Mayor Harker called the regular meeting of the City Council to order at 7:30 P. M. Invocation was given by Councilman Nunamak- 2. er in the absence of Rev. Dunkelberger of the Baptist Church. 3. Mayor Harker then led the Pledge of Allegiance to the Flag. 4. ROLL CALL: Present: Councilmen- Dickason, Nunamaker, Tyrell, Harker Absent: Councilman- Merritt Also Present: City Attorney Martin, City Attorney Kramer, City Treasurer Buchan, and Acting City Manager Koski 5. APPROVAL OF MINUTES: Regular meeting of August 3, 1965. Councilman Nunamaker moved to approve the minutes of the regular meeting of August 3, 1965, as mailed, Councilman Dickason second- ed and the motion was unanimously carried. At this time Mayor Harker requested Mrs. Loui Clarkson to come forward. He then commended her for her fine services as Chairman of the Sister City Committee for the past year and presented her with a Certificate of Recognition on behalf of the Council and the City. UNFINISHED BUSINESS: 6. ORDINANCE NO. 65 -173: 2nd read. Re- authorizing contract with SERS, City Attorney Martin read title to Ordinance No, 63 -173 AN ORDI- NANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING A CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA STATE EMPLOYEE RETIREMENT SYSTEM. Councilman Tyrell moved to waive further reading of Ordinance No. 65 -173, Councilman Nunamaker seconded, the motion was unanimously carried. Councilman Tyrell moved to adopt Ordinance No. 65 -173, Councilman Nunamaker seconded, and the motion was carried by the following roll call vote: AYES: Councilmen - Dickason, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman - Merritt PUBLIC HEARING: 7:30 P. M. Re Bringing building, electrical & plumbing codes up to date to coincide with the County Ordinance Councilman Nunamaker moved to open the public hearing, Council- man Dickason seconded, and the motion carried unanimously. The City Attorney advised these hearings were legally required when i an ordinance is adopted by reference. Mayor Harker asked if any- one wished to speak for or against this ordinance. No one came forward to speak. Councilman Tyrell moved to close the Public Hearing, Councilman Nunamaker seconded, motion unanimously carri, ed. City Attorney Martin read title to Ordinance No. 65 -170 which is the second reading, AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 8100, 8200, AND 8300 OF THE TEMPLE CITY CODE RELATING TO THE ADOPTION OF THE 1965 EDITION CF THE LOS ANGELES COUNTY BUILDING LAWS, ELECTRICAL LAWS & PLUMBING LAWS, BY REFER- ENCE. Councilman Nunamaker moved to open the Public Hearing, Councilman Tyrell seconded, the motion was carried unanimously. Mayor Harker asked if anyone wished to speak for or against this ordinance. No one came forward to speak. Councilman Nunamaker moved the public hearing be closed, Councilman Tyrell seconded, the motion carried unanimously. Councilman Dickason moved to waive further reading of Ordinance No. 65-171 and to adopt, Councilman Tyrell seconded, roll call vote to carry the motion as follows: AYES: Councilmen - Dickason, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman- Merritt PUBLIC HEARING: 7 :30 P. M. ASSESSMENT HEARING, Curb & Gutter, 10102 La Rosa Ave., in the sum of $80. Acting City Manager Koski requested this be held over until the meeting of September 7, 1965, Councilman Tyrell so moved, Coun- cilman Nunamaker seconded, motion unanimously carried. PUBLIC HEARING: 7 :30 P. M. OPENING OF BIDS FOR BONDS TO BE ISSUED FOR UNPAID ASSESSMENTS LEVIED ON LANDS IN VEHICLE PARKING DISTRICT NO. 1 City Attorney Martin stated three bids had been received. He recommended Acting City Manager Koski be appointed Street Super- intendent to replace Mr. Woollett for Parking Dist, purposes. Councilman Oickason so moved, Councilman Nunamaker seconded, and the motion was unanimously carried by roll call vote. Mayor Harker announced this to be the time and place fixed for opening of bids for $160,756,09 of bonds to be issued to repre- sent unpaid assessments levied upon lands within Vehicle Parking District No. 1, and requested the City Clerk and City Treasurer to open the three bids received, examine and read them. Bids received as follows: Name of Bidder Interest Rate Premium if tie 1, Charles L. Swanton, Bev. Hills 4.24% $161. accompanied by good faith check in amount of $5000. 2. Taylor & Co., Beverly Hills 4.60% $ 51. accompanied by good faith check in amount of $4900. 