Brewster Town Office Building l. Present: Chairman Taylor convened the Planning Board meeting at 7:OOPM in the Brewster Town Office Building with members Henchy, Pierce, McMullen, and Remy present. 2. Taylor opened the Legal Hearing to discuss the following proposed Zoning By-law changes for the Fall Town Meeting scheduled for November 15, 2004. AMENDMENT TO ZONING BYLAW/PARKING LOT,COMMERCIAL AND AUXILIARY ARTICLE NO. 16. To see if the Town will vote to amend the Code of the Town of Brewster, Massachusetts by amending chapter 179, Section 2.(b). to include the following new definition placed in alphabetical order: Parking Facility, Commercial and Auxiliary—A lot or a group of lots or a structure, whose purpose is to provide vehicular parking for six or more vehicles. The lot or group of lots or structure may be used to provide parking for an adjacent building or business establishment or athletic facility or any other type facility enumerated in Section 179-22.A, Table 4. The area(s) on a lot whose principal use is not as a parking lot but as a facility for which parking must be provided under the requirements of Section 179-22 of the Code of the Town of Brewster shall not be considered as a"Parking Facility". Parking facilities shall not be established in residential zones. 3. Motion by Henchy, McMullen second "change reference in article 16 "Parking Facility, Commercial and Auxiliary"to Commercial Parking Lot or Structure, recommend for Town Meeting."All voted in favor. Page 1 of 3,minutes of 10-5-2004 AMENDMENT TO ZONING BYLAW/RETAIL AND SERVICES ARTICLE NO. 17. To see if the Town will vote to amend the Code of the Town of Brewster,Massachusetts by amending Chapter 179-11(B.), Table 1,Use Regulations,to delete under Retail and Services the line designated: "22. Commercial parking Lot or Structure"in its entirety and insert in its place the following new language in a new Paragraph 22. as follows: R-R R-L R-M C-H V-B I MRD CT 22. Motion by Henchy, McMullen second"change reference in article 17 "Parking Facility"to Commercial Parking Lot or Structure, recommend for Town Meeting."All voted in favor. AMENDMENT TO ZONING BYLAW/PARKING AND LOADING REQUIREMENT TABLES ARTICLE NO. 18. To see if the Town will vote to amend the Code of the Town of Brewster, Massachusetts by amending Chapter 179-22. By adding a new paragraph under Parking and Loading Requirements Tables as follows: A. (1) Establishment of one or more Parking Facilities as defined in Section 179-2.(b.) shall be construed as a change of use under the Corridor Overlay Protective District Bylaw Section Special Permits Uses, Section 179-66.(B.)(1)a. and shall be allowed only if granted a special permit under the procedures of Section 179-66 and 179-67. The requirements of Section 179-23 shall apply, except the SPGA may for good reason, reflected in the record, allow a permeable surface. 5. Motion by Henchy, McMullen second"change reference in article 18 "Parking Facilities"to "Commercial Parking Lot or Structure", recommend for Town Meeting."All voted in favor. AMENDMENT TO ZONING BYLAW/HEIGHT ARTICLE NO. 19: To see if the Town will vote to amend the code of the Town of Brewster, Massachusetts by amending Chapter 179, Section 2.(b). to delete the current language of"Height" and to insert new language: Delete as currently written: HEIGHT--The vertical distance from the mean level of the adjacent ground to the top of the structure, measured at the highest roof beams of a flat roof or the highest gable or slope of a hip roof. And insert the following new Language: Page 2 of 3,minutes of 10-5-2004 HEIGHT—The vertical distance from the highest point of the roof to the average of the mean ground level existing grade of all sides of the building, such measurement to be based o the elevation of the lot in its natural state prior to construction, grading or filling. 6. Motion by Henchy, McMullen second"recommend article 19 "Height"for Town Meeting." All voted in favor.
