RESOLUTION NO. 69 -905
A.RESOLUTION OF THE CITY OF TEMPLE
CITY GRANTING.A CONDITIONAL USE
PERMIT WITH CONDITIONS AND REVERSING
PLANNING COMMISSION RESOLUTION
NO. 69- 328PC. (Case No. 69 -281)
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES
RESOLVE:
SECTION 1. The City Council hereby finds and deter-
mines that an application for a Conditional Use Permit has
been filed by Gerald W. McClellan for certain real property
located in the City of Temple City, County of Los Angeles,
State of California, located at 5327 Baldwin Avenue in
said City, more particularly described as:
Parcel 8, Portion of Lot 12, Tract No. 6755.
Book 153, Pages 6 and 7 of Maps in the office
of the County Recorder, County of Los, Angeles,
State of California,
pursuant to Section 9203 of the Temple City Zoning Code
for the operation and maintenance of a service station.
SECTION 2. Resolution No. 69 -328PC of the Planning
Commission is hereby reversed.
SECTION 3. The City Council hereby finds and deter-
mines that the applicant has satisfied the requirements
of Section 9203 of the Zoning Code and said Conditional
Use Permit is hereby granted subject to the following
conditions, violation or failure to conform to any of
which shall constitute grounds for revocation:
1. That subject property shall be developed
substantially in accordance with the plot
plan marked Exhibit "A "; and
2. That the size of the proposed parking spaces
shall be 10' x 20'; and
3. That a demolition permit shall be obtained to
remove the existing structure (facing Olive),
pump islands and sign; and
4. That entrances to restrooms shall be screened
from view of adjacent properties or streets
by ornamental metal or screen masonry screen-
ing 6 feet high; and
5. That planting areas along the southerly property
line shall be provided and maintained; and
6. That planting areas adjacent to the street
frontage shall not exceed a height of 30" and
shall not encroach into public right -of -way;
and

7. That planting areas shall maintain permanent
irrigation system; and
8. That no vehicle parked on premises shall be
offered for sale, lease or rent; and
9. That all merchandise/Or automotive supplies
shall be restricted within the enclosed
building or on the pump islands; and
10. That no used or discarded automotive parts
or equipment shall be located outside the
service station except within an enclosed
trash storage area; and
11. That all outside trash, garbage and storage
area shall be connected to the main building
and be enclosed by a 6 foot high view -
obscuring wall; and
12. That the rental of equipment, and the sale
of merchandise, not related to the proposed
use, shall be prohibited; and
13. That no banners, bunting strips, signal flags
or flashing signs shall be permitted; and
14. That a 6 foot high masonry wall, except in
the required setback areas, shall be built
and maintained along the southerly and
westerly property lines; and
15. That all outdoor lighting shall be installed
and maintained so as to prevent reflection or
inconvenience to abutting or adjacent pro-
perties or public right- of- way;•and
16. That area light poles shall not exceed a
height of 16 feet; and
17. That revolving part of free - standing sign
shall not exceed 4 RPM, and 8 feet in
diameter, and shall not exceed 20 feet.
18. That all business activities, except
servicing of vehicles with gasoline and
oil, shall be confined to the hours between
7:00 a.m. and 91:00 p.m.; and
19. That all applicable City regulations shall
be complied with; and
20. No bare light tubes shall be permitted
on the service station site.

21. That this Conditional Use Permit shall expire and be
of no effect unless exercised within a period of one
year from and after the date of adoption of this resolution;
and
22. That the applicant shall file, or cause to be filed, with
the City Clerk, a document which the City may record
which shall acknowledge that the owner of the subject
property is aware of and accepts the conditions set forth
in paragraphs 1 through 21 above, and that the subject
property, regardless of any change in ownership, is bound
by and subject to the provisions of this Resolution and
the conditions contained herein.
SECTION 4. The City Clerk shall certify to the adoption of
this Resolution.
