A RESOLUTION: PRESENTED January 16, 1996 96-13 ADOPTED January 16~ 1996 AUTHORIZING AN EASEMENT FOR CABLEVISION OF LOUDOUN ON THE VINEGAR HILL PARKING LOT PROPERTY WHEREAS, Cablevision of Loudoun has requested an easement for underground cable television facilities on the land owned by the Town of Leesburg at the Vinegar Hill Parking Lot to provide cable television service to the Loudoun County Complex at 5 Harrison Street; and WHEREAS, the easement agreement has been submitted to the Deputy Town Attorney and the easement plat has been submitted to the Director of Engineering and Public Works for review. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: The Mayor is authorized to sign the easement agreement for the easement requested by the Cablevision of Loudoun on the Vinegar Hill Parking Lot Property. The easement agreement shall be in a form approved by the Deputy Town Attorney, and the easement plat shall be as approved by the Director of Engineering and Public Works. Clem, Mayor Town of Leesburg ATTEST: Clerk of Council r:cablevision EASEMENT AGREEMENT FOR CABLE TELEVISION KNOW ALL MEN BY THESE PRESENTS, that the undersigned GtLANTOR for and in consideration of the sum of ONE AND NO/100 DOLLAR ($1.00) paid by the GRA2,~TEE, CABLEVISION OF LOUDO~. (hereinafter referred to as CL), and other good and valuable consideration, the receipt and sufficiency of which is hereby." acknowledged, does hereby grant and convey to said CL, its successors and assigns, a Permanent Easement to maintain and/or replace cable TV transmission lines, and/or pedestals necessary in connection therewith on and under the following described land situated in the County of Loudoun, City of L~g~.~¢- ; Virginia: (See EXHIBIT "A" attached hereto and made a part hereof.) In connection with the aforesaid easement CL shall have full right of access thereto at reasonable times and upon reasonable notice, for all purposes for which said easement is hereby granted. CL agrees to install cable TV transmission line within said easement so as to only disturb Grantor's property to a minimum and agrees to remair at CL's sole expense any damage to Grantor's property caused by the installation of said lines. Said lines, pedestals and equipment are to remain the sole property of CL. This Easement Agreement shall be binding upon both parties hereto, their heirs, assigns and successors in interest. All references to CL herein shall include all duly authorized agents and/or employees of CL.
