No minutes were submitted for approval. 2. Discussion of DOR requirement: a. FY 2007 Funds will be available July 1, 2006 b. FY 2006 Funds will also be available after July 1, 2006, but only after a Special Town Meeting to release the funds that are now in the pot. There followed a discussion of the October 24t" CPA Conference: 3. Carr—There was a representative from DOR. The CPA has a very complex administrative process; funds need to be carefully monitored. There were discussions of what other towns have done under the CPA. a. Some have re-zoned all large parcels and allow only cluster developments with 60+% Open Space and required Affordable Housing. b. Individual hearings need to be held for each application that will go to Town Meeting. c. DOR monitors all funds —so the CPC must be very careful how and when monies are given out. Need to pay out funds as project phases are completed. d. Critical to have a written time line for projects. e. All expenses for a project have to be listed, including legal fees. 4. Robinson —At the Historic Preservation meeting, other Towns indicated: a. Problems with the BOS, needed to protect CPA funds. b. It was very clear that PR plays an important role in all CPC activities. c. Projects that ran for a long term (over a year) needed regular quarterly updates. Bills were paid on a quarterly basis, with written proof of any and all work that had been done. d. Be wary of contracts without a written time line. e. Be careful about the wording of Town Meeting articles. Community Preservation Committee Minutes October 26,2005 Page 1 of 3 Robinson recently had lunch with the HDC attorney. He expressed concern over violations of the open meeting law. All subgroups need to have open, posted meetings and minutes must be taken. There followed discussion of whether small group meetings require posting and minutes. S. Ruchinskas—Wants to be able to meet with all the applicants— have each applicant meet with the whole committee. 6. Robinson —We need to have the BOS appoint a Historic Commission. 7.Taylor—There is actually a Historic Commission listed in the Town Board/Committee book—just no one has been appointed. 8. Robinson -The OKHHD has a specific charter— it cannot deem houses historic or not—a Historic Commission could do that. The OKHHD is the largest Historic District in the country. 9. Bassett—we should ask the BOS to appoint people to the Committee. 10. Ruchinskas—Will we be using outside counsel? We will need someone to monitor items such as construction bills, etc. 11.There followed a long discussion on monitoring issues, the need for consultants, the release of monies in phases during projects, who would oversee what, etc. 12. Lach —Paul Ruchinskas knows the housing community very well. Laura Schufeldt and Bob Murray were hired to do the Town of Eastham Housing reviews. Bob Murray functions something like a Clerk of the Works. 13. Robinson — relative to Historic Preservation —the seminar indicated that one must hire consultants, and this money must come out of the money for each project. 14. Hush —It appears that it will be important to have our own attorney. Especially where it concerns bonding. We should hire Bond Counsel to draft our Town Meeting Articles. 15. Hush—Are there some conflict of interest issues here? Can members propose projects? e.g. can Open Space vote on Open Space applications? Housing on housing applications? Can HDC present a grant? We should check with Chatham to see who votes on their applications. 16. Discussion of how the CPC Forum will be run: Carr—will speak first— provide introduction and short history. Hush —Affordable Housing introduction Ruchinskas—Intro. self Reyburn —Intro. self Taylor—Open Space introduction Lach —Intro. self McKenna —Intro. self Robinson — Historic Preservation Introduction Bassett— Recreation Introduction Each person will say something about who they are, their background and add anything to what the initial speaker talked about for their area of expertise. The floor will then be opened up for questions. Community Preservation Committee Minutes October 26,2005 Page 2 of 3 17. Lach—What is the Role of the CPA? How do we see our role?We act as a filtering, review process, to make recommendations after receiving input from the various committees. 18. Carr—We make recommendations to Town Meeting. 19. Hush —We should say some of the applications will come from outside of the Committee, some from within. All will be discussed in public meetings. 20. Ruchinskas—We will be getting input from a variety of sources and then reviewing the applications. It is very important that we know what our priorities are. How do we get the best bang for the buck! 21. Lach —It is very important that the voters know they have the control —we are their representatives, not our own representatives. 22. CARR- FORUM — Next week—Taylor will make copies of flyer. Paul Hush will post flyers and make sure we are listed on the Public cable channel calendar, too. Meeting adjourned at 5:20 PM.
