever Wild areas will be left untouched in perpetuity, innovative septic systems, certified energy efficient homes. Atty. Watt agreed to reword the Covenant. Mr. Paul Shea discussed his findings regarding the environmental report and the board was generally satisfied with the report that had been submitted. 6. The Board asked the applicant to provide a topographic plan of the land in relation to the lots and building envelopes and also provide a draft Conservation Restriction. 7. Motion by Henchy, Pierce second "Continue hearing until July 6th, 2004 at 7:30PM". All voted in favor. 8. CONTINUED JOINT LEGAL HEARING—PLANNING BOARD, HISTORIC DISTRICT COMMITTEE AND BREWSTER TREE WARDEN - SCENIC ROAD ACT AND PUBLIC SHADE TREE FOR TRIMMING AND/OR REMOVING SELECTED TREES BY NSTAR; TRIMMING IN THE FOLLOWING MARKED AREAS: LOWER ROAD (6A—SWAMP); BREAKWATER ROAD; TUBMAN ROAD (6A—GRIFFITHS POND ROAD. THE TRIMMING TO BE DONE IS TO PROVIDE CLEARANCE FOR ELECTRIC DISTRIBUTION LINES THUS IMPROVING RELIABILITY OF SERVICE AND IMPROVING PUBLIC SAFETY. Page 1 of 2, Minutes of 6/15/2004 9. The HDC and Planning Board did not have anymore questions regarding the proposal. The proposal was approved. 10.
