Glenn Clerk Treasurer Greencastle Common Council Minutes Special Session Thursday, April 26, 2007 6:30 P.M. Greencastle City Hall Call to Order: Roll Call A. Mayor Michael called the meeting to order at 6:34 PM B. Roll Call: Present: John Lanie, Mark Hammer, Bob Sedlack, and Russ Evans. Absent: Tom Roach Resolution 2007 -6, A Resolution Authorizing Additional Appropriations to the Annual Budget A. Upon motion by John Lanie to accept resolution as presented and read by Mayor Michael with a second by Mark Hammer, this resolution was unanimously approved. 6:38 PM III. Resolution 2007 -7, A Resolution Authorizing A Temporary Loan For The City Of Greencastle General Fund A. Mayor Michael read this resolution. Discussion. Motion by Russ Evans, second by Bob Sedlack, unanimous approval. 6:43 PM IV. Resolution 2007 -8, A Resolution Creating A Water Leak Policy A. Mayor Michael read this resolution. Motion by Bob Sedlack to approve as presented, second by Mark Hammer, unanimous approval. 6:50 PM V. Ordinance 2007 -3, Ordinance Prohibiting Smoking in Public Places and Places of Employment A. Tabled from April 10, 2007 Regular Meeting 1. Motion by Russ Evans, second by Bob Sedlack to remove from tabled status, unanimous approval. 2. Mayor Michael reviewed ordinance with changes that have been made since first reading. After Mayor Michael reviewed the changes to this ordinance the Council was invited to make comments after which the audience made comments. 3. Bob Sedlack began with comments regarding the serious health issue smoking is and the history of this ordinance with this council. Councilor Sedlack continued with comments regarding area outside of entrance to buildings and private clubs being included in this ordinance. Russ Evans ® asked for a moratorium on revisiting this Resolution issue for a period of time. After discussion with Attorney it was decided this would be ineffective. John Lanie pleased with addition of appeal process. Pagel of 3 Suggested adding to the Ordinance distance from entrance to be smoke free 25 feet from public /main entrance. Discussion. Mark Hammer • shared his comments. His main issue is fairness and consistency for all citizens in our community. He continued with comments regarding his understanding both sides and the issue of government intrusion. Wishes that council had never opened the door for any exemptions. Motion by Mark Hammer to amend Ordinance 2007 -3 regarding exemption and treatment of private clubs under section 3,(1) remove bold letters; strike item (d) in section 5, second by Bob Sedlack, vote: 3 ayes, 1 nay Russ Evans, motion carried. Motion by John Lanie to amend Ordinance 2007- 3 adding language prohibiting smoking within 25 feet of main, public entrance of enclosed area where smoking is prohibited by this Ordinance, second by Mark Hammer, discussion. John Lanie withdrew his motion for this change, second by Mark Hammer. Motion by Mark Hammer to amend Ordinance 2007 -3 under Section 3 adding to item (h) "except where required by law ", second by John Lanie, unanimous approval. 4. Mayor Michael opened the discussion up for public comments and discussion at 7:55 PM. a. Alan Hammond representing Moore's Bar. Opposed to government control. b. Carolyn Hammond representing Moore's Bar. Co -owner of Moore's Bar. Opposed to government regulating social behavior. Freedom of Religion, Choice and Speech. • c. Bill Fulford shared his personal thoughts. Suggested private clubs and bars add smoke eaters to their establishments and adding this to the ordinance. d. Leslie Hanson shared her thoughts in support of this Ordinance. e. Dave Newgent shared his thoughts supporting this Ordinance. f. Carolyn Miller co -owner of Putnam Inn shared her opposition to this Ordinance and the effect this will have on her business. g. Dr. Heavin, Health Officer shared his comments regarding this Ordinance and his support of this Ordinance. h. Ann Newton 51 year resident of Greencastle shared article regarding air conditioning and heating and ineffectiveness of air handling systems filtering smoke from restaurants and other businesses. i. Meredith Williams, Putnam County Smoking Cessation, thanked Council for their efforts on this Ordinance and the importance of the serious health issue this is for our community. j. Gail Smith local business owner of Almost Home and operator of Final Approach Bistro, non - smoking establishments. Supports a county wide Ordinance. 5. Mayor Michael turned the meeting back over to Council for comments. 6. Bob Sedlack moved for an effective date of September 1, 2007, second by Mark Hammer, unanimous approval. is Page 2 of 3 7. Bob Sedlack moved for approval of Ordinance 2007 -3 as amended ® above, second by Mark Hammer, discussion, unanimous approval on first reading. B. Reminder to Council of Rokicki Scholarship fund at Putnam County Foundation. VI. Adjournment A.
