Members present: Mayor, Thomas Anderson; .Councilmembers, Sarah Lutz, William Reiser, Thomas Crosby; Clerk -Treasurer, Donna Roehl; Police Chief, Charles Hoover; Public. Works Director, Bon Duran; Building Inspector, Loren Kohnen; Engiine��er, Lyle Swanson; Attorney, Richard Schieffers Plan - Members absent: ian y Onn" ai Administrator, JoEllen Burr. Mayor Anderson'asked if Councilmembers wished to discuss the following items not on the agenda: Hwy. 55 and Co. Rd. 116 Intersection Committee for Police negotiations Hamel Rd. repairs Zoning Ordinance Correction of Charles Pangiers Special Assessments Members agreed to discuss the items. 1.� MINUTES OF MAY 20, 1980 Motion by Crosby, seconded by Reiser to approve the minutes of May 20, 1980, as presented. Motion declared carried 2. PUBLIC WORKS DEPARTMENT Independence Beach Lift Station Lyle Swanson reported that they were waiting for Mr. Ostlund to sign and return the ease- ment agreement. Seal Coating Lyle Swanson reported that not all of the Independence Beaoli streets are eligible for State - Aid funding; that it would cost about $10,00Q to seal -coat all of the streets with about $5,000 of that amount fundable. He suggested that some overlay work be done'on Willow Dr. that would also cost about $10,000, which could be paid for out of County -State Aid funds. Motion by Crosby, seconded by Reiser to authorize the preparation of Plans and Specifi- cations for sealcoating the Independence Beach streets and overlaying Willow Dr. Motion declared carried Hamel Rd. William Reiser explained that residents in one area of Hamel Rd. had asked that the road be patched and not dug up and graveled. Rita Jubert, 1355 Hamel Rd., stated that there is about one mile of road that they would like patched as they believed that their property would be downgraded if it.were graveled. Lyle Swanson was asked to look into the possiblity of patching and report at the June 17th meeting. Arrowhead Rd. Ron Duran explained that Steve Muth would like to know when Arrowhead Rd. would be upgraded. He stated that some road material had been hauled but that more work was needed. Council agreed to discuss further work for 1981, when budget is prepared. 3. HIGHWAY 55 AND COUNTY ROAD 116 Mayor Anderson reported on the meeting that had been held at Medina Recreations regarding the intersection upgrading. He said that the majority of the property owners do not want stop lights, nor islands, but are concerned with speed in that area. He reported that Hennepin County had attempted to survey for a service road but had met with opposition from property owners and had stopped the surveying work. He stated that several alternatives had beendiscussed and that the Department of Trans- portation has said that Medina should either reject the project entirely, accept it with a service road provded that property owners sign statements that surveying work can be continued, or accep the project without a service road. Peggy Rasmussen asked if the city could install the semaphore on its own and assess costs to property owners. Lyle Swanson estimated the cost of the semaphore to be about $80,000. Thomas Crosby explained that some property owners might argue that they should not be assessed as they were not benefiting from the project. Wallace Doerr discussed the ditch situation west of the intersection and the fact that some alterations should be made in that area. Motion by Crosby, seconded by Reiser to request that the engineer review all of the alter- natives and contact the Soo Line railroad with regards to the possibility of obtaining an easement. Motion declared carried 4. HAUL SIDEWALKS Lyle Swanson explained that the cost of sidewalk construction would be approximately $30,000 assessed at about $13.00 per running foot, over a 10 year period. •Marilyn Fortin explained. that the Chamber of Commerce would be holding. a meeting in Hamel to explain the project. 