3. J. B. Hanauer & Co., Bev, Hills 4.75% $128„ accompanied by good faith check in amount of $4822.71 Mayor Harker excused the City Treas.& Acting City Manager, for checking and computation, a report thereon to be given to the Council later during the meeting. 7. Item 7 was held over for presentation by Acting City Manager Koski later in the meeting. NEW BUSINESS: 8. RESOLUTION NO. 65 -513: adopting "NO TAX RATE" for fiscal year 1965 -66 - City Attorney Martin read title to Resolution No. 65 -513 A RE- SOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY INDICAT- ING NO CITY TAX RATE FOR THE FISCAL YEAR 1965 -66. Councilman Dickason moved to adopt resolution No. 65 -513, Councilman Nuna- maker seconded, the motion carried by the following called vote: AYES: Councilmen- Dickason, Nunamaker, Tyrell, Harker, NOES: Councilmen -None ABSENT: Councilman- Merritt 9. RESOLUTION NO. 65 -514: Re annexation to L. A. County Lighting aintenance District #1395, Petition #71 -45, Dnal Dev. Inc., Tract #29569, Randwick & Degas Sts. Councilman Tyrell moved to adopt Resolution No. 65 -514, Council- man Nunamaker seconded, roil call vote to carry as follows: 789 Council Minutes, August 17, 1965, page 3 AYES: Councilmen- Dickason, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman- Merritt 10. APPEAL FROM PLANNING COMMISSION DECISION ZONE VARIANCE CASE #65- 163, Marantha High School, Applicant, Temple City Brethren Church: owner, 5537 Temple City Blvd. Appealed by John R. Gallagher, 9550 Wedgewood City Attorney Martin advised the Council he had been contacted by the attorney representing the Marantha High School requesting the Council to act on this matter tonight as it was causing a hardship as it would delay the opening of the school if a public hearing were scheduled. The City Attorney advised the Council may do one of three things, (a) affirm the action of the Plann- ing Commission, (b) require a summary of all evidence upon which the Commission made its decision; and after receiving such evi- dence shall take such action as in its opinion is indicated by such evidence alone; (c) refer back to the Planning Commission, or set for public hearing before the City Council. Following discussion and being advised Mr. Gallagher, who filed the appeal as well as others calling in had been advised they did not have to be present as the Public Hearing would be set and they would receive legal notice when this was to be heard before the Counci' Councilman Tyrell moved to set the Public Hearing for September 7, 1965, at 7:30 P. M., Councilman Dickason seconded. At this time Mr. John Hill, 9416 Olema St., speaking on behalf of the school asked if this could not be considered other than Sept. 7. in order to expedite the decision. Following discussion the vote on the motion on the floor was as follows to be carried: AYES: Councilmen - Dickason, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman- Merritt The Public Hearing will be scheduled for Sept. 7, 1965, at 7:30 P. M. with legal notice being given property owners in the re- quired area. PUBLIC HEARING: OPENING OF BIDS FOR BONDS: Cont'd, At this time the Committee appointed to check and compute the bids on the bonds to be issued to represent unpaid assessments upon lands in Vehicle Parking District No. I reported that the bid of Charles L. Swanton, Beverly Hills, interest rate of 4,24% was the best bid. After considering the various bids and the report thereon, Councilman Nunamaker moved to adopt Resolution No. 65 -515 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, AWARDING BONDS TO BE ISSUED TO REPRESENT UN- PAID ASSESSMENTS ON LANDS IN VEHICLE PARKING DISTRICT N0. 1 OF SAID CITY, Councilman Tyrell seconded, and the motion was carried adopting Resolution 65 -515 which awards the bonds to Charles L. Swanton at the interest rate of 4.24 %, the roll call vote as follows: AYES: Councilmen - Dickason, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman- Merritt 7. REPORT ON BRIDGE & STREET IMPROVEMENTS ON BROADWAY Acting City Manager Koski reviewed the written report on the proposed improvement of Broadway from Eaton ':,'ash to Rosemead Blvd. including reconstruction of the Broadway `grid ?e over Eaton Wash. This is to be a City- County joint participation in the improvement. Estimated design costs would be $10,000. which the County will fund. Construction cost estimated to be $85,000. with City's share $20,000., which would be budgeted July 1, 1966. City's right of way acquisition cost estimated to be $55,000. Following approval of the City - County agreement design work will be initiated. He outlined budget changes which could be made to fund the acquisition costs, and advised the project funds to be used are 186 Gas Tax Appropriations. He recommended Supervis- or Bonelli be advised of the City's interest and that an.agree- ment be prepared as soon as possible. Councilman Tyrell moved that the Mayor be instructed to advise the County by written communication of the City's interest in this project, Councilman Nunamaker seconded, and the motion was unanimously carried. 