The Commission upheld the recommendation of the Planning Board and, consistent with Section 66 -154 Paragraph 4 of the Town Code of Ordinances in that the portion submitted does not deprive the applicant of rights commonly enjoyed by other properties in the same zoning district, they denied the variance as they felt there is no undue hardship on the applicant to justify the variance. The Level 3 Architectural /Site Plan Review was also denied in that the variance request had been denied. With regard to the recommendation from the ARPB that consideration be given to the possibility of a future code change in relation to controlling the size of boats and lifts, the Commissioners agreed that this should be considered at such time as there are other code changes under study, recognizing that a code change has just taken place. Van Dinter Agent: N/A Approval Requested: Architectural /Site Plan Review, Level III Variances: Variance from provisions requiring that boat lifts which exceed 500 pounds lifting capacity be attached only to seawalls or platforms landward of the seawall. The Van Dinters would like to install a 25,000 -pound capacity lift supported by 8 pilings. Zoning District: RS -P Proposed Height of lift: not provided Adjacent Residences: Adjacent to north is a vacant lot, to the west is the "other various style" home, to the west is a one -story G.S. Bermuda home. Potential Issues Considered during Review: Impact on water views; mandatory variance criteria Recommendation: That the application be postponed for one month to allow the applicant to bring back a boatlift design that has a smaller boat - weight capacity and is less massive in scale (for example, a four post rather than an eight post design). Variance If the Commission Approves the variance, the following conditions are recommended: 1. Prior to application for a building permit to construct the lift, a restrictive covenant shall be filed imposing the following restrictions on the use of the lift: a. No boat over 32 feet in length (as measured according to U.S. Coastguard standards) shall be stored on the lift. b. No boat exceeding 11' in vertical clearance shall be stored on the lift. Height is to be measured from waterline to the highest point on the boat, including installed canvas or Bimini tops, but excluding antenna. 2. The boatlift shall be setback a minimum of 35 feet from the north side property line. 3. The boatlift shall have a maximum lifting capacity of 15,000 pounds and shall be supported by only four wooden pilings. No top -beam members (cross members at the waterline are acceptable) and no concrete supporting posts shall be installed. 4. Prior to application for a building permit the applicant shall bring back for Planning Board approval a site plan and boatlift specifications demonstrating compliance with the above conditions. Level III Architectural /Site Plan Review Motion to defer consideration of the Level III Architectural /Site Plan Review, until the applicant demonstrates compliance with conditions #2 , #3 and #4 above. Basis for Recommendation: There are two perspectives to be considered relative to this variance request, as follows: 1) The current code provisions are designed to ensure that simplicity and aesthetics are maintained, water views are not diminished and that the waterway remains free of numerous structures. As an example, the placement of a 32 -foot boat with flybridge and canvas top on a lift could be ARPB # 000 -01, Page 1 approximately 18 -19 feet tall. This is equivalent to the height of a one -story home and could have an impact on the neighboring properties' views as well as the aesthetics of the watwerway. 2) On the other hand, this property is located directly on the Intracoastal Waterway in an area that is not designated as a "No Wake Zone." This particular property is different from the other dual frontage" point" lots in Place Au Soleil in that it has only nominal arc - shaped frontage on the canal. As such it is not possible keep a sizeable boat in the water at this location. Davits and boatlifts attached to the seawall generally do not allow the lifting capacity necessary for a larger boat without risking damage to the seawall. It may be reasonable to consider this a hardship in a waterfront community. In total there are 11 other lots in Gulf Stream that have frontage on the ICWW without alternate docking options on a canal or cove. If the variance is granted, the board's findings should make clear the specific circumstances that justified the variance. Additionally, in order to approve this variance, the Board must find each of the eight mandatory variance findings (attached). The Van Dinters' justification is also attached. The Place Au Soleil Homeowners is scheduled to review this proposed lift at its February 8" meeting. Requirements to be met prior to Building Permit Application: 1. Filing of a restrictive covenant. ARPB Date: February 24, 2000 ARPB Recommendations: 1. Recommend Denial of the variance due to the applicant's refusal of the restrictive covenant conditions, Vote: 5-0 2. A second motion was made to recommend that the Commission look into the possibility of a future code change regarding the size of boats and boat lifts, Vote: 5 -0. 