New Business/Public Hearings Case No. P16006 — Property in the 2500 Block of Hideaway Court, Rezoning and Comprehensive Plan Amendment. Request filed by Sully Properties LLC, property owner, on behalf of Don Renkemeyer, applicant, for a rezoning of 1.12 acres from RA-2 High Density Residential to C-2 General Commercial and an associated amendment to the Development Plan Map of the Comprehensive Plan. The property is located at the terminus of Hideaway Court, a private road, approximately 750 feet from the intersection of East McCarty Street, and is adjacent to the rear portion of property addressed as 2527 E. McCarty. The property is described as part of Reserved Tract 1 of Mount Hope Heights Subdivision, Jefferson City, Cole County, Missouri. Mr. Barron described the proposal and explained that the applicant is in the process of buying the 1.12 acre property, which is being split from a larger 4.24 acre property. He stated that the subject property is currently zoned RA-2 High Density Residential. He stated that there are two single family residential homes located on Hideaway Court, which is a private drive that intersects with E. McCarty Street. Mr. Barron explained that the applicant intends to construct mini-storage units on the property, as an expansion of his existing mini-storage business on the neighboring property. He stated that mini-storage uses are a conditional use of the C-2 zoning district. He stated that upon approval from the Planning and Zoning Commission and the City Council the applicant will need to file an application to the Board of Adjustment. Mr. Don Renkemeyer, 450 Cedar Creek Court, spoke regarding this request and explained that the easement will not affect the subject property or the two single family homes on Hideaway Court. He stated that a fence will be installed along the property line of the property to be rezoned. Mr. Renkemeyer explained that access to the proposed storage sheds will be from E. McCarty Street through the existing mini-storage business. Mr. Rick Alberts, 2530 Hideaway Court, expressed concerns regarding the easement and stormwater runoff. No one spoke in opposition to this request and no correspondence was received. Mr. Barron gave the Planning Division staff report. Mr. Dutoi moved and Mr. Nunn seconded to recommend approval of the comprehensive plan amendment request to show the property as Commercial on the Development Plan Map of the Comprehensive Plan to the City Council. The property is located at the rear of 2521 E. McCarty Street and a portion of adjacent property at 2527 East McCarty Street. The property is described as part of Reserved Tract 1 and part of Reserved Tract 2 of Mount Hope Heights Subdivision, Jefferson City, Cole County, Missouri. Minutes/Jefferson City Planning &Zoning Commission Page 3 August 11, 2016 Mr. Barron described the proposal and explained that a pocket of RS-2 residential zoning exists at the rear of the property addressed as 2521 E. McCarty Street, which is a property currently used in a commercial manner and a parking lot serving the commercial use is partially contained within the area zoned RS-2. He stated that a small portion of RS-2 zoning also exists on the adjacent property addressed as 2527 E. McCarty Street, which is currently in use as a mini-warehouse storage business. Mr. Barron explained that the purpose of the staff initiated rezoning request is to remove the split zoning situation on these two properties, bringing the zoning of each property into alignment under the C-2 General Commercial designation. He stated that an amendment to the development plan map of the Comprehensive Plan, from Medium Density Residential to Commercial, is also proposed to support the existing commercial use and proposed zoning of the two properties. No one spoke in opposition to this request and no correspondence was received. Mr. Barron gave the Planning Division staff report. Ms. Cotten moved and Mr. Vaughan seconded to recommend approval of the comprehensive plan amendment request to show the property as Commercial on the Development Plan Map of the Comprehensive Plan. Request filed by Wortman — Fortner LLC, property owner, for a Preliminary PUD Plan to demolish the existing convenience store, car wash and fuel pumps and redevelop the property with a new 6,780 sf convenience store, 5 dispenser fuel canopy, and 2,520 sf car wash with vacuum stations. The property consists of 1.32 acres and is located at the northwest corner of the intersection of South Country Club Drive and Fairgrounds Road /West Edgewood Drive. The property is described as part of the West Half of the Southeast Quarter of Section 8, Township 44 North, Range 12 West, Jefferson City, Cole County, Missouri (Cochran Engineering, Consultant). Mr. Barron described the proposal and explained that the property owner intends to redevelop the site by demolishing the existing convenience store, fuel pumps and car wash and rebuild similar structures in a new arrangement on the property. He stated that the property is zoned PUD Planned Unit Development, and the property owner has submitted a Preliminary PUD Plan detailing the redevelopment plan. Mr. Barron explained that an underlying zoning district of C-1 Neighborhood Commercial