790 Council Minutes, August 17, 1965, pace 4 11. TRAFFIC COMMISSION RECOMMENDATIONS: Presented by Acting City Mgr Item 6. approval of crossing guard schedule as presented by the Traffic Engineer. Councilman Dickason moved to approve Councilman Tyrell seconded, motion unanimously carried. Item 9. installation of Stop sign with stop bar pavement mark- ings, street name signs, and not throuc7h- street sign at intersection of Garibaldi & St. J`:mes Dr. Council- man Nunamaker moved to approve, Councilman Tyrell se- conded, the motion was carried unanimously. Item 13 recommend Jr. Chamber of Commerce be commended for in- stallation of reflector buttons on Sultana & Baldwin. Councilman Dickason moved to approve, Councilman Tyrel seconded, and the motion was unanimously carried. The staff will prepare a letter for the Mayor's signature. 12. PLANNING COMMISSION RECOMNr.NDAT I ONS: 1. Res. #65 -171PC recommending Mobile Home Ordinance be incor- porated in City zoning regulations. (Ord. 65 -151). 2. Res. #65 -172PC recommending off - street parking ordinance be incorporated in City zonino regulations. (Ord. 65 -153 & Ord. 65 -162) City Attorney Martin advised that since the adoption of the zoning ordinance the Council has adopted Ordinances #65 -151 and #65 -153, and Ordinance No. 65 -162 will have its first read- ing at the next Council Meeting. In order to incorporate them into the Zoning Ordinance a Public Hearing must be held and he recommended one be set for Sept. 7, 1965, at 7:30 P. M. Coun- cilman Tyrell so moved, Councilman Nunamaker seconded, and the motion was unanimously carried. 13. APPROVAL OF SURVEY MONUMENTS & RELEASE OF FAITHFUL PERFORMANCE BOND, TRACT #29678, Baldwin Builders, Sawyer Tract, St. James Dr. in the sum of $570., Aetna Cas. & Surety Co. Acting City Manager Koski advised a letter had been received from the City Engineer recommending the City Council approve the survey monuments and tie points for Tract #29678 and to release the faithful performance bond in the sum of $570., surety the Aetna Casualty & Surety Co. Councilman Tyrell so moved, Councilman Nunamaker seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman- Merritt 14. PET I T IOC, RE PLANTING OF PARK':''AY TREES ROWLAND AVE. BETWEEN LAS TUNAS DR. & LIVE OAK AVE. Acting City Manager Koski presented a petition signed by prac- tically all of the residents in the above named area asking thy_ city to consider this area for trees in the next tree planting program. This would require approximately 42 trees at an estir: ated cost of $10. each, and is in accordance with the City tree planting program. Following discussion Councilman Dickason moved to give this request priority in the tree planting pro- gram, Councilman Tyrell seconded, and the motion carried by the following roll call vote: AYES: Councilmen- Dickason, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman- Merritt 15. RESOLUTION NO. 65 -516: Warrants & Demands Acting! City Manager presented Resolution No. b5 -516, warrants and demands in the sum of $8,699.17, No. 6936 through No. 6979. Councilman Tyrell moved to adopt Resolution Ho. 65 -516, Council man Nunamaker seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman- Merritt 16. COMMUNICATIONS: a. Acting City Manager Koski presented a request for a procla- mation of the month of September, 1965, as "Constitution Obser. vance Month" from Samuel E. Harris, Member of the 538th Masonic District. Councilman Tyrell moved to so proclaim, Councilman Nunamaker seconded, and the motion carried unanimously. Mark Schrock of the 538th Masonic ,District advised a special prograas 791 council Minutes, August 17, 1965, pace 3 b. T. C. Lions Club request a charitable solicitation permit for Oct. 1 and 2, and that these days be proclaimed as "White Cane Days" and that pertinent advertising be posted along main thoroughfares. Councilman Dickason moved to approve the designa- tion of "'.'kite Cane Days" Oct 1 and 2 and to approve the solici- tation, Councilman Tyrell seconded, and the motion carried unan- imously. c. The Acting City Manager presented letters from the L. A. County Boundary Commission re proposed annexations #1965 -1 and 1965 - ;, both for City of San Gabriel. Councilman Dickason moved to receive and file, Councilman Nunamaker seconded, and the mo- tion was unanimously carried. 