3. All concrete pilings will be wrapped with wood to present ascetic appeal and finished look. The eight pilings will enable this lift to eliminate the cross member (as seen on other lifts), again for a more ascetic appeal. IV.G.4. What is the total variance requested? The "circumstance which is peculiar" is the land area available on direct intracoastal waterway with seawall footage to provide new improvement to our property, which would not interfere with the use or activity or ascetics of our neighbors. Being located on the intracoastal waterway with no "no wake zone" makes this a "peculiar" and problamatic situation, or circumstance for dockage of a water vessel. The cradle boat lift would provide protection for a vessel. Dockage and vessel protection, other conditions or circumstances which would be "peculiar" for other properties in this community would be diversified and different consideration required in each case. A violation of any condition of approval granted pursuant to this division shall be considered a violation of this Code and shall be rectified prior to any public hearing or meeting on the issuance of any subsequent development order or permit. Unless otherwise specified in the final approval, an approved use must comply with all conditions prior to implementing the approval. (Ord. No. 95 -1, § 2, 1- 30 -95) Sec. 66 -147. Misrepresentation. If there is evidence that an application for an architectural/site plan review was considered wherein there was misrepresentation, fraud, de- ceit, or a deliberate error of omission, the town shall initiate a rehearing to reconsider the appli- cation. The town shall re- approve, approve with new conditions, or deny the application at the rehearing based on the standards in this division. If evidence of misrepresentation or neglect is discovered during the application review and ap- proval process, the application shall be decertified and remanded to sufficiency review. (Ord. No. 95 -1, § 2, 1- 30 -95) Sec. 66 -148. Revisions to approved plans Applications for revisions to plans approved pursuant to this Article shall be processed and ZONING § 66 -152 reviewed in accordance with the magnitude of the revision. The revision application shall be pro- cessed and reviewed in the same manner as if the revision were a separate project except in those instances where the revision materially alters the approved plans or is inconsistent with a specific condition of approval. In these instances, the revision application shall be processed and re- viewed in the same manner as was used to process and review the original application. (Ord. No. 95 -1, § 2, 1- 30 -95) Sec. 66 -149. Reserved. DIVISION 3. VARIANCE Sec. 66 -150. Purpose and intent. This division sets forth procedures and stan- dards for the appropriate review authorities to review and approve, approve with conditions, or deny applications for variances. Variances are deviations from the terms of this Code that would not be contrary to the public interest when owing to special circumstances or conditions, or when the literal enforcement of the provisions of this Code would result in undue and unnecessary hardship. (Ord. No. 95 -1, § 2, 1- 30 -95) Sec. 66 -151. Applicability. Pursuant to the provisions of this division, variances may be granted to any land develop- ment regulation contained in this Code provided that the regulation pertains only to the location or physical attributes of a structure or improvement. In no case shall a variance be granted which is counter to any stated purpose or intent of this Code or which would permit something that is expressly prohibited. (Ord. (2) The special conditions and circumstances do not result from the actions of the applicant. (3) Granting the variance requested will not confer on the applicant any special privi- lege that is denied by this Code to other lands, buildings, or structures in the same zoning district. (4) Literal interpretation of the provisions of this Code would deprive the applicant of rights commonly enjoyed by other proper- ties in the same zoning district under the CD66:42 ture. The planning and building administrator shall receive, review and process applications for vari- ances in accordance with the following: (1) Mandatory simultaneous processing with related development permit applications. In those instances where a project re- quires approval of a variance in addition to approval of other development permits, the