5. POLICE DEPARTMENT Motorbike Licensing Thomas Anderson explained that the purpose of the licensing program was to enable anyone to identifybikes that were driving carelessly, trespassing, etc. Chief Hoover reported that the prioe of a 3" x 5" plate was $2.45 each and if ordered in pairs price was $1.65 each. Barney Glaefke suggested using the same type of numbers that Moto -cross race bikes use that have 4" numbers. The cost of the plates is $8.00 for 2 plates plus $.35 for each number. Richard Schaeffer stated that a resolution setting forth charges for the license could be acted upon at the June 17th meeting. Motion by Reiser, seconded by Crosby to adopt Ordinance 195, licensing of recreational vehicles. Motion declared carried Power Boat Race Barney Glaefke appeared to request permission for the Minnesota Power Boat Racing Assoc- iation to hold races on Lake Independence September 7th. He explained their plans for spectators, First Aid and that the Water Patrol had worked with them on the design of the course and that the Park Reserve had given its approval. Motion by Reiser, seconded by Crosby to agree to the fact that the city has no - objection to the Power Boat Racing Association holding races at Lake Independence on September 7, 1980. Motion declared carried Police Negotiations Thomas Anderson reported that a flat fee of $1500 for work on the 1981 contract. Thomas Crosby suggested that the city explore the rather than a flat fee. William Reiser and Thomas Crosby agreed to serve agreed to serve as an alternate. would be charged by. the cities negotiator possibility of paying an hourly rate as city representatives. Sarah Lutz Radar Units Police Chief Hoover reported that he had placed a bid of $500 for 2 radar units being offered by the State of Minnesota, He also explained, that there is sufficent funds in the budget for the units. 6. 1979 AUDIT Mark Babcock answered questions concerning the 1979 Audit Report. He explained that the City had recouped $20,600 of the General Fund accumulated deficit. He reported that it is typical of many cities not to allow for depreciation of equipment in the sewer and water facilities. He explained that they would be testing a data processing system and would like to work with Medina, at no cost, for a one year period. Thomas Anderson requested that a meeting be scheduled with the Auditor to discuss improvement of the budgeting process. Motion by Crosby, seconded by Reiser to accept the 1979 Audit report as prepared by Hanson and Babcock and to comply with their listed recommendations. Motion declared carried 7. MEADOWWOODS PLAT Discussion of the list of conditions of approval of Meadowwoods plat that had been pre- pared by City Attorney and JoEllen Hurr. Mayor Anderson asked whose responsibility it would be to pay for paving Cherokee Rd. Richard Schaeffer explained that the developer would need to work with the abutting pro- perty owners. Thomas Anderson asked if other conditions should be listed. Attorney Schieffer explained that at the time of final plat approval an extensive agreement would be prepared outlining everything that needed coverage. Motion by Crosby, seconded"by Lutz to grant preliminary approval to Meadowwoods Plat subject to the following conditions: a. The applicant shall provide an easement for road access from Cherokee Rd. to Mead- owwoods Lane on an alignment which has been approved by the City Engineer and Director of Public Works. " B. The Meadowwoods Tune cal -de -sac shall not exceed 1227 feet in length. C. Upon filing the final plat, the applicant shall file with the Hennepin County recorder, a declaration on Lots 6,7,8 and 9, stating that construction upon the areas of those lots which are burdened by the NSP easement is subject to the app- roval of Northern States Power Company in accordance with its letter of May 7, 1980, and that construction on those lots is further subject to the set -back requirements of the Zoning Code of the City of Medina. D. All streets withing the development, together with Cherokee Dr. extended to Tam- arack, shall be paved with bituminous surfacing, street lighting and signs installed. E. The final plat is further subject to all applicable provisions of the subdivision regulations and other ordinances of the City of Medina. Motion declared carried 8. ELM CREEK HEIGHTS, 2ND. ADDITION, PLAT Discussion of the prepared list of conditions necessary to grant preliminary approval to the plat; Also the need to collect sewer and water connection charges for the 2 family dwelling constructed on Lot 1. Motion by Reiser, seconded by Crosby to grant preliminary approval to Elm Creek Heights 2nd Addition contingent upon: A. Compliance by the applicant with all conditions set forth in the City Engineer's letter of March 12, 1980. B. Compliance with the requirements of the Director of Public Works and the Zoning Administrator as set forth in the memorandum of the Zoning