HomeMy Public PortalAboutRES-CC-2008-04CITY OF MOAB COUNCIL RESOLUTION # 04-2008 A RESOLUTION CONDITIONALLY APPROVING THE FINAL PLAT FOR THE TWO -LOT, 200 SOUTH MINOR SUBDIVISION WHEREAS, 200 South Moab LLC, 12460 1st Street. P.O. Box 247, Eastlake, CO 80614, a Colorado Corporation, as the "Owner" of record of a parcel of land (hereinafter "Property"), .59 acres in size has, through agent, Kent Carlson ("Applicant"), 12460 1 st Street. P.O. Box 247, Eastlake, CO 80614, applied for a minor subdivision of the Property located on the southeast corner of the intersection of 200 South 200 East and more particularly described as follows: A parcel of ground situated in Section 1, Township 26 South, Range 21 East Salt Lake Base and Meridian being described as follows: Beginning at the Northwest Comer, Lot 1, 200 South Subdivision, thence along the right-of-way for 2"d South Street, S89°47'007 115.63 feet; thence, N00°17100"E 8.60 feet; thence S89°47'00"E 44.37 feet; thence leaving the right-of-way for ed South Street, S00°17'00"W 167.60 feet; thence N89°47'00"W 160 feet to the East right-of-way line for 2°d East Street; thence along said right-of-way, N00°17'00"E 159.00 feet to the point of Beginning, containing .59 acres as described. WHEREAS, the Applicant submitted to the Planning Commission (the "Commission") for review a preliminary minor subdivision plat showing two lots: Lot One consisting of 8,464.58 square feet (.19 acres) and Lot Two with 17,223.94 square feet (.40 acres); and, WHEREAS, the Commission reviewed the proposal in a regularly scheduled meeting held on December 27, 2007, and determined that the minor subdivision satisfies Chapters 16.08.020, Exceptions -Final plat, and 16.20.00, Required Improvements, in all aspects; and: 1. The subdivision is not traversed by lines of a proposed street, and does not require the dedication of any land for street or other purposes; 2. Each lot within the subdivision meets the frontage width and area requirements of the zone; 3. All final plat requirements have been met. WHEREAS, the Commission adopted Resolution No. 2007-08, on December 27, 2007, and favorably recommends to Council conditional approval of the plat for the 200 South Minor Subdivision with a single condition: proof of ownership of the previously vacated 122 square feet of right-of-way to address a building encroachment shall be submitted to the City. WHEREAS, Council reviewed the final plat of said minor subdivision in a regularly scheduled meeting held on January 8, 2008; and WHEREAS, Council finds that the proposed subdivision of the lot is consistent with the dimensional and other requirements of the Land Use Code and does not adversely affect the future development of the surrounding area. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOAB, UTAH: THAT, through adoption of Resolution No. 04-2008, the plat for the 200 South Moab Minor Subdivision is hereby approved with the condition that proof of ownership of the previously vacated 122 square feet of right-of-way to address a building encroachment shall be submitted to the City.
