HomeMy Public PortalAboutOrdinance 3548ORDINANCE NO. 3548 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIAL USE PERMIT TO OPERATE A MASSAGE THERAPY BUSINESS AT 14722 S. NAPERVILLE ROAD, UNIT 100, IN THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS WHEREAS, the Village of Plainfield has considered an application for a special use permit to operate a massage therapy business commonly known as Luna Azul Massage & Spa, on property located in the B-1, Business Convenience District, at 14722 S. Naperville Road, Unit 100, and the Plainfield Plan Commission has made certain findings based on the evidence presented in said case that: a. The special use will not be injurious to the use and enjoyment of other property in the immediate area for the purposes already permitted, nor substantially diminish property values within the neighborhood; and The establishment of the special use will not impede the normal and orderly development and improvement of the adjacent properties for uses permitted in the subject zoning district. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL AND KENDALL COUNTIES, ILLINOIS AS FOLLOWS: Section 1: Recitals - The President and Board of Trustees of the Village of Plainfield hereby adopt and incorporate as their own, the above findings recited. Section 2: Approval — The President and Board of Trustees of the Village of Plainfield hereby approve the application for a special use permit to operate a massage therapy business commonly known as Luna Azul Massage & Spa, on property located in the B-1, Business Convenience District, at 14722 S. Naperville Road, Unit 100, legally described as follows: THAT PART OF THE WEST HALF OF SECTION 10, TOWNSHIP 36 NORTH, RANGE 9, EAST OF THE THIRD PRINCIPAL MERIDIAN, DESCRIBED AS FOLLOWS: COMMENCING AT THE INTERSECTION OF THE NORTHWESTERLY RIGHT OF WAY OF THE ELGIN, JOLIET AND EASTERN RAILWAY, WITH THE NORTHWESTERLY RIGHT OF WAY LINE OF NAPERVILLE ROAD (STATE AID ROUTE 14); THENCE NORTHEASTERLY ALONG THE NORTHWESTERLY RIGHT OF WAY LINE OF NAPERVILLE ROAD, 15.0 FEET TO THE POINT OF BEGINNING; THENCE CONTINUING NORTHEASTERLY ALONG SAID RIGHT OF WAY LINE, 125.00 FEET TO A POINT; THENCE NORTHWESTERLY, PARALLEL WITH THE NORTHEASTERLY RIGHT OF WAY LINE OF SAID ELGIN, JOLIET AND EASTERN RAILWAY, A DISTANCE OF 253.90 FEET TO A POINT; THENCE SOUTHWESTERLY, AT RIGHT ANGLES TO SAID LAST DESCRIBED COURSE, 125.03 FEET TO A POINT 15 FEET NORTHEASTERLY OF THE SAID NORTHEASTERLY RIGHT OF WAY LINE OF THE ELGIN, JOLIET AND EASTERN RAILWAY; THENCE SOUTHEASTERLY, PARALLEL WITH THE NORTHEASTERLY RIGHT OF WAY LINE OF SAID ELGIN, JOLIET AND EASTERN RAILWAY, TO THE POINT OF BEGINNING, IN WILL COUNTY, ILLINOIS. Naperville Road, Suite 100, Plainfield, Illinois 60544 Section 3: Severability - The various portions of this Ordinance are hereby expressly declared to be severable, and the invalidity of any such portion of this Ordinance shall not affect the validity of any other portions of this Ordinance, which shall be enforced to the fullest extent possible. Section 4: Repealer - All ordinances or portions of ordinances previously passed or adopted by the Village of Plainfield that conflict with or are inconsistent with the provisions of this Ordinance are hereby repealed. Section 5: Effective Date — This Ordinance shall be in full force and effect from and after its passage and approval. PASSED THIS 7TH DAY OF MARCH, 2022.
