As I mentioned, the Town of Gulf Stream has, in the course of the litigation pending in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County captioned O'Boyle v. Town of Gulf Stream, Case No. 2014CA004474XXXXMB AG, received a request to produce documents that may be in the possession, custody and control of the City of Delray Beach. Specifically, the Town has received a request for "(a]ny transcripts or recordings of any communications made by members or employees of the Gulf Stream Police Department and third parties regarding the removal of political or campaign signage on March [3] and 4, 2014." I understand that pursuant to its regular schedule the City of Delray Beach destroys records of radio communications after 90 days and, therefore, write to you in order to facilitate the preservation and production of these records. Please allow this letter to request that you immediately remove from any document destruction schedule, preserve and maintain (or forward to me on behalf of the Town) the following: • any recordings of radio communications of the Town of Gulf Stream Police Department for March 3 and 4, 2014.
