A RESOLUTION: 96-54 INITIATING AN AMENDMENT SUBDIVISION AND LAND PRESENTED March 12, 1996 ADOPTED March 12, 1996 TO SECTION 13-75(c)(2) OF THE DEVELOPMENT REGULATIONS REGARDING COMMON PARKING COURTS WHEREAS, the Town of Leesburg seeks to provide a safe and efficient transportation system serving automobiles, pedestrians and bicycle traffic in all sectors of the community; and WHEREAS, common parking courts do not meet the same road standards as that of public streets within the Town; and WHEREAS, traffic flow on a common parking court can be increased without the requirement of comparable street design improvements; and WHEREAS, the Town has no explicit performance criteria for evaluating requests for variations to Section 13-75(c)(2) allowed under the current regulations; and WHEREAS, the Town has received numerous complaints from citizens concerning common parking courts, including but not limited to, road maintenance and snow removal, and safe and convenient school bus pickup of children; and WHEREAS, a majority of the Planning Commission believes that only single-family attached dwellings should be allowed on a common parking court; and WHEREAS, amendment of this provision of the Leesburg Subdivision and Land Development Regulations is in the best interest of the public necessity, convenience, general welfare and good planning practice: THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: An amendment to Section 13-75(c)(2) of the Town of Leesburg Subdivision and Land -2- INITIATING AN AMENDMENT TO SECTION 13-75(c)(2) OF THE SUBDVISION AND LAND DEVELOPMENT REGULATIONS REGARDING COMMON PARKING COURTS Development Regulations to eliminate language which would allow single-family detached and two- family dwellings on common parking courts and further to create road design considerations for use on common parking courts which exceed a certain traffic volume is initiated. This amendment is referred to the Planning Commission for a public hearing and recommendation under Chapter 11, Title 15.1-43 ! of the Code of Virginia, as amended.