Administrator dated March 20, 1980. C. Subject to all applicable conditions of the subdivision regulations and other applicable ordinances of the City of Medina. D. Payment of $1630 in sewer and water connection fees prior to issuance of Cert- ificate of Occupancy. Motion declared carried 9. HAROLD P1 ERSON DIVISION JoEllen Hurr explained the division of Mr. Pedeisons 40 acres into 7 parcels. The 2 roads serving the parcels will be private driveways. Discussion of extending an easement to the westerly property line. Ms. Hurr explained that parcel 4 would then be less than 5 acres in size and the property lines would need to be realigned. She explained the Engineers opinion of the soils tests that had been taken on the various parcels. Motion by Crosby, seconded by Reiser to approve the Harold Pederson land division with a 60 ft. easement extended to the west boundary and to provide thatproperty lines between parcels 3 and 4 be adjusted so as to indicate that they are each 5 acres in size, without the ponded area. Motion declared carried 10. WATER SUPPLY COMPANY Thomas Crosby read from a letter he had received. from Marlon ffaugen regarding the possible purchase of the Medina Morningside water system, by the City., or the need to increase water rates before 1981. Council requested that a letter be written to Mr. Haugen explaining that the city is still interested in obtaining the system -but cannot do anything until a determination has been made regarding the application for Federal funds to construct a sewer system in the area. 11. SCHLOSSERKARENEMI JoEllen Hurr explained that Mr. Karenemi is interested in purchasing commercially zoned property from Mr. Schlosser to construct a residence and had discussed with her the poss- ibility of the city rezoning the property to residential. Council asked that definit plans or a request be brought before the city by Mr. Schlosser. 12. DAN QUAST JoEllen Hurr explained that Mr. Quast had begun some extensive land alteration on his property on Chippewa Rd. without a land alteration permit and was not cooperating with requests made by the City to comply with requlations regarding securing a permit. Attorney Schieffer stated that he would look into the matter and issue a complaint, if necessary. 13. ANNE THEIS Motion by Lutz, seconded by Crosby to adopt Resolution 80-16, amending the property des- cription originally covered in Resolution 79-22. Motion declared carried 14. TRACT J, REGISTERED LAND SURVEY 1049 Richard Schieffer explained a request that he had received to provide some assurance that the city will not revoke the rights of those property owners abutting Tract J to continue to use as a private drive. Motion by Crosby, seconded by Lutz to approve Resolution 80-17, granting permission to use Tract J, Registered Land Survey 1049 for road purposes, setting a fee of $100. Motion declared carried 15. CANAAN FELLOWSHIP JoEllen Jurr reported that the mobile home being used as an office at 4175 Brockton Lane had been removed. 16. DOCKSIDE INN LICENSES Motion by Reiser, seconded by Crosby to grant an On -Sale Intoxicating Liquor license to John Spaeth dba Dockside Inn, for 1980-81. Motion declared carried Motion by Reiser, seconded by Crosby to grant an Off -Sale Intoxicating Liquor license to John Spaeth, dba Dockside Inn, for 1980-81. Motion declared carried Motion by Reiser, seconded by Crosby to grant a Sunday Liquor license to John Spaeth, dba Dockside Inn for 1980-81, Motion declared carried 17. BILLS Motion by Crosby, seconded by Lutz to pay the bills; Order Checks # 8810-8867 in the amount of $57,967.47 and Payroll Checks # 5758-5783 in the amount of $9,939.60. Motion declared carried 18. TAX FORFEIT LOTS Richard Schieffer explained that 4 lots in Independence Beach had been sold at auction by the State, after Medina had passed a resolution requesting they not be sold as they are unbuildable lots. (h E) He reported that Bloomington had lots sold under a similar situation and he would like to investigate the matter further. Council agreed that he should pursue the matter with Bloomington officials. 19. FIB MARSHALL Loren Kohnen discussedwith Council, posistion of Fire Marshall. Motion by Reiser, seconded by Lutz of $7.00 per hour, for 6 hours per Motion declared carried the possibility that he be considered for the to appoint Loren Kohnen as Fire Marshall, at a fee month and payment of $.18 per mile travel expense.
