TOWN OF BREWSTER MINUTES OF PLANNING BOARD
Tuesday, October 4, 2005 7:00 P.M.
Brewster Town Office Building
1) Present: Chairman Henchy convened the Planning Board meeting at 7:OOPM in the Brewster Town
Office Building with members Taylor, Pierce, Bugle and Tubman present.
2) CONTINUANCE - LEGAL HEARING—SPECIAL PERMIT#SP2005-07— CORRIDOR
OVERLAY PROTECTION DISTRICT BYLAW—McGinnis applicant, Hopkins owner- Located
at 2750 Main Street,on Assessors' Map 14, Lot 61 — An approximately 3,150 sf. Retail/Restaurant
building with attached apartment.
3) The Board reviewed a letter from abutter Baxter. After reviewing the plan as revised by the Cape Cod
Commission the board decided to save the tree that was to be eliminated, therefore, asked the applicant
to revise the plans to move driveway back so that no trees would be removed. All other recommendation
of the Cape Cod Commission is to be complied with and revised plans submitted.
4) Motion by Pierce, Tubman second "approve Special Permit for McGinnisBayside Seafood with
conditions as discussed. Roll call voted all voted in favor.
5) CONTINUED LEGAL HEARING — SPECIAL PERMIT #SP2005-13 — CORRIDOR OVERLAY
PROTECTION DISTRICT BYLAW — Northside United Methodist Church - Located at 701
Airline Road, on Assessors' Map 37, Lot 52— Expansion of existing church facility and parking.
6) The board asked the applicant to remove 3 parking spaces from the front of the building. The board will
waive the requirement for numerical number of space from 138 to 135. The purpose is to keep as much
natural screening as possible. The Board will also revisit the permit after construction to see if more
screening/buffering is needed on the property.
7) Motion by Bugle, Pierce second "approve Special Permit with conditions." All voted in favor.
8) LEGAL HEARING—MODIFICATION OF SPECIAL PERMIT#SP2004-17— CORRIDOR
OVERLAY PROTECTION DISTRICT BYLAW—Boxer Shorts Realty Trust/Geraldine Boccio
Trustee/For the Love of the Breed - Located at 4018 Main Street, on Assessors' Map 30, Lot 22—
Proposed Two Story Addition, 2,300 SF with a 1 bedroom manager apartment. Modify-eliminate

9) The applicant submitted a letter to the Board stating that the exterior lights on the side and on the rear of
the building will be replaced by a white downcast light activated by a motion detector that turns off after
5 minutes. The second egress door on the rear of the building will be eliminated, because the new
addition will provide egress to the front of the building in compliance with the Mass Building Code. The
Board asked when the lights could be installed the applicant stated next week.
10) Abutter was present and submitted a letter to the Board that the Water Dept. had issued regarding
moving the water pipe line. The board stated that they would add a condition that they must comply with
the Water Dept. Letter of July 2, 2004.
11) The Board stressed that a letter be sent outlining the necessity of complying with the condition of the
lighting and deadline for installation of November 15, 2005 and compliance with the Water Department
Letter of July 2, 2004. The Board continued the hearing to October 18`h, for review of draft Special
Permit. All voted in favor.