is proposed for this property. Mr. James Fortner, 601 Maupin Avenue, New Haven, Missouri, spoke regarding this request. Mr. Fortner explained that he partnered with Wortman this year who owns several Jack Flash stores in Illinois. He stated that the subject property is in disrepair and has a lot of potential. Mr. Fortner stated that he concurs with staff comments and recommendations. Mr. David Van Leer, Cochran Engineering, 530-A Independence Drive, Union, Missouri spoke regarding this request. Mr. Van Leer explained that he discussed staffs comments and recommendations with the applicant. He stated that they will address all of the comments and recommendations and resubmit the plan as requested. Mr. Ron Wolken, 4005 Cambridge Circle, spoke in favor on behalf of the residents of Georgetown Subdivision and commented that the proposed development will be an improvement to this area. No one spoke in opposition to this request and no correspondence was received. Mr. Nunn moved and Mr. Lester seconded to recommend approval, to the City Council, of the Preliminary PUD Plan with the following conditions: 1. Establishment of an underlying zoning designation of C-1 Neighborhood Commercial for the purpose of determining signage, outdoor lighting, and future permitted uses with addition of Convenience Store with Gasoline Sales and Vehicle Wash as a permitted use. 2. Modification of the Preliminary PUD Plan to address comments and technical corrections as identified by City Staff. Scheduled Reports --Environmental Quality Commission Mr. Lester reported that the City Council redefined the Environmental Quality Commission into the Wellness Committee. The Environmental Quality Commission will no longer be under the purview of the Planning and Zoning Commission. C. Turtle Creek Subdivision Mr. Barron explained that there is a subdivision proposal that staff were going to place on the agenda for this meeting. He stated that there were still technical issues to work out with the applicant's consultant. Mr. Barron explained that there is a desire by the developer to introduce the subdivision bill at the September 6, 2016 City Council meeting with approval on September 19, 2016. He stated that in order to accomplish this we would need to hold a special meeting with the Planning and Zoning Commission to review the plat and forward to City Council. Mr. Barron explained that this property is located off of South Country Club Drive and was formerly owned by the Scheperle family and has been sold to Jim Lage. Mr. George moved and Mr. Nunn seconded to schedule a special meeting, preferably over the noon hour in approximately two weeks as can be arranged by staff, to review the subdivision plat for Turtle Creek Subdivision. Other New Business Case No. P16010—1050 South Country Club Drive, Preliminary and Final Subdivision Plat of Turtle Creek Subdivision. Request filed by Lage LLC, property owner, for the following: 1. Preliminary Subdivision Plat of 34.55 acres consisting of 79 lots. 2. Final Subdivision Plat of 18.53 acres consisting of 39 lots. The property is zoned RS-2 Single Family Residential and is located on the west side of South Country Club Drive 350 feet north of Old Lohman Road and is described as part of the Southwest Quarter of Section 8 and part of the Northwest Quarter of Section 17, Township 44 North, Range 12 West, Jefferson City, Missouri (Central Missouri Professional Services, Consultant). Mr. Barron described the proposal and explained that this proposal is for the approval of a Preliminary Plat for Turtle Creek Subdivision consisting of 34.55 acres and approval of a Final Subdivision Plat consisting of 18.53 acres. He stated that the property is zoned RS-2 and is to be developed as a single family residential subdivision in three phases with access off of South Country Club Drive. Mr. Barron explained that Section One would consist of 39 lots. He stated that the Preliminary Plat shows four streets ending with cul-de-sac bulbs. He stated that right-of-way extensions to the property line are shown on three of the streets, which would allow for future connectivity to neighboring property. Mr. Barron explained that sidewalks are shown on the north side of Tanman Court and the east side of the other three streets. He stated that stormwater quality basins will be constructed on Lot 8 and Lot 65 and will be deeded to the City for maintenance once the infrastructure is completed. Mr. Mike Bates, Central Missouri Professional Services, 2500 E. McCarty Street, spoke regarding this request. Mr. Bates distributed two visuals that depict the layout of the proposed subdivision. He explained that the City implemented, per the Environmental Protection Agency(EPA), a stormwater quality ordinance in July 2015. Mr. Bates explained that the focus of the EPA transitioned from stormwater detention to stormwater quality, and the learning curve associated with this transition caused delay in the development of the plat. Mr. Jim Lage, 50 Lage Lane, Henley, Missouri spoke regarding this request. Mr. Lage clarified that the covenants and restrictions for the proposed Turtle Creek Subdivision will be the same as Lage Ridge Subdivision, Sections One and Two. No one spoke in opposition to this