Brewster Town Office Building 1. Present: Chairman Taylor convened the Planning Board meeting at 7:OOPM in the Brewster Town Office Building with members Henchy, Pierce, McMullen Remy and new member Amberlyn Tubman present. 2. Reorganize: Motion by Pierce, McMullen second, "Henchy for Chairman". All voted in favor. Motion by Henchy, Remy second, "McMullen Vice Chairman". All voted in favor. Motion by Henchy McMullen, "Pierce for Planning Board Clerk". All voted in favor. 3. All Board members thanked Taylor for her years as Chairman. All Board members welcomed Amberlyn Tubman to the board. 4. Discussion with Nat Kelly and Patricia Daley from Daley and Whitten consulting group- regarding reviewing town bylaws. 5. The Board discussed target issues regarding the grant that was received to review the Brewster bylaws. After the discussion it was decided to stay on target and have the consultants review the Zoning Bylaws for inconsistencies as stated in contract as task one with by weekly reports until finished. After this they will review the Subdivision rules and Regulations along with the suggested changes from the Ground Water Protection District bylaw. These must be reviewed together due to drainage issues in both regulations in order to have them consistant. 6. The Board will receive first report by June 21 s`, 2005 and have their first meeting on Wednesday June 291h, 2005 at 11:30am. 7. LEGAL HEARING—SPECIAL PERMIT #SP2005-06— CORRIDOR OVERLAY PROTECTION DISTRICT BYLAW—Sullivan- Located at Lot 6 Independence Drive, on Assessors' Map 27, Lot 2101-6— An approximately 3200 sf. Steel building with apartment, storage building for livery cars. Present: Mr. & Mrs. Sullivan. 8. Henchy opened the hearing and read the legal ad and departmental comments. BLDG—5-19-05 —retaining wall to meet yard setback. Identify use according to Brewster Zoning Bylaw Section II Table 1. Mechanical work performance on site?. CONS COM—5-25-2005 —the proposed is outside of the jurisdiction of the Brewster Conservation Commission. BOH—5-25-05 —BOH noted. FIRE DEPT—5-18-2005 —Smoke Detectors stem for apartment. Fire extinguishers. Heat Y p 1� properly done by code. Recommendations—sprinkler storage &apt. minimum. Fire Alarm for both storage and apt. Historic—Not applicable. DPW—No one to review. 9. Sullivan- approximately 3200 sf. steel building with apartment, storage building for livery cars. The building measures 28 x 20 and is proposed to be forest green with tan trim. Our need is to park our cars (limousines). Drivers for the cars will pick up when needed to do a job. I have seven parking spots. The cars will be stored in side the building. There will be no mechanical work or storage of fluids on site. There could be 6 to 10 trips a day from site. There are days that there may not be any. There will be no customers coming in. There will be an office with a phone. 10. The Board reviewed the proposal in accordance with Chapter 179-51 and 179-64. On a Motion by Remy, Pierce second"Closed to public input". All voted in favor. Motion by McMullen, Remy second, "approve application SP2005-06, draft special permit to be approved at next meeting". Roll call vote, all voted in favor. 10. LEGAL HEARING—SPECIAL PERMIT—SP2005-05 - DIRT ROAD ACCESS BY-LAW— CybuUFinn—removing an existing dilapidated building and constructing a single family dwelling with bedroom wing, detached garage and related future accessory structures to be located off Crowell's Bog Road on assessors' Map 49 Lot 10-2.No one present 11. Henchy-the applicant requests a withdrawal without prejudice. Motion by Remy, McMullen second, "Withdraw application#SP2005-05, without prejudice. All voted in favor. 12. CONTINUED LEGAL HEARING— SPECIAL PERMIT #SP2004-18—CORRIDOR OVERLAY PROTECTION DISTRICT BYLAW—SBCC Land Trust-Located on Sarah Ann Lane off Underpass Road, on Assessors' Map 26,Lots 11, 12, & 14—proposed 3200sf office building with a 2 bedroom apartment. No one Present. 13. Henchy—the applicant requests an indefinite postponement, due to the fact that we have continued this for almost a year and a postponement would mean abutter process of notification would need to be done, the application should be withdrawn without prejudice. Motion by Pierce, Remy second"Withdraw application#sp2004-18 without prejudice."All voted in favor. 14. Eastward Homes—Site Plan Review for lot 1 - Long Pond Landing Subdivision, Whidah Way on assessor's Map 48 Lot 8. Present: Susan Ladue, Eastward Homes. 15. The Board reviewed the site plan for lot 1 of the Long pond Landing Subdivision and on a motion by Taylor, Remy second, "Approve site plan for lot I". All voted in favor. 16. Eastward Homes request bonds released for Atwood Circle- $1,128.80; Captains Village- $5,400.00 and Tamer lane- $3,120.00. 17. Some members of the Board did an inspection of the roads and did not find any problems. The members were curious as to why there was no street light at Atwood Circle and Route 137. They decided to allow the police chief to decide if a street light was needed prior to Atwood Circle's release of funds. Motion by Pierce, McMullen second, "Approve release of Bonds as requested, except for Atwood Circle, get comments regarding streetlight from police Chief, if all is fine then release funds". All voted in favor 18.