application for a variance shall be processed simultaneously with the appli- cations for the other required develop- ment permits. (7) Granting the variance is consistent with the goals, objectives and policies and fu- ture land use map of the adopted compre- hensive plan. (8) Granting the variance will be in harmony with the general intent and purpose of this Code and that such variance will not be injurious to the area involved or other- wise detrimental to the public welfare. (Ord. No. 95 -1, § 2, 1- 30 -95) Sec. 66 -155. Procedures for submitting and Processing applications. The planning and building administrator shall receive, review and process applications for vari- ances in accordance with the following: (1) Mandatory simultaneous processing with related development permit applications. In those instances where a project re- quires approval of a variance in addition to approval of other development permits, the application for a variance shall be processed simultaneously with the appli- cations for the other required develop- ment permits. In the event the applica- tion procedures and requirements of this section conflict with those required for other development permits processed si- multaneously, the more stringent provi- sions shall prevail. (2) Mandatory pre - application conference. At least 15 days prior to submitting an ap- plication, the applicant shall arrange for and attend a pre - application conference with staff members of the planning and building department to review the pro- posed project, applicable codes and regu- lations, and application procedures. (3) Deadlines. The town commission shall approve a schedule of application dead- lines provided, however, that applications shall be submitted at least 30 days prior to the architectural review and planning Sec. 66 -369. Docks. In the single - family residential district, one dock per lot of record shell be permitted in accor- dance with the following: (1) Site plan review required. All new docks and significant alterations to existing docks shall require site plan review and ap- proval. (2) Permitted as accessory use. Docks shall be Permitted only as an accessory use to single - family dwellings for the exclusive use of the dwellings occupants (residents and nonresident members ofthe occupant's family and resident guests at the dwell- ing). Docks shall not be permitted on vacant lots unless the vacant lot is adja- cent to a developed lot under the same ownership and a unity of title has been recorded. (3) Prohibited uses_ Dockage of commercial vessels or rental of dock space exclusive of the dwelling and property shall be prohib- ited. (4) Docking parallel to seawall only. Docking of vessels shall be permitted in a manner so that the vessel is docked parallel to the seawall. Docking in any other manner is prohibited. (5) Ancillary structures permitted Ancillary structures including handrails, steps, swim ladders and up to a maximum of four dolphins, one boat lift and one davit (ar alternatively three davits), two water hook- up, two electrical outlets in excess of 115 volts, two lights, and one dock box shall be permitted in accordance with the provi- sions of this chapter. Boathouses, floating docks, Seed covers, fixed benches, fixed fish- cleaning apparatus, fixed mainte- nance apparatus, fuel pumps, sewage pump -outs, flagpoles and diving platforms/ boards shall be prohibited. h' (6) Location and dimensions. a. Docks and all ancillary structures shall comply with the required side yard setbacks applicable to the lot. b. Docks shall not project more than five feet into any waterway and dol• phins shall not project more than 25 feet into any waterway_ C. Docks shall be no ihigher than any abutting seawall or 5Y2. feet above mean sea level, whichever is greater. Ancillary handrails, steps and lights shall not project more than four feet above the dock. d. A maximum of one dock box shall be permitted which shall be no higher than 30 inches and no larger than 24 cubic feet_ e. ( ) Except as in paragraphs (a)(2) through (a)(5) of this section, the gro s tonnage of a vessel designed for sailing is one -half of the product f its overall length, overall breadth, and overall depth (LBD) divi ed by one hundred (i.e., 0.50 LBD /100), and the gross tonnage of a vesse not designed for sailing is 0.67 LBD /100. (2) The gross tonnag of a vessel with a hull that approximates in shape a rectangular georr tric solid (barge- shape) is 0.84 LBD /100. (3) The gross tonnag of a multi -hull vessel is the sum of all the hulls as calculated unde this section. (4) If the volume of the principal deck structure of a vessel is as large as, or larger than the volume of the vessel's hull, the volume of the principal deck struc ure in tons of 100 cubic feet is added to the tonnage of the hull to e tablish the vessel's gross tonnage.