request and no correspondence was received. Mr. Wade gave the Engineering Division staff report. Mr. Barron gave the Planning Division staff report. Mr. Bates stated that he concurs with staff comments and recommendations. Capital Region is proposing a rezoning of the property from its current single family designation to Commercial Office. A request to amend the Development Plan Map of the Comprehensive Plan to show the property as an expansion of the Public and Semi Public intended land use for the hospital campus is attached to the rezoning request. Whether events subsequent to the Comprehensive Plan adoption have invalidated the Commission's original premises and findings made upon plan adoption Without question, events subsequent to the adoption of the 1996 Comprehensive Plan have radically changed the area surrounding the immediate campus of Capital Region Medical Center. During the past few years CRMC has invested $40 million in a medical office building adjoining the main campus to the north of the original hospital. This expansion was done in partnership with the City of Jefferson and Cole County to improve major infrastructure components of the plan. Specifically, Woodlawn Avenue was closed and vacated along with the widening of Monroe Street for two way traffic with a signalized intersection at Monroe and Stadium Boulevard. Concurrently, improvements were made for sanitary sewer and stormwater systems. Missouri American Water Company also invested significantly to improve water flows that were limited when the original hospital was built in the early 1950's. Over the last 20 years, CRMC has continued to acquire adjoining residential properties adjacent to their facilities. These acquisitions have allowed the expansion of parking and other support services as the hospital has grown. In 2015, CRMC initiated a planning study for an area surrounding the campus in anticipation of their continued growth and the changing character of the adjoining neighborhoods. The boundaries of the study were the Rex Whitten Expressway to the north, Broadway and Linden Avenue to the west/southwest to Myrtle Avenue; and Stadium Boulevard to the south and Lafayette Street to the east. Organizations included in the study were the Jefferson City Public School District, Lincoln University, Helias Catholic High School, and the City. To date, the study has involved community meetings and charrettes with advisory committee meetings. The ultimate goal is to finalize a plan that would be adopted by the City as a complimentary plan to the Comprehensive Plan. c. Whether the change is consistent with the goals, objectives and policies of the Plan. We believe the plan is consistent with the vision of an evolving comprehensive plan. d. Whether events subsequent to the Comprehensive Plan adoption have changed the character and/or condition of the area so as to make the application acceptable The initial planning process has identified a neighborhood that is in transition. It is the intent of CRMC to be the catalyst and be proactive in the redevelopment of this area. While there are major significant improvements underway throughout the neighborhood, there are areas where housing is falling into disrepair, potentially harming the entire area. e. Whether the change is needed to improve consistency between the Comprehensive Plan and other adopted plans. It is the vision of CRMC that this sub plan will complement the comprehensive plan. f. The property is located on the north side of East Capitol Avenue 250 feet west of Lafayette Street and is described as part of Inlots 135 and 136,Jefferson City, Missouri. Nature of Request There is an existing building on the property that has been used as a two unit apartment building in the past, with one unit accessible from the main entrance and one unit located on the second floor and accessible from a stairway on the east side of the building. The property owner wishes to market the main level unit as a commercial office rather than an apartment. The current zoning of RA-2 Multi-Family Residential does not permit conversion of the structure into an office, so the property owner is requesting a rezoning to the C-O Office Commercial zoning district to permit the office and second floor residential use. Central Eastside Neighborhood Plan City staff are in the process of finalizing documents that would implement the Central Eastside Neighborhood Plan (which was adopted as a component of the Comprehensive Plan in 2006) through a combination of rezoning and application of overlay districts. The Capitol Avenue area that includes this property is identified as being ideal for mixed office and residential use. The timeline for the rezoning and overlay district implementation has not been finalized(there are a number of items that will require additional public input after drafting). Zoning History Many of the properties and buildings along Capitol Avenue are currently occupied with office uses, despite being zoned RA-2. This is largely a result of past zoning, which permitted offices in the RA-2 district with a conditional use permit. Many of the properties received conditional use approval for use as an office, and their office use can continue indefinitely.