17. TIME FOR THOSE I N THE AUDIENCE !!H0 WISH TO SPEAK: No one came forward at this time to speak. 18. MATTERS FROM CITY OFFICIALS: Councilman Tyrell asked about the traffic signals coordination on Las Tunas Dr. Acting City Manager Koski advised there are some problems in the equipment and they are being checked out at this time. He will follow through on expediting the correc- tion of the problems. Councilman Nunamaker reported to the Council on the activities of the League of California meeting. The proposed cigarette tax was not signed by the Governor, and the lease tax on cars and equipment will bring in large revenues to the cities. The Highway Patrol is in charge of all freeways even through the cities. The 1 gas tax comes off immediately and Bill 1150 was passed for building of parks and recreation areas. Councilman Nunamaker brought up for consideration the Southern California Association of Governments Formation Committee. He advised 71 cities and 4 counties have signed the agreement and others are considering membership at this time. Following dis- cussion Councilman Tyrell moved to pass. The motion died for lack of a second. Councilman Nunamaker then moved to join the group for one year, Councilman Dickason seconded, the motion carried by the following roll call vote: AYES: Councilmen - Dickason, Nunamaker, Harker NOES: Councilman - Tyrell ABSENT: Councilman- Merritt At this time Mayor Harker appointed Councilman Dickason as the City representative on SCAG. City Attorney Martin presented ordinance No. 65 -172 re charitable solicitation permits and requirements for a first reading. Councilman Tyrell moved to waive further reading Ord. No. 65 -172 Councilman Nunamaker seconded, and the motion unanimously carri- ed. No further action was taken as this was the 1st reading. Acting City Manager presented a request for an additional exten- sion of time of four months for Tract #21396. If granted this would give them a total of two years which is the maximum time allowed. Following discussion Councilman Nunamaker moved to grant, Councilman Dickason seconded, motion unanimously carriedo The Acting City Manager requested authorization to go to bid for a new truck for the park department for approximately $3500. This is in the budget. The City Attorney advised we did not have to co to bid on this type of purchase, only on public works. The Acting City Manager referred to his report concerning drain- age on Ladell Ave. southerly of Olive and recommended excavation of a shallow channel from Zadell Ave. cul de sac to the new Tract drainage structure and constructing a concrete line, the estim- ated cost of the work would be approximately $200.00. Council- man Nunamaker moved to approve the recommendation, Councilman Tyrell seconded and the motion carried by the following roll can vote: AYES: Councilmen- Dickason, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilman- Merritt 792 1 1 1 Council Minutes, August 17, 1965, pace 6 The Actin City Manager read a letter from the Soroptimist Club of Temple City requesting permission from the Council to conduct a Fashion Show at Live Oak Park which would involve stating when the merchandise shown is available and the price of same. Coun- cilman Nunamaker moved to approve the request, Councilman Dicke - son seconded and the motion was unanimously carried. Mr. Koski then presented a letter from the Sister City Committee requesting Council approval of the new slate of officers as submitted. Councilman Dickason moved to approve the slate, Councilman Tyrell seconded, and the motion carried unanimously. 19. ADJOURNMENT: Councilman Dickason moved to adjourn, seconded and unanimously carried. The Council adjourned at 3 :55 P. M. The next regular meeting of the City Council will be held on September 7, 1965, at 7:30 P. M. in the Council Chambers of the City Hall, 5930 Kauffman Ave., Temple City.
