HomeMy Public PortalAbout1995_09_12_R181 - Agreement with VDOT for Evergreen Mill Rd and Cardinal Park Turn LanesThe Town of Leesburg, Virginia RESOLUTION NO. 95 -181 ADOPTED September 12, 1995 A RESOLUTION: WHEREAS, the Virginia Department of Transportation (VDOT) Six Year Improvement Program for Fiscal Year 1995 -1996 through 2000 -2001 for urban highways includes an allocation of Regional Surface Transportation funds for construction of two improvement projects in the Town of Leesburg known as right turn lane on Route 621 Evergreen Mills Road at Route 15 and right turn lane on Cardinal Park Drive at Route 7 Leesburg Pike and identified as Projects U000- 253 -V06, C -501 and U000- 253 -V07, C -501, respectively; and WHEREAS, the town and VDOT desire to construct the projects as expeditiously as possible; and WHEREAS, the town entered into an agreement with VDOT for the town to administer and manage the design and bidding phases of the projects; and WHEREAS, the current agreement between the town and VDOT requires execution of an additional agreement between the town and VDOT for administration of the construction contract; and WHEREAS, the town has received Loudoun County Gas Tax funds for the turn lanes which will be used to pay costs for design, easements, and a portion of the construction; and WHEREAS, the proposed agreement has been reviewed by the Deputy Town Attorney; and WHEREAS, administration and management of the turn lane projects by the town will be more efficient since these roads are operated and maintained by the town and the overall scope of the work is uncomplicated. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: The Town Manager is authorized to sign the agreement with VDOT in a form approved by the Deputy Town Attorney for the construction administration and management of the turn lanes at Cardinal Park Drive and Evergreen Mills Road as identified above. 6 PASSED this 12th day of September, 1995. HOLLIS STATE URBAN ENGINEER AGREEMENT BETWEEN THE TOWN OF LEESBURG AND THE VIRGINIA DEPARTMENT OF TRANSPORTATION The Town of Leesburg, Commonwealth of Virginia, hereinafter referred to as LEESBURG, and the Commonwealth of Virginia, Department of Transportation, hereinafter referred to as the DEPARTMENT, hereby agree as follows: 1. The DEPARTMENT approves the plans for a project for the improvement of a right turn lane on Evergreen Mills Road at Route 15 and a project for right turn lane on Cardinal Park Drive at Route 7 and designated as Projects U000- 253 -V06, C -501 and U000- 253 -V07, C -501 and Federal Projects STP -5253 (105) and STP- 5253 (106), respectively. 2. LEESBURG will prosecute the project as designed and requests the DEPARTMENT to submit the project with recommendation that it be approved by the Commonwealth Transportation Board /Federal Highway Administration and agrees that if such project is approved and constructed, LEESBURG, thereafter, at its own expense, will maintain the project, or have it maintained, in a manner satisfactory to the DEPARTMENT or its authorized representatives and will make ample provision each year for such maintenance. 3. LEESBURG agrees that after construction of the project, or any part thereof, it will not permit any reduction in width of traffic lanes, without the prior written approval of the DEPARTMENT. 4. LEESBURG agrees to furnish complete plans, adjust utilities, and furnish all necessary rights of way, all at no expense to the DEPARTMENT. 5. Parking will be prohibited at all times on both sides of this project and appropriate NO PARKING signs shall be erected. The signs shall conform to the standards as shown in the current edition of the Manual on Uniform Traffic Control Devices. 6. LEESBURG agrees that the location, form and character of informational, regulatory and warning signs, curb and pavement or other markings,installed or placed by any public authority, or other agency, shall conform to the standards as shown in the current edition of the Manual on Uniform Traffic Control Devices or be subject to the approval of the DEPARTMENT. -2- 7. LEESBURG agrees that the location and installation of utility poles, lighting standards, traffic signal poles or any other facility installed or placed within the right of way by any public authority, or other agency, shall conform to VDOT Land Use Permit Manual or be subject to the approval of the DEPARTMENT. 8. LEESBURG agrees to comply with Title VI of the Civil Rights Act of 1964 and the Virginia Fair Employment Contracting Act, Section 2.1 -374 through 2.1 -376 of the Code of Virginia (1950), as amended. 9. LEESBURG agrees to comply with all applicable federal, state and local rules, regulations and statutes when work is performed on this project with municipal forces or its agent at project expense. 10. LEESBURG agrees that prison labor will not be used for any purpose whatsoever on this project. -3- 11. LEESBURG agrees to participate in the actual cost of this project in accordance with the following tabulation, understanding that the costs shown are estimated and the basic Federal /State ratio is 80x/20 respectively, and will be applied to actual costs, however, such ratio is subject to the limiting federal /state amount $76.000 PROJECT COST TOTAL FEDERAL /STATE LEESBURG'S ITEM ESTIMATED COST FUNDS SHARE Roadway Construction $47,729.30 (Evergreen Mills Road) Roadway Construction $38,706.35 (Cardinal Park Drive) TOTAL $86,435.65 $76,000.00 $10,435.65 *Maximum amount of STP Regional Funds available for eligible project expenditures (limiting federal /state amount).
