TOWN OF BREWSTER MINUTES OF PLANNING BOARD
Tuesday, September 7, 2004 7:00 P.M.
Brewster Town Office Building
1. Present: Chairman Taylor convened the Planning Board meeting at 7:OOPM in the Brewster Town
Office Building with members Henchy, McMullen, Linda Bugle, Bob Bugle, and Remy present.
2. CONTINUED-REQUEST FULL RELEASE OF COVENANT/ROAD BOND - SUBDIVISION PLAN
#DEF2003-06- Jeffrey Drown, Trustee of Blond Dog Realty Trust - Located off Main Street (Rt.
6A) on Assessors' Map 29,Lot 87.- Proposed 4 lot subdivision. Present: Jeff Drown.
3. Mr. Drown presented the Board with the contractors agreement to absorb the costs of adding some trees
to the subdivision for installing berms under sized, and a check for$1,041.00 for the 2 year road bond.
4. Motion by Henchy, Bugle second, "accept road bond and release all lots". All voted in favor.
5. LEGAL HEARING — SPECIAL PERMIT #SP2004-20 — CORRIDOR OVERLAY
PROTECTION DISTRICT BYLAW — Smith - Located at 282 Underpass Road, on Assessors'
Map 26, Lot 104-1 — Proposed change of previously used office/retail space, to become restaurant
use and increase parking to 22 spaces and 5 spaces to be on adjacent parcel 104-4.
6. Smith — The agreement with the next door neighbor is for 5 parking spaces. The proposed on-site
parking is for 22 spaces at the 10 x 20 in size. This will increase the existing parking by 4 spaces. A total
of 27 parking spaces meet the requirements for 81 seats.
7. The Board agreed with the concept, and requested a new site plan to show all the parking in relation to
the site.
8. On a Motion by Bob Bugle, Remy second, "Approve writing of the draft Special Permit, based on
receipt of a new site plan for showing 81 seats. Hearing to be continued until September 21, 2004 for
final review. All voted in favor.
9. LEGAL HEARING— CORRIDOR OVERLAY PPROTECTION DISTRICT SPECIAL PERMIT
- SP2004-24- Rail Trail Realty Trust — 302 Underpass Road, on Assessors' Map 26 Lots 104-3 &
104-4 —proposed to construct an addition (704 SF) with porch to expand retail use.

11. Prior to the hearing, the Board had requested written comments concerning the application from the Board
of Health, the Department of Public Works, Water Department, the Police and Fire Departments, the
Conservation Commission and the Building Commissioner. The following comments were on file and read
by the Chairman:
B.O.H.- 8/25/04 septic system needs to be inspected.
FIRE—No problems with information provided.
H.D.C.—No Concerns
DPW- Has no concerns in this matter.
12. Chairman Taylor opened the hearing at 8:15PM by reading the legal advertisement and making the
applicant and parties in interest aware of their rights to appeal as required under Chapter 40A, Section 17.
She stated that during the hearing any member of the Board or interested party may direct questions through
the Chairman to a speaker relating to the proposal. She asked the applicant to make his presentation.
13. Present: John O'Reilly, Daniel Poitras, Charlie Miller(Contractor)and David Smith.
14. O'Reilly — the property is currently being used as a bicycle retail/rental store along with a sandwich
shop. The existing building with the proposed addition is about 3,162 SF and is split into 2,400SF retail
(bike shop) and 762SF restaurant (sandwich shop) use. The proposal is to construct a 704SF addition so
as to expand the bike shop space and to provide additional display area and storage. Also, it will remove
the need for the existing storage trailers that are currently on-site.
15. O'Reilly — the existing building location, limits the property's ability to comply with all the
requirements of the Corridor Overlay District By-law. The proposed addition is located so as not to
encroach further towards Underpass Road than the present building.
16. O'Reilly — a total of 39 parking spaces are provided, 16 spaces are required for the current use and
proposed addition. The additional spaces provided above the required number, will offset seasonal bike
use and provide parking for abutting uses by the restaurant to the north. Five spaces have been assigned
to the abutting property. They are located at the common lot line.
17. Board members asked that the front island be kept vegetated at least 3 ft high to screen the parking lot
and that the trash receptacle be screened as well with stockade fence. The applicant agreed.
18. The Board agreed with the concept that the new site plan will show the screening as requested.
19. On a Motion by Bob Bugle, Remy second, "Approve writing of the draft Special Permit, based on
receipt of a new site plan. Hearing to be continued until September 21, 2004 for final review. All voted
in favor.
20. CONTINUED LEGAL HEARING—DEFINITIVE SUBDIVISION PLAN#MRS2004-23-Boston
Development Collaborative, Inc.—off Crowell's Bog Road on Assessors' Map 49 Lot 8—proposed
14 lot division.

21. Due to all members not being preset, meeting was continued as requested by applicant to September 21,
2005.
22. Approval Not Required ANR2004-2004-26 - Orbe — 20 Long Pond Road, Iocated on accessors'
Map 24 Parcel 19—Alter lot lines on the previously approved ANR2004-22.
23. Applicant ask to continue, noting a need to clarify a possible issue with the zoning agent, Motion by
Bugle, Henchy second, "Continue to Sept. 21, 2005". All voted in